N\u00eb fund t\u00eb muajit, jam njoftuar se pritet t\u00eb lidhim nj\u00eb marr\u00ebveshje kredie me BERZH-in, Bank\u00ebn Evropiane p\u00ebr Rind\u00ebrtim dhe Zhvillim, p\u00ebr nj\u00eb shum\u00eb rreth 160 milion euro. Kuptohet se, gjithashtu, nj\u00eb arsye shum\u00eb e r\u00ebnd\u00ebsishme, ndoshta arsyeja m\u00eb e r\u00ebnd\u00ebsishme p\u00ebr k\u00ebt\u00eb vendim ishte q\u00eb n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb Qeveris\u00eb t\u2019i lejohet t\u00eb vazhdoj\u00eb q\u00eb p\u00ebrmes dekreteve me forc\u00eb ligjore t\u00eb mund\u00ebsoj\u00eb q\u00eb i gjith\u00eb sektori i sh\u00ebndet\u00ebsis\u00eb t\u00eb ballafaqohet m\u00eb suksessh\u00ebm me pandemin\u00eb.\u201c<\/p>\n<p>Q\u00eb nga fillimi i kriz\u00ebs n\u00eb mars 2020, Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut i ka <strong>monitoruar<\/strong> rregullisht masat e Qeveris\u00eb, ve\u00e7an\u00ebrisht n\u00eb kontekstin e respektimit t\u00eb t\u00eb drejtave themelore n\u00eb kuad\u00ebr t\u00eb <strong>Kapitullit 23<\/strong> &#8211; Gjykata dhe t\u00eb Drejtat Themelore. Duke i marr\u00eb parasysh zhvillimet e m\u00ebsip\u00ebrme dhe duke e monitoruar zhvillimin e ngjarjeve, Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut n\u00eb <strong>raportin<\/strong> e tij p\u00ebr muajin maj ve\u00e7an\u00ebrisht jep nj\u00eb p\u00ebrmbledhje p\u00ebr zbatimin e masave dhe ndikimin e tyre t\u00eb drejtp\u00ebrdrejt\u00eb te qytetar\u00ebt. Ngjash\u00ebm me muajt e kaluar dhe n\u00eb p\u00ebrputhje me trendin e konstatuar, duhet t&#8217;i kushtohet v\u00ebmendje ballafaqimit me <strong>kriz\u00ebn socio-ekonomike<\/strong> si rezultat i pandemis\u00eb \u2013 mbrojtjes s\u00eb komuniteteve t\u00eb <strong>margjinalizuara<\/strong>, zbatimit t\u00eb duhur t\u00eb <strong>masave <\/strong>mbrojt\u00ebse, mbik\u00ebqyrjes dhe zbatimit p\u00ebrkat\u00ebs s\u00eb tyre. Ajo q\u00eb e sh\u00ebnoi k\u00ebt\u00eb muaj ishte rritja e s\u00ebrishme e <strong>gjuh\u00ebs s\u00eb urrejtjes<\/strong> n\u00eb mediat sociale, q\u00eb \u00ebsht\u00eb nj\u00eb rezultat i drejtp\u00ebrdrejt\u00eb i relaksimit t\u00eb masave mbrojt\u00ebse dhe heqjes s\u00eb or\u00ebs policore, <strong>mosrespektimi i masave<\/strong> qeveritare nga disa <strong>udh\u00ebheq\u00ebs fetar\u00eb<\/strong> dhe rritje e numrit t\u00eb personave me COVID -19 n\u00eb fund t\u00eb muajit. N\u00eb fush\u00ebn politike dominonte debati p\u00ebr mbajtjen e <strong>zgjedhjeve t\u00eb parakohshme parlamentare<\/strong>. Partit\u00eb politike nuk ran\u00eb dakord p\u00ebr dat\u00ebn e mbajtjes s\u00eb zgjedhjeve, duke ofruar interpretime t\u00eb ndryshme p\u00ebr mund\u00ebsin\u00eb e realizimit t\u00eb tyre.<\/p>\n<p><u>M\u00eb 30 maj 2020<\/u>, <strong>Presidenti <\/strong>i shtetit edhe nj\u00ebher\u00eb e zgjati <strong>gjendjen e jasht\u00ebzakonshme<\/strong> n\u00eb Republik\u00ebn e Maqedonis\u00eb s\u00eb Veriut, duke sqaruar se \u201e&#8230;opinioni tashm\u00eb \u00ebsht\u00eb njoftuar se numri i rasteve t\u00eb reja me COVID-19, p\u00ebr fat t\u00eb keq edhe numri i bashk\u00ebqytetar\u00ebve tan\u00eb t\u00eb vdekur filloi t\u00eb rritet n\u00eb dit\u00ebt e fundit. \u00cbsht\u00eb e v\u00ebrtet\u00eb q\u00eb n\u00eb shumic\u00ebn e komunave situata \u00ebsht\u00eb stabile, por p\u00ebr disa komuna ekziston shqet\u00ebsim serioz.\u201c M\u00eb n\u00eb fund, Presidenti u b\u00ebri thirrje \u201eudh\u00ebheq\u00ebsve politik\u00eb q\u00eb marrin pjes\u00eb n\u00eb t\u00eb ashtuquajturat takime t\u00eb lider\u00ebve &#8211; shteti nuk ka parlament, ekziston nj\u00eb qeveri teknike q\u00eb ka autorizime t\u00eb kufizuara, situata \u00ebsht\u00eb shum\u00eb serioze. Kjo \u00ebsht\u00eb arsyeja pse un\u00eb k\u00ebrkoj nga t\u00eb gjith\u00eb ata q\u00eb t\u00eb jen\u00eb n\u00eb kulmin e p\u00ebrgjegj\u00ebsis\u00eb s\u00eb tyre historike dhe t\u00eb bien dakord p\u00ebr dat\u00ebn e zgjedhjeve t\u00eb ardhshme parlamentare, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb fitojm\u00eb institucione me kapacitet t\u00eb plot\u00eb dhe legjitimitet politik. Shteti thjesht nuk mund dhe nuk duhet t\u00eb funksionoj\u00eb me muaj vet\u00ebm n\u00ebse \u00ebsht\u00eb deklaruar nj\u00eb gjendje e jasht\u00ebzakonshme.\u201c<\/p>\n<p>T\u00cb DREJTAT E PUN\u00cbTOR\u00cbVE<\/p>\n<p><strong>AKTGJYKIM POZITIV P\u00cbR NJ\u00cb GRUA PUN\u00cbTORE GJAT\u00cb KOH\u00cbS S\u00cb GJENDJES S\u00cb JASHT\u00cbZAKONSHME<\/strong><\/p>\n<ol>\n<li><strong><u>Shkelje e t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve<\/u><\/strong><strong><u><br \/>\n<\/u><\/strong><\/li>\n<\/ol>\n<p>K\u00ebt\u00eb muaj, n\u00eb Komitetn e Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut jan\u00eb <strong>denoncuar 20 raste<\/strong> t\u00eb <strong>shkeljeve<\/strong> t\u00eb t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve ku jan\u00eb p\u00ebrfshir\u00eb <strong>218 pun\u00ebtor\u00eb<\/strong>. P\u00ebr dallim nga fillimi i gjendjes s\u00eb kriz\u00ebs, kur Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut ka regjistruar <strong>60 raste n\u00eb mars dhe 85 raste n\u00eb prill<\/strong>, kjo paraqet nj\u00eb <strong>ulje<\/strong> e konsiderueshme pas nj\u00eb periudhe m\u00eb t\u00eb gjat\u00eb. Megjithat\u00eb, si n\u00eb muajin e kaluar, n\u00eb muajin maj kemi regjistruar <strong>pushime<\/strong> t\u00eb paligjshme nga puna, <strong>paga t\u00eb reduktuara dhe\/ose t\u00eb papaguara dhe<\/strong> <strong>nd\u00ebrprerje t\u00eb detyruara<\/strong> <strong>t\u00eb<\/strong> <strong>kontratave t\u00eb pun\u00ebsimit<\/strong> me marr\u00ebveshje<strong>.<\/strong> Prandaj, p\u00ebr kat\u00ebr raste kemi parashtruar k\u00ebrkesa p\u00ebr kryerjen e nj\u00eb <strong>mbik\u00ebqyrjeje t\u00eb jasht\u00ebzakonshme inspektuese<\/strong> pran\u00eb Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs. Nj\u00eb k\u00ebrkes\u00eb \u00ebsht\u00eb parashtruar <strong>p\u00ebr uljen e pag\u00ebs<\/strong> t\u00eb nj\u00eb grupi <strong>pun\u00ebtor\u00ebsh t\u00eb s\u00ebmur\u00eb kronik<\/strong>, t\u00eb cil\u00ebt jan\u00eb pushuar nga detyrat e pun\u00ebs, dy k\u00ebrkesa jan\u00eb parashtruar p\u00ebr shkak t\u00eb <strong>mospagimit t\u00eb pagave<\/strong> p\u00ebr mbi 200 pun\u00ebtor\u00eb gjat\u00eb koh\u00ebs s\u00eb gjendjes s\u00eb kriz\u00ebs dhe k\u00ebrkesa e fundit i referohet <strong>pushimit t\u00eb paligjsh\u00ebm nga puna e nj\u00eb gruaje pun\u00ebtore shtatz\u00ebn\u00eb<\/strong>.<\/p>\n<p>Rekomandim: P\u00ebrve\u00e7 k\u00ebshillimit t\u00eb pun\u00ebtor\u00ebve q\u00eb t\u2019i p\u00ebrdorin vet\u00eb mekanizmat mbrojt\u00ebs n\u00eb rast t\u00eb <strong>shkeljes<\/strong> s\u00eb t\u00eb drejtave t\u00eb tyre, ne u kemi rekomanduar q\u00eb t\u00eb mos n\u00ebnshkruajn\u00eb marr\u00ebveshje p\u00ebr nd\u00ebrprerjen e kontratave t\u00eb tyre t\u00eb pun\u00ebsimit. Pun\u00ebtor\u00ebt q\u00eb tashm\u00eb kan\u00eb n\u00ebnshkruar kontrata pun\u00ebsimi p\u00ebr koh\u00eb t\u00eb pacaktuar, i k\u00ebshillojm\u00eb t\u00eb mos n\u00ebnshkruajn\u00eb kontrata pun\u00ebsimi p\u00ebr koh\u00eb t\u00eb caktuar, kurse n\u00eb shum\u00eb raste i kemi sqaruar edhe masat e miratuara nga ana e Qeveris\u00eb n\u00eb lidhje me kategori t\u00eb ndryshme t\u00eb pun\u00ebtor\u00ebve dhe grave pun\u00ebtore.<\/p>\n<ol>\n<li><strong><u>Masat ekonomike t\u00eb Qeveris\u00eb<\/u><\/strong><\/li>\n<\/ol>\n<p>Muaji filloi me <strong>p\u00ebrfaq\u00ebsimin e suksessh\u00ebm<\/strong> t\u00eb <strong>t\u00ebrheqjes<\/strong> s\u00eb Dekretit t\u00eb Qeveris\u00eb me t\u00eb cil\u00ebn nd\u00ebrmarrjeve q\u00eb p\u00ebrdorin <strong>ndihm\u00eb financiare nga shteti<\/strong> p\u00ebr pagimin e pagave u lejohej t\u00eb pushojn\u00eb nga puna deri n\u00eb 15% t\u00eb punonj\u00ebsve t\u00eb tyre. Sipas formulimit aktual t\u00eb Dekretit, <strong>p\u00ebrcaktohet<\/strong> q\u00eb <strong>pun\u00ebdh\u00ebn\u00ebsi<\/strong> q\u00eb do ta p\u00ebrdor\u00eb ndihm\u00ebn financiare p\u00ebr pagimin e pagave, <strong>nuk guxon t\u00eb ket\u00eb num\u00ebr t\u00eb zvog\u00ebluar t\u00eb t\u00eb pun\u00ebsuarve<\/strong> n\u00eb muajt prill dhe maj t\u00eb vitit 2020, si dhe dy muaj m\u00eb pas, deri n\u00eb korrik t\u00eb vitit 2020.<\/p>\n<p>Nga ana tjet\u00ebr, gjat\u00eb prezantimit t\u00eb <strong>paket\u00ebs s\u00eb tret\u00eb ekonomike<\/strong>, Qeveria e prezantoi mas\u00ebn \u201eKompensim me para p\u00ebr t\u00eb gjith\u00eb personat q\u00eb kan\u00eb ngelur pa pun\u00eb nga 11 mars deri m\u00eb 30 prill 2020&#8243;, si harmonizim me k\u00ebrkesat e <strong>sindikatave dhe organizatave t\u00eb shoq\u00ebris\u00eb civile<\/strong>. Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut, s\u00eb bashku me disa organizata t\u00eb shoq\u00ebris\u00eb civile dhe sindikatat, q\u00eb nga fillimi i kriz\u00ebs sh\u00ebndet\u00ebsore ka folur p\u00ebr abuzimet e shumta t\u00eb nd\u00ebrprerjeve t\u00eb kontratave t\u00eb pun\u00ebsimit me \u201emarr\u00ebveshje\u201d dhe deklaratave t\u00eb pun\u00ebtor\u00ebve t\u00eb marra me detyrim, p\u00ebr nd\u00ebrprerjen e marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs. Si rezultat i k\u00ebsaj, shum\u00eb pun\u00ebtor\u00eb dhe familjet e tyre kan\u00eb mbetur pa asnj\u00eb t\u00eb ardhur dhe nuk kan\u00eb mund\u00ebsi p\u00ebr pun\u00ebsim t\u00eb ri gjat\u00eb gjendjes s\u00eb jasht\u00ebzakonshme. Me k\u00ebt\u00eb <strong>mas\u00eb<\/strong>, t\u00eb gjith\u00eb personat q\u00eb e kan\u00eb humbur vendin e pun\u00ebs, p\u00ebrfshir\u00eb edhe ata q\u00eb e kan\u00eb nd\u00ebrprer\u00eb marr\u00ebdh\u00ebnien e pun\u00ebs p\u00ebrmes nj\u00eb deklarate me shkrim me marr\u00ebveshje ose jan\u00eb pushuar nga pun\u00ebdh\u00ebn\u00ebsi, do t\u00eb marrin <strong>kompensim me para<\/strong> nga Agjencia e Pun\u00ebsimit dhe kjo padyshim \u00ebsht\u00eb nj\u00eb fillim i mbar\u00eb. Me k\u00ebt\u00eb kompensim p\u00ebrfshihen t\u00eb pakt\u00ebn 8.000 pun\u00ebtor\u00eb, ekzistenca e t\u00eb cil\u00ebve u rrezikua seriozisht p\u00ebr arsye se ata mbet\u00ebn pa baz\u00ebn e vetme mbi t\u00eb cil\u00ebn i realizojn\u00eb t\u00eb ardhurat p\u00ebr jetes\u00ebn.<\/p>\n<p>Sidoqoft\u00eb, <strong>Qeveria nuk e respektoi marr\u00ebveshjen<\/strong> e arritur n\u00eb mbledhjen e 30 prillit, kur u b\u00eb marr\u00ebveshja q\u00eb k\u00ebta persona t\u00eb p\u00ebrfshihen n\u00eb <strong>zgjidhjen sistemore p\u00ebr sigurim<\/strong> n\u00eb rast t\u00eb <strong>papun\u00ebsis\u00eb<\/strong>, respektivisht t\u00eb marrin <strong>kompensim<\/strong> p\u00ebr nj\u00eb periudh\u00eb kohe q\u00eb varet nga koh\u00ebzgjatja e p\u00ebrvoj\u00ebs s\u00eb pun\u00ebs, dhe jo vet\u00ebm p\u00ebr 2 muaj.<\/p>\n<p>Fakti q\u00eb <strong>Qeveria<\/strong> nuk e mbajti fjal\u00ebn e saj dhe e <strong>t\u00ebrhoqi<\/strong> vendimin fillestar tregoi se sa i respekton pun\u00ebtor\u00ebt, grat\u00eb pun\u00ebtore dhe sindikatat, si p\u00ebrfaq\u00ebsues s\u00eb tyre. N\u00eb periudh\u00ebn e ardhshme, <strong>pritet<\/strong> q\u00eb Qeveria ta <strong>harmonizoj\u00eb<\/strong> edhe k\u00ebt\u00eb <strong>mas\u00eb<\/strong> me logjik\u00ebn q\u00eb q\u00ebndron n\u00eb <strong>Ligjin p\u00ebr pun\u00ebsim dhe sigurim n\u00eb rast papun\u00ebsie<\/strong> dhe ta harmonizoj\u00eb periudh\u00ebn e sigurimit me koh\u00ebzgjatjen e p\u00ebrvoj\u00ebs s\u00eb pun\u00ebs, n\u00eb vend t\u00eb nj\u00eb afati t\u00eb p\u00ebrcaktuar aty p\u00ebr aty p\u00ebr dy muaj, p\u00ebr t\u00eb gjith\u00eb pun\u00ebtor\u00ebt, pavar\u00ebsisht p\u00ebrvoj\u00ebs s\u00eb tyre t\u00eb pun\u00ebs.<\/p>\n<ol>\n<li><strong><u>Praktika gjyq\u00ebsore<\/u><\/strong><\/li>\n<\/ol>\n<p>N\u00eb fillim t\u00eb vitit 2019, nj\u00eb punonj\u00ebse e pun\u00ebsuar n\u00eb nj\u00eb institucion sh\u00ebndet\u00ebsor iu drejtua Komitetit t\u00eb Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut me nj\u00eb k\u00ebrkes\u00eb p\u00ebr <strong>ndihm\u00eb juridike falas<\/strong>. Ajo na informoi se pun\u00ebdh\u00ebn\u00ebsi ka filluar <strong>procedur\u00eb disiplinore<\/strong> ndaj saj p\u00ebr gjoja mosrespektim t\u00eb urdhrave me goj\u00eb t\u00eb dh\u00ebna nga eprorja e saj, respektivisht p\u00ebr <strong>shkelje t\u00eb rendit dhe disiplin\u00ebs s\u00eb pun\u00ebs<\/strong> p\u00ebr arsye se ajo nuk ka pranuar t\u2019i kryej\u00eb detyrat e saj t\u00eb pun\u00ebs. Procedura disiplinore ka konstatuar p\u00ebrgjegj\u00ebsi tek punonj\u00ebsja dhe ndaj saj \u00ebsht\u00eb shqiptuar mas\u00eb disiplinore n\u00eb form\u00ebn e gjob\u00ebs n\u00eb para n\u00eb shum\u00eb prej 15% t\u00eb pag\u00ebs s\u00eb paguar t\u00eb fundit, p\u00ebr nj\u00eb periudh\u00eb prej dy muajsh. Punonj\u00ebsja pohoi se procedura \u00ebsht\u00eb zbatuar n\u00eb m\u00ebnyr\u00eb tendencioze pa pranin\u00eb e saj dhe se d\u00ebshmitar\u00ebt e ngjarjes nuk jan\u00eb d\u00ebgjuar fare, dhe vendimi me t\u00eb cilin \u00ebsht\u00eb shqiptuar masa disiplinore ndaj saj nuk p\u00ebrmban asnj\u00eb arsyetim. Vendimi nuk ka specifikuar se \u00e7far\u00eb urdhri me goj\u00eb ka marr\u00eb punonj\u00ebsja dhe konkretisht cilat detyra t\u00eb pun\u00ebs ajo ka refuzuar t\u2019i kryej\u00eb. Prandaj, ajo ka apeluar me ankes\u00eb ndaj vendimit, por ankesa i \u00ebsht\u00eb refuzuar.<\/p>\n<p><strong>Me ndihm\u00ebn dhe mb\u00ebshtetjen e Komitetit t\u00eb Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut, p\u00ebrmes nj\u00eb avokati me t\u00eb cilin organizata jon\u00eb ka themeluar bashk\u00ebpunim, punonj\u00ebsja inicoi nj\u00eb kontest gjyq\u00ebsor kund\u00ebr vendimeve t\u00eb tilla para Gjykat\u00ebs Themelore Civile Shkup. K\u00ebt\u00eb muaj, Gjykata i dor\u00ebzoi nj\u00eb aktvendim punonj\u00ebses me t\u00eb cil\u00ebn ajo e pranoi padin\u00eb e saj, dhe i anuloi si t\u00eb paligjshme dy vendimet e marra nga institucioni sh\u00ebndet\u00ebsor dhe Bordi Drejtues i institucionit sh\u00ebndet\u00ebsor. <\/strong><\/p>\n<p>DISKRIMINIMI<\/p>\n<p><strong>P\u00cbRMBAJTJE DISKRIMINUESE N\u00cb DEKRETIN P\u00cbR NDRYSHIMIN DHE PLOT\u00cbSIMIN E DEKRETIT ME FUQI LIGJORE P\u00cbR ZBATIMIN E LIGJIT P\u00cbR ARSIM T\u00cb MES\u00cbM GJAT\u00cb KOH\u00cbS S\u00cb GJENDJES S\u00cb JASHT\u00cbZAKONSHME<\/strong><\/p>\n<p>Me Dekretin p\u00ebr ndryshimin dhe plot\u00ebsimin e Dekretit me fuqi ligjore p\u00ebr zbatimin e <strong>Ligjit p\u00ebr arsim t\u00eb mes\u00ebm<\/strong> gjat\u00eb koh\u00ebs s\u00eb gjendjes s\u00eb jasht\u00ebzakonshme (Gazeta zyrtare nr. 116\/2020 t\u00eb dat\u00ebs 05.05.2020) lirohen nga provimi i matur\u00ebs shtet\u00ebrore, matur\u00ebs shkollore, provimit p\u00ebrfundimtar me afat vlefshm\u00ebrie prej 3 vjet dhe provim t\u00eb dh\u00ebn\u00eb me afat vlefshm\u00ebrie prej kat\u00ebr vjet n\u00eb arsimin e mes\u00ebm gjimnazist, arsimin e mes\u00ebm profesional, arsimin e mes\u00ebm t\u00eb artit dhe arsimin e mes\u00ebm p\u00ebr nx\u00ebn\u00ebsit me nevoja t\u00eb ve\u00e7anta arsimore, nx\u00ebn\u00ebsit nga vitet p\u00ebrfundimtare t\u00eb arsimit n\u00eb vitin shkollor 2019\/2020. K\u00ebtyre nx\u00ebn\u00ebsve shkollat u japin diploma p\u00ebr kryerjen e arsimit t\u00eb mes\u00ebm.<\/p>\n<p>Nga ana tjet\u00ebr, me t\u00eb nj\u00ebjtin Dekret parashikohet q\u00eb nx\u00ebn\u00ebsit t\u00eb cil\u00ebt n\u00eb vitet e m\u00ebparshme shkollore i kan\u00eb kaluar provimet e matur\u00ebs shkollore ose provimet e kryera me afat vlefshm\u00ebrie prej kat\u00ebr vjet dhe kan\u00eb aplikuar p\u00ebr provimin e matur\u00ebs shtet\u00ebrore n\u00eb vitin shkollor 2019\/2020, nuk jan\u00eb t\u00eb liruar nga provimi i matur\u00ebs shtet\u00ebrore dhe p\u00ebr t\u00eb nj\u00ebjt\u00ebn \u00ebsht\u00eb organizuar mbajtja e provimeve p\u00ebr matur\u00eb shtet\u00ebrore. Nx\u00ebn\u00ebsit q\u00eb n\u00eb vitet e m\u00ebparshme shkollore kan\u00eb filluar me provimet e matur\u00ebs shtet\u00ebrore, matur\u00ebs shkollore, provimin p\u00ebrfundimtar me koh\u00ebzgjatje trevje\u00e7are ose provimin p\u00ebrfundimtar me koh\u00ebzgjatje kat\u00ebrvje\u00e7are, nuk i kan\u00eb kaluar dhe kan\u00eb aplikuar s\u00ebrish p\u00ebr provim n\u00eb vitin shkollor 2019\/2020, p\u00ebr t\u00eb nj\u00ebjtat do t\u00eb organizohet mbajtja e provimeve p\u00ebr matur\u00ebn shtet\u00ebrore, matur\u00ebn shkollore, provimin p\u00ebrfundimtar me koh\u00ebzgjatje trevje\u00e7are ose provimin p\u00ebrfundimtar me koh\u00ebzgjatje kat\u00ebrvje\u00e7are.<\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut reagoi n\u00eb lidhje me k\u00ebt\u00eb dispozit\u00eb kontestuese t\u00eb Dekretit n\u00eb Ministrin\u00eb e Arsimit dhe Shkenc\u00ebs.<\/p>\n<p><strong>KONKLUZION: Kjo dispozit\u00eb e Dekretit p\u00ebr ndryshimin dhe plot\u00ebsimin e Dekretit me fuqi ligjore p\u00ebr zbatimin e Ligjit p\u00ebr arsimin e mes\u00ebm gjat\u00eb koh\u00ebs s\u00eb gjendjes s\u00eb jasht\u00ebzakonshme, paraqet nj\u00eb trajtim t\u00eb pabarabart\u00eb t\u00eb t\u00eb dy grupeve t\u00eb p\u00ebrmendura t\u00eb nx\u00ebn\u00ebsve.<\/strong><\/p>\n<p><strong>REKOMANDIM:\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ne i b\u00ebjm\u00eb thirrje Ministris\u00eb s\u00eb Arsimit dhe Shkenc\u00ebs t\u00eb b\u00ebj\u00eb ndryshim dhe plot\u00ebsim t\u00eb k\u00ebtij Dekreti dhe t&#8217;i liroj\u00eb ata nga dh\u00ebnia e provimit t\u00eb matur\u00ebs shtet\u00ebrore, matur\u00ebs shkollore, provimit p\u00ebrfundimtar me koh\u00ebzgjatje trevje\u00e7are dhe provimit p\u00ebrfundimtar me koh\u00ebzgjatje kat\u00ebrvje\u00e7are n\u00eb arsimin e mes\u00ebm gjimnazist, arsimin e mes\u00ebm profesional, arsimin e mes\u00ebm t\u00eb artit dhe arsimin e mes\u00ebm p\u00ebr nx\u00ebn\u00ebsit me nevoja t\u00eb ve\u00e7anta arsimore p\u00ebr t\u00eb gjith\u00eb nx\u00ebn\u00ebsit n\u00eb vitet e fundit t\u00eb arsimit.<\/strong><\/p>\n<p>GRAT\u00cb PUN\u00cbTORE N\u00cb INDUSTRIN\u00cb E TEKSTILIT<\/p>\n<p><strong>SHUM\u00cb GRA PUN\u00cbTORE N\u00cb INDUSTRIN\u00cb E TEKSTILIT T\u00cb S\u00cb NJ\u00cbJT\u00cbS PUN\u00cbTORI TEKSTILI N\u00cb SHTIP JAN\u00cb POZITIVE ME COVID-19<\/strong><\/p>\n<p>N\u00eb muajin maj, s\u00eb bashku me organizat\u00ebn partnere Glasen Tekstilec, ne dokumentuam nj\u00eb rast t\u00eb disa grave pun\u00ebtore n\u00eb industrin\u00eb e tekstilit t\u00eb infektuara me COVID-19. N\u00eb fakt, n\u00eb nj\u00eb pun\u00ebtori tekstili n\u00eb Shtip n\u00eb muajin maj jan\u00eb <strong>regjistruar <\/strong>10 gra pun\u00ebtore pozitiv\u00eb me COVID-19 n\u00eb industrin\u00eb e tekstilit.<\/p>\n<p>Nga bisedat q\u00eb i kishin asistentet e Komitetit t\u00eb Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut me grat\u00eb pun\u00ebtore nga kjo pun\u00ebtori, mor\u00ebm informacion se n\u00eb uzin\u00ebn p\u00ebr prodhimin e konfeksionit \u00ebsht\u00eb <strong>siguruar distanca e p\u00ebrcaktuar<\/strong> nd\u00ebrmjet pun\u00ebtoreve gjat\u00eb kryerjes s\u00eb detyrave t\u00eb pun\u00ebs dhe se ambienti <strong>dezinfektohet rregullisht<\/strong>. Kjo \u00ebsht\u00eb konfirmuar edhe pas nj\u00eb <strong>mbik\u00ebqyrje t\u00eb jasht\u00ebzakonshme<\/strong> inspektuese nga ana e Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs, me \u00e7rast \u00ebsht\u00eb konstatuar se <strong>nuk ekzistojn\u00eb shkelje t\u00eb respektimit t\u00eb masave<\/strong>.<\/p>\n<p>Nga ana tjet\u00ebr, sipas informacioneve tona t\u00eb marra nga punonj\u00ebset e pun\u00ebtoris\u00eb, nuk jan\u00eb <strong>respektuar masat p\u00ebr transportimin<\/strong> e punonj\u00ebseve deri n\u00eb pun\u00ebtori dhe gjat\u00eb transportit nuk \u00ebsht\u00eb <strong>siguruar distanca e k\u00ebrkuar<\/strong> midis punonj\u00ebseve. P\u00ebrkat\u00ebsisht, disa nga <strong>punonj\u00ebset e infektuara<\/strong> jetojn\u00eb n\u00eb fshatrat af\u00ebr Shtipit dhe nd\u00ebrrojn\u00eb dy mjete transporti deri n\u00eb vendin e pun\u00ebs, s\u00eb pari, nga vendi i vendbanimit p\u00ebr n\u00eb Shtip udh\u00ebtojn\u00eb me furgon, dhe m\u00eb pas n\u00eb stacionin e autobus\u00ebve n\u00eb Shtip transferohen n\u00eb autobus\u00eb q\u00eb transportojn\u00eb punonj\u00ebse t\u00eb disa pun\u00ebtorive dhe k\u00ebshtu transferohen n\u00eb vendin e pun\u00ebs. N\u00eb asnj\u00ebr\u00ebn nga t\u00eb dy transportet nuk jan\u00eb <strong>respektuar rekomandimet<\/strong> p\u00ebr <strong>mbajtjen e distanc\u00ebs<\/strong> nd\u00ebrmjet punonj\u00ebseve, sepse n\u00eb t\u00eb dy transportet <strong>kan\u00eb<\/strong> <strong>udh\u00ebtuar m\u00eb shum\u00eb punonj\u00ebse se sa lejon kapaciteti i p\u00ebrshkruar<\/strong>.<\/p>\n<p>Lidhur me respektimin e masave nga ana e punonj\u00ebseve, kemi informacione q\u00eb num\u00ebr i madh i punonj\u00ebseve n\u00eb autobus\u00eb dhe n\u00eb vendin e pun\u00ebs, jo gjithmon\u00eb kan\u00eb mbajtur maska dhe\/ose maskat i kan\u00eb p\u00ebrdorur n\u00eb m\u00ebnyr\u00eb jo korrekte.<\/p>\n<p>Edhe pse deri m\u00eb tani jan\u00eb regjistruar 10 punonj\u00ebse t\u00eb infektuara nga kjo pun\u00ebtori, shqet\u00ebson fakti q\u00eb ka m\u00eb shum\u00eb punonj\u00ebse me simptoma t\u00eb COVID-19 dhe ato do t\u00eb testohen n\u00eb m\u00ebnyr\u00eb shtes\u00eb. Poashtu shqet\u00ebsues \u00ebsht\u00eb fakti q\u00eb an\u00ebtar\u00ebt e ngusht\u00eb t\u00eb familjeve t\u00eb punonj\u00ebseve t\u00eb infektuara, t\u00eb cil\u00ebt gjithashtu jan\u00eb pozitiv\u00eb me COVID-19, punojn\u00eb n\u00eb pun\u00ebtori t\u00eb tjera t\u00eb tekstilit n\u00eb Shtip, gj\u00eb q\u00eb e rrit edhe m\u00eb shum\u00eb <strong>rrezikun e p\u00ebrhapjes s\u00eb virusit<\/strong> n\u00eb mesin e punonj\u00ebseve t\u00eb tekstilit n\u00eb Shtip.<\/p>\n<p>Pas testeve pozitive t\u00eb punonj\u00ebseve t\u00eb para t\u00eb testuar n\u00eb pun\u00ebtorit\u00eb e tekstilit, pun\u00ebdh\u00ebn\u00ebsi p\u00ebrkoh\u00ebsisht e ka mbyllur pun\u00ebtorin\u00eb e tekstilit.<\/p>\n<p><strong>KONKLUZION: Mbetet konstatimi se punonj\u00ebsit dhe pun\u00ebdh\u00ebn\u00ebsit nuk i respektojn\u00eb dhe zbatojn\u00eb plot\u00ebsisht masat mbrojt\u00ebse p\u00ebr parandalimin e p\u00ebrhapjes s\u00eb virusit COVID-19 n\u00eb vendet e pun\u00ebs. Pun\u00ebdh\u00ebn\u00ebsit dhe transportuesit nuk e kan\u00eb respektuar Dekretin me fuqi ligjore p\u00ebr zbatimin e Ligjit p\u00ebr Transport Rrugor gjat\u00eb koh\u00ebs s\u00eb gjendjes s\u00eb jasht\u00ebzakonshme, sipas t\u00eb cilit gjat\u00eb transportit publik t\u00eb udh\u00ebtar\u00ebve, gjat\u00eb gjendjes s\u00eb jasht\u00ebzakonshme, transportuesi \u00ebsht\u00eb i detyruar ta organizoj\u00eb transportin duke e mbajtur distanc\u00ebn e detyrueshme prej t\u00eb pakt\u00ebn dy metrave nd\u00ebrmjet udh\u00ebtar\u00ebve dhe q\u00eb t\u00eb guxoj\u00eb t\u00eb ket\u00eb maksimalisht deri n\u00eb 50% t\u00eb udh\u00ebtar\u00ebve nga numri i p\u00ebrgjithsh\u00ebm i ul\u00ebseve, duke mos e llogaritur ul\u00ebsen e shoferit.<\/strong><\/p>\n<p><strong>REKOMANDIM:\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ju b<\/strong><strong>\u00ebjm\u00eb thirrje pun\u00ebdh\u00ebn\u00ebsve dhe pun\u00ebtor\u00ebve q\u00eb plot\u00ebsisht dhe n\u00eb m\u00ebnyr\u00eb t\u00eb vazhdueshme t<\/strong><strong>\u2019<\/strong><strong>i respektojn\u00eb masat mbrojt\u00ebse dhe parandaluese kund\u00ebr<\/strong> <strong>COVID-19 gjat\u00eb pun\u00ebs, n\u00eb drejtim t\u00eb mbajtjes s\u00eb maskave mbrojt\u00ebse n\u00eb m\u00ebnyr\u00eb korrekte, mbajtjes s\u00eb distanc\u00ebs gjat\u00eb kryerjes s\u00eb procesit t\u00eb pun\u00ebs dhe dezinfektimit t\u00eb procesit t\u00eb pun\u00ebs. Pun\u00ebdh\u00ebn\u00ebsit dhe transportuesit ta organizojn\u00eb transportin e pun\u00ebtor\u00ebve deri tek vendet e pun\u00ebs n\u00eb p\u00ebrputhje me Dekretin me fuqi ligjore p\u00ebr zbatimin e Ligjit p\u00ebr transport rrugor gjat\u00eb gjendjes s\u00eb jasht\u00ebzakonshme. U b\u00ebjm\u00eb thirrje t\u00eb gjitha grave punonj\u00ebse n\u00eb industrin\u00eb e tekstilit, t\u00eb cilat konsiderojn\u00eb se pun\u00ebdh\u00ebn\u00ebsit e tyre nuk i respektojn\u00eb masat mbrojt\u00ebse dhe parandaluese kund\u00ebr COVID-19 me rastin e transportit n\u00eb vendet e pun\u00ebs dhe\/ose gjat\u00eb procesit t\u00eb pun\u00ebs, at\u00eb ta denoncojn\u00eb n\u00eb Komitetin e Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut ose n\u00eb Glasen Tekstilec. Ne i b\u00ebjm\u00eb thirrje Ministris\u00eb p\u00ebr Pun\u00eb t\u00eb Brendshme q\u00eb t\u00eb kryej\u00eb kontrolle t\u00eb intensifikuara mbi transportuesit q\u00eb kryejn\u00eb transport t\u00eb punonj\u00ebseve t\u00eb tekstilit n\u00eb vendet e pun\u00ebs.<\/strong><\/p>\n<p>BARAZIA GJINORE<\/p>\n<p><strong>D\u00cbSHTUAN INSTITUCIONET PAR\u00cbSORE P\u00cbR MBROJTJEN E VIKTIMAVE T\u00cb DHUN\u00cbS N\u00cb FAMILJE<\/strong><\/p>\n<p>Q\u00eb nga muaji mars i k\u00ebtij viti, me fillimin e gjendjes s\u00eb kriz\u00ebs me virusin korona, kur u shpall p\u00ebr her\u00eb t\u00eb par\u00eb <strong>gjendja e jasht\u00ebzakonshme<\/strong> n\u00eb territorin e vendit ton\u00eb, Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut e <strong>ngriti alarmin se numri i rasteve t\u00eb dhun\u00ebs n\u00eb familje <\/strong>ka gjasa t\u00eb rritet ndjesh\u00ebm. Si m\u00eb par\u00eb, ashtu edhe gjat\u00eb koh\u00ebs s\u00eb k\u00ebsaj gjendjeje, puna e <strong>institucioneve kompetente<\/strong> q\u00eb jan\u00eb t\u00eb detyruara t\u00eb marrin masa p\u00ebr parandalimin dhe mbrojtjen e viktimave \u00ebsht\u00eb duke u <strong>monitoruar nga af\u00ebr<\/strong>.<\/p>\n<p><strong>Qendra p\u00ebr Pun\u00eb Sociale<\/strong> \u00ebsht\u00eb nj\u00ebra nga institucionet q\u00eb e p\u00ebrfaq\u00ebson <strong>mekanizmin par\u00ebsor mbrojt\u00ebs<\/strong> p\u00ebr viktimat e <strong>dhun\u00ebs n\u00eb familje<\/strong>, kurse zyrtar\u00ebt e pun\u00ebsuar n\u00eb ato institucione zakonisht jan\u00eb kontakti i par\u00eb i viktimave. K\u00ebt\u00eb muaj ishin shqet\u00ebsuese ankesat q\u00eb arrit\u00ebn nga dy gra viktima t\u00eb dhun\u00ebs n\u00eb familje, q\u00eb i referohen Qendr\u00ebs p\u00ebr Pun\u00eb Sociale n\u00eb Kriva Pallank\u00eb. Nj\u00ebri rast i referohej nj\u00eb viktime, t\u00eb cil\u00ebs personat zyrtar\u00eb <strong>kan\u00eb refuzuar t\u2019<\/strong><strong>i ofrojn\u00eb ndihm\u00eb<\/strong> dhe mb\u00ebshtetje p\u00ebr shkak t\u00eb adres\u00ebs s\u00eb vendbanimit t\u00eb saj, e cila ka qen\u00eb n\u00eb nj\u00eb qytet tjet\u00ebr sipas dokumentit t\u00eb saj t\u00eb identifikimit, ashtu q\u00eb ajo ka qen\u00eb e ridrejtuar q\u00eb rastin ta denoncoj\u00eb n\u00eb qytetin tjet\u00ebr. N\u00eb fakt, <strong>t\u00eb gjitha procedurat lidhur me dhun\u00ebn n\u00eb familje n\u00eb p\u00ebrputhje me ligjin, duhet t\u00eb jen\u00eb urgjente<\/strong>. Mungesa e urgjenc\u00ebs, ridrejtimi i viktimave nga nj\u00eb institucion, n\u00eb nj\u00eb tjet\u00ebr, kontribuojn\u00eb n\u00eb <strong>viktimizimin shtes\u00eb t\u00eb viktimave<\/strong>, ve\u00e7an\u00ebrisht n\u00eb k\u00ebt\u00eb gjendje krize kur viktimat jan\u00eb n\u00eb izolim me dhunuesit dhe rreziku ndaj sh\u00ebndetit dhe siguris\u00eb s\u00eb tyre \u00ebsht\u00eb rritur ndjesh\u00ebm. Mbrojtja e viktimave duhet t\u00eb jet\u00eb p\u00ebrpar\u00ebsia kryesore, pavar\u00ebsisht se cili \u00ebsht\u00eb vendbanimi i tyre n\u00eb kart\u00ebn e identitetit. Kjo, n\u00eb asnj\u00eb rast nuk duhet t\u00eb jet\u00eb nj\u00eb kriter me t\u00eb cilin institucionet duhet t\u00eb udh\u00ebzohen n\u00eb veprimet e tyre n\u00eb situata kaq jasht\u00ebzakonisht urgjente.<\/p>\n<p>Rasti i dyt\u00eb i referohet nj\u00eb gruaje t\u00eb moshuar me pengesa fizike e cila po p\u00ebrjeton dhun\u00eb n\u00eb familje nga ana e djalit t\u00eb saj. Edhe pse ajo disa her\u00eb e ka <strong>denoncuar dhun\u00ebn<\/strong> n\u00eb Qendr\u00ebn kompetente p\u00ebr pun\u00eb sociale n\u00eb Kriva Pallank\u00eb, akoma <strong>nuk e ka marr\u00eb mbrojtjen e nevojshme<\/strong>, kurse jetesa e saj n\u00eb nj\u00eb sht\u00ebpi t\u00eb p\u00ebrbashk\u00ebt me dhunuesin \u00ebsht\u00eb rrezik i p\u00ebrditsh\u00ebm p\u00ebr jet\u00ebn dhe sh\u00ebndetin e saj. <strong>Ministria p\u00ebr Pun\u00eb dhe Politik\u00eb Sociale, pas denoncimit t\u00eb Komitetit t\u00eb Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut ka kryer nj\u00eb mbik\u00ebqyrje t\u00eb jasht\u00ebzakonshme inspektuese mbi pun\u00ebn e k\u00ebsaj Qendre, por rezultatet e k\u00ebsaj mbik\u00ebqyrjeje ende jan\u00eb n\u00eb pritje.<\/strong><\/p>\n<p>Poashtu shqet\u00ebsuese ishin edhe informacionet q\u00eb i mor\u00ebm nga ana e nj\u00eb viktime nga Shkupi, e cila po p\u00ebrjeton dhun\u00eb n\u00eb familje nga ana e djalit t\u00eb saj. Pop\u00e7evska e ka ankimuar n\u00eb K\u00ebshillin pran\u00eb Gjykat\u00ebs Supreme e cila ankes\u00ebn e saj e ka refuzuar si t\u00eb pabazuar dhe e ka konfirmuar vendimin e K\u00ebshillit Gjyq\u00ebsor p\u00ebr shkakrikimin e saj nga funksioni i gjyqtares. P\u00ebr shkak t\u00eb shkeljeve t\u00eb b\u00ebra n\u00eb procedur\u00eb, znj. Pop\u00e7evska ka inicuar <strong>procedur\u00eb <\/strong>n\u00eb <strong>Gjykat\u00ebn Evropiane p\u00ebr t\u00eb Drejtat e Njeriut,<\/strong> e cila n\u00eb janar t\u00eb vitit 2016 ka miratuar <strong>aktgjykim <\/strong>n\u00eb t\u00eb cilin ka <strong>konstatuar shkelje t\u00eb nenit 6 paragrafi 1 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut.<\/strong> N\u00eb fakt, shkelja i referohej munges\u00ebs s\u00eb paanshm\u00ebris\u00eb dhe pavar\u00ebsis\u00eb s\u00eb duhur t\u00eb K\u00ebshillit Gjyq\u00ebsor, p\u00ebr shkak t\u00eb pjes\u00ebmarrjes s\u00eb Kryetarit t\u00eb at\u00ebhersh\u00ebm t\u00eb Gjykat\u00ebs Supreme dhe Ministrit t\u00eb at\u00ebhersh\u00ebm t\u00eb Drejt\u00ebsis\u00eb, n\u00eb procedur\u00ebn dhe vendimmarrjen e K\u00ebshillit Gjyq\u00ebsor p\u00ebr shkarkimin e gjyqtares. N\u00eb shkurt t\u00eb vitit 2016, znj. Pop\u00e7evska e ka fituar t\u00eb drejt\u00ebn e pensionit t\u00eb pleq\u00ebris\u00eb, kurse n\u00eb muajin maj t\u00eb vitit 2016 ka paraqitur K\u00ebrkes\u00eb p\u00ebr p\u00ebrs\u00ebritjen e procedur\u00ebs mbi baz\u00ebn e aktgjykimit p\u00ebrfundimtar t\u00eb Gjykat\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut. Dy vite m\u00eb von\u00eb, n\u00eb shkurt t\u00eb vitit 2018 K\u00ebshilli Gjyq\u00ebsor e miratoi k\u00ebrkes\u00ebn e saj dhe e lejoi p\u00ebrs\u00ebritjen e procedur\u00ebs s\u00eb p\u00ebrfunduar t\u00eb plotfuqishme.<\/p>\n<p>Me vendim t\u00eb dat\u00ebs 5.6.2019 K\u00ebshilli Gjyq\u00ebsor i Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut ka konstatuar ushtrim joprofesional dhe t\u00eb pand\u00ebrgjegjsh\u00ebm t\u00eb funksionit t\u00eb gjyqtarit p\u00ebr gjyqtaren tashm\u00eb n\u00eb pension Snezhana Gerovska Pop\u00e7evska. Zonja Pop\u00e7evska e apeloi k\u00ebt\u00eb vendim n\u00eb K\u00ebshillin e Gjykat\u00ebs Supreme p\u00ebr shkelje thelb\u00ebsore t\u00eb procedur\u00ebs s\u00eb vendimmarrjes, jokompetenc\u00ebs s\u00eb K\u00ebshillit Gjyq\u00ebsor p\u00ebr t\u00eb vendosur n\u00eb rastin konkret, moskorrigjimin e shkeljes s\u00eb konstatuar me aktgjykimin e Gjykat\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut, zbatim t\u00eb pasakt\u00eb t\u00eb t\u00eb drejt\u00ebs materiale, dhe gjithashtu p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb elementeve p\u00ebr konstatimin e pap\u00ebrgjegjsis\u00eb dhe joprofesionalizmit n\u00eb ushtrimin e funksionit t\u00eb gjyqtarit. Zonja Pop\u00e7evska m\u00eb tej deklaroi n\u00eb ankes\u00eb se provat e paraqitura aspak nuk ishin vler\u00ebsuar &#8211; nj\u00eb aktvendim i miratuar nga K\u00ebshilli Gjyq\u00ebsor n\u00eb vitin 2008 i cili e ndalon procedur\u00ebn e iniciuar p\u00ebr konstatimin e ushtrimit joprofesional dhe t\u00eb pand\u00ebrgjegjsh\u00ebm t\u00eb funksionit t\u00eb gjyqtarit kund\u00ebr gjyqtares n\u00eb gjykat\u00ebn e apelit, p\u00ebr shkak se gjyqtarja i ka plot\u00ebsuar kushtet p\u00ebr pension pleq\u00ebrie, kurse veprimi i K\u00ebshillit \u00ebsht\u00eb b\u00ebr\u00eb i pavlefsh\u00ebm.<\/p>\n<p>K\u00ebshilli p\u00ebr vendimmarrje ndaj ankesave i formuar pran\u00eb Gjykat\u00ebs Supreme n\u00eb tetor t\u00eb vitit 2019 e ka miratuar ankes\u00ebn e znj. Pop\u00e7evska dhe e ka shfuqizuar vendimin e K\u00ebshillit Gjyq\u00ebsor. K\u00ebshilli ka vendosur se arsyetimi ankimues p\u00ebr shkelje thelb\u00ebsore t\u00eb dispozitave n\u00eb procedur\u00eb ka qen\u00eb i bazuar, p\u00ebr shkak t\u00eb faktit se vendimi i ankimuar ka qen\u00eb i paqart\u00eb dhe i pakuptuesh\u00ebm dhe nuk ka p\u00ebrmbajtur arsye mjaftuesh\u00ebm t\u00eb shpjeguara p\u00ebr faktet vendimtare nga t\u00eb cilat K\u00ebshilli Gjyq\u00ebsor \u00ebsht\u00eb udh\u00ebzuar n\u00eb procesin e vendimmarrjes. K\u00ebshilli thekson se n\u00eb arsyetimin e vendimit t\u00eb ankimuar thuhej se gjat\u00eb miratimit t\u00eb tij K\u00ebshilli Gjyq\u00ebsor ka pasur parasysh se padit\u00ebsja nuk \u00ebsht\u00eb gjyqtar aktiv dhe prandaj ajo nuk shkarkohet por vet\u00ebm n\u00eb tekstin e aktvendimit konstatohet ushtrim joprofesional dhe i pand\u00ebrgjegjsh\u00ebm t\u00eb funksionit t\u00eb gjyqtarit. K\u00ebshilli Gjyq\u00ebsor ka theksuar se n\u00eb rastin konkret nuk ekziston mund\u00ebsi ligjore t\u00eb miratohet vendim p\u00ebr shkarkimin e gjyqtarit, duke e marr\u00eb parasysh faktin se ajo i ka plot\u00ebsuar kushtet e pensionit t\u00eb pleq\u00ebris\u00eb. P\u00ebr shkak t\u00eb k\u00ebsaj, K\u00ebshilli Gjyq\u00ebsor ka vendosur deklarativisht. Por, p\u00ebr K\u00ebshillin e Gjykat\u00ebs Supreme ky arsyetim ka qen\u00eb kund\u00ebrth\u00ebn\u00ebs, i paqart\u00eb dhe i pakuptuesh\u00ebm, p\u00ebr shkak se teksti i vendimit nuk ka qen\u00eb korrespondues dhe ka qen\u00eb kund\u00ebrth\u00ebn\u00ebs me arsyet p\u00ebr miratimin e tij, t\u00eb p\u00ebrmbajtura n\u00eb arsyetimin.<\/p>\n<p>P\u00ebr m\u00eb tep\u00ebr, K\u00ebshilli i Gjykat\u00ebs Supreme deklaroi se n\u00eb dispozitat ligjore t\u00eb cituara, mbi t\u00eb cilat K\u00ebshilli Gjyq\u00ebsor e ka bazuar vendimin e tij, nuk parashikohet mund\u00ebsi ligjore p\u00ebr konstatim deklarues t\u00eb performanc\u00ebs joprofesionale dhe t\u00eb pand\u00ebrgjegjshme t\u00eb funksionit t\u00eb gjyqtarit, por p\u00ebr ushtrim joprofesional dhe t\u00eb pand\u00ebrgjegjsh\u00ebm t\u00eb funksionit t\u00eb gjyqtarit \u00ebsht\u00eb i mundsh\u00ebm vet\u00ebm shkarkimi nga funksioni i gjyqtarit.<\/p>\n<p>K\u00ebshilli thekson q\u00eb ligjv\u00ebn\u00ebsi e ka parashikuar mund\u00ebsin\u00eb q\u00eb K\u00ebshilli Gjyq\u00ebsor t\u00eb marr\u00eb vet\u00ebm vendim q\u00eb e pezullon procedur\u00ebn dhe vendimin p\u00ebr shkarkimin e gjyqtarit p\u00ebr shkak t\u00eb ushtrimit joprofesional dhe t\u00eb pand\u00ebrgjegjsh\u00ebm t\u00eb funksionit t\u00eb gjyqtarit, dhe nuk ka parashikuar mund\u00ebsi p\u00ebr konfirmim vendimi p\u00ebr ushtrim joprofesional dhe t\u00eb pand\u00ebrgjegjsh\u00ebm t\u00eb funksionit t\u00eb gjyqtarit t\u00eb karakterit deklarativ, si\u00e7 ka miratuar K\u00ebshilli Gjyq\u00ebsor n\u00eb rastin konkret. P\u00ebr shkak t\u00eb k\u00ebsaj, p\u00ebr K\u00ebshillin e Gjykat\u00ebs Supreme ka qen\u00eb e paqart\u00eb se n\u00eb baz\u00eb t\u00eb t\u00eb cilave dispozita ligjore K\u00ebshilli Gjyq\u00ebsor e ka miratuar vendimin e kontestuar p\u00ebr nj\u00eb gjyqtar tashm\u00eb n\u00eb pension i cili nuk mund t\u00eb shkarkohet, duke pasur parasysh q\u00eb funksioni i gjyqtarit tashm\u00eb \u00ebsht\u00eb nd\u00ebrprer\u00eb me an\u00eb t\u00eb forc\u00ebs s\u00eb ligjit. P\u00ebr m\u00eb tep\u00ebr, K\u00ebshilli i Gjykat\u00ebs Supreme ka konstatuar se K\u00ebshilli Gjyq\u00ebsor nuk ka deklaruar se n\u00eb baz\u00eb t\u00eb cilit Ligj p\u00ebr Gjykatat dhe Ligj p\u00ebr K\u00ebshillin Gjyq\u00ebsor \u00ebsht\u00eb udh\u00ebhequr gjat\u00eb vendimmarrjes, duke e marr\u00eb parasysh koh\u00ebn e inicimit t\u00eb procedur\u00ebs dhe miratimin e vendimit p\u00ebr shkarkimin e gjyqtarit, si dhe rregullat e vlefshm\u00ebris\u00eb kohore t\u00eb ligjeve. P\u00ebr shkak t\u00eb t\u00eb gjith\u00eb k\u00ebsaj, K\u00ebshilli i Gjykat\u00ebs Supreme ka vendosur q\u00eb pa i hequr shkeljet thelb\u00ebsore t\u00eb p\u00ebrcaktuara, K\u00ebshilli Gjyq\u00ebsor nuk ka qen\u00eb n\u00eb gjendje ta zbatoj\u00eb n\u00eb m\u00ebnyr\u00eb korrekte t\u00eb drejt\u00ebn materiale dhe t\u00eb miratoj\u00eb vendim t\u00eb drejt\u00eb dhe t\u00eb bazuar me ligj.<\/p>\n<p>K\u00ebshilli Gjyq\u00ebsor p\u00ebrs\u00ebri n\u00eb shkurt t\u00eb vitit 2020 ka miratuar vendim ku ka konstatuar ushtrim joprofesional dhe t\u00eb pand\u00ebrgjegjsh\u00ebm t\u00eb funksionit t\u00eb gjyqtarit, me arsyetim identik n\u00eb lidhje me karakterin deklarativ t\u00eb vendimit t\u00eb miratuar edhe p\u00ebrkund\u00ebr asaj se b\u00ebhet fjal\u00eb p\u00ebr gjyqtare n\u00eb pension, n\u00eb kund\u00ebrshtim me udh\u00ebzimet e dh\u00ebna nga K\u00ebshilli i Gjykat\u00ebs Supreme. P\u00ebr m\u00eb tep\u00ebr, K\u00ebshilli Gjyq\u00ebsor n\u00eb m\u00ebnyr\u00eb kund\u00ebrth\u00ebn\u00ebse ka shpjeguar se cilat ligje i ka zbatuar gjat\u00eb vendimmarrjes, duke theksuar ligj q\u00eb nuk e ka zbatuar. N\u00eb udh\u00ebzimet ligjore \u00ebsht\u00eb theksuar se vendimi \u00ebsht\u00eb p\u00ebrfundimtar dhe kund\u00ebr tij nuk ka t\u00eb drejt\u00eb ankimimi, n\u00eb p\u00ebrputhje me nenin 96 paragrafi 4 t\u00eb Ligjit p\u00ebr K\u00ebshillin Gjyq\u00ebsor.<\/p>\n<p>Duke marr\u00eb parasysh q\u00eb kjo dispozit\u00eb e Ligjit \u00ebsht\u00eb jokushtetuese dhe e shkel t\u00eb drejt\u00ebn e saj p\u00ebr nj\u00eb procedur\u00eb n\u00eb shkall\u00eb t\u00eb dyt\u00eb, znj. Pop\u00e7evska ka parashtruar nj\u00eb Iniciativ\u00eb n\u00eb Gjykat\u00ebn Kushtetuese p\u00ebr ta vler\u00ebsuar kushtetutshm\u00ebrin\u00eb e k\u00ebsaj dispozite.
