Sipas Kryetarit, vendimi \u00ebsht\u00eb p\u00ebr faktin se &#8220;<u>gjendja aktuale e jasht\u00ebzakonshme p\u00ebrfundon sot p\u00ebr shkak t\u00eb skadimit t\u00eb afatit 30-ditor p\u00ebr t\u00eb cilin u p\u00ebrcaktua dhe nuk do t\u00eb zgjatet zyrtarisht dhe ligj\u00ebrisht sepse p\u00ebr t\u00eb nuk ka asnj\u00eb baz\u00eb kushtetuese. Prandaj, sot, bazuar n\u00eb nj\u00eb propozim t\u00eb ri t\u00eb arsyetuar nga Qeveria, dhe n\u00eb situat\u00ebn kur Kuvendi nuk po funksionon, un\u00eb do t\u00eb marr nj\u00eb vendim t\u00eb ri p\u00ebr ta p\u00ebrcaktuar zgjatjen e gjendjes s\u00eb jasht\u00ebzakonshme p\u00ebr nj\u00eb periudh\u00eb prej 30 dit\u00ebsh n\u00eb t\u00eb gjith\u00eb territorin e vendit. Sidoqoft\u00eb, ky vendim nuk e zvog\u00eblon p\u00ebrgjegj\u00ebsin\u00eb e t\u00eb gjith\u00eb faktor\u00ebve politik\u00eb p\u00ebrkat\u00ebs n\u00eb vend q\u00eb t\u2019<\/u><u>i<\/u><u> shprehin qart\u00eb dhe publikisht pik\u00ebpamjet e tyre p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje, sepse n\u00eb mesin e majit edhe m\u00eb tutje do t\u2019<\/u><u>i<\/u><u> kemi t\u00eb nj\u00ebjtat dilema ligjore<\/u>\u201d.<\/p>\n<p>N\u00eb prill t\u00eb vitit 2020, <strong>Komiteti i Helsinkit vazhdoi t<\/strong><strong>\u2019i<\/strong><strong> monitoroj\u00eb masat e <\/strong><strong>Q<\/strong><strong>everis\u00eb<\/strong>, ve\u00e7an\u00ebrisht n\u00eb kontekstin e respektimit t\u00eb t\u00eb drejtave themelore n\u00eb kuad\u00ebr t\u00eb <strong>Kapitulli<\/strong><strong>t<\/strong><strong> 23<\/strong>. Duke i pasur parasysh dhe duke i ndjekur zhvillimet e m\u00ebsip\u00ebrme, Komiteti i Helsinkit b\u00ebri thirrje p\u00ebr respektimin e t\u00eb drejtave t\u00eb njeriut p\u00ebrmes informimit n\u00eb koh\u00eb dhe transparent t\u00eb publikut me informacion t\u00eb sakt\u00eb n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb rritet mbik\u00ebqyrja publike ndaj pushteteve ekzekutive gjat\u00eb koh\u00ebs s\u00eb gjendjes s\u00eb jasht\u00ebzakonshme.<\/p>\n<p>N\u00eb lidhje me k\u00ebt\u00eb \u00e7\u00ebshtje, u inicua nj\u00eb iniciativ\u00eb p\u00ebr ta thirrur Kuvendin e Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut p\u00ebr t\u2019i konfirmuar vendimet p\u00ebr gjendjen e jasht\u00ebzakonshme n\u00eb vend, e cila iniciativ\u00eb pati mendime t\u00eb ndryshme nga ana e partive politike. Fokusi i k\u00ebtij raporti mujor \u00ebsht\u00eb ndikimi i masave t\u00eb Qeveris\u00eb s\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut dhe gjendjes s\u00eb jasht\u00ebzakonshme mbi situat\u00ebn me t\u00eb drejtat e njeriut. N\u00eb p\u00ebrputhje me trendin aktual, v\u00ebmendja duhet t\u00eb p\u00ebrqendrohet n\u00eb trajtimin e kriz\u00ebs socio-ekonomike si rezultat i pandemis\u00eb &#8211; ve\u00e7an\u00ebrisht mbrojtja e t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve dhe masave aktive p\u00ebr parandalimin dhe sanksionimin e dhun\u00ebs n\u00eb familje.<\/p>\n<p>Gjithashtu, gjat\u00eb muajit prill, Komisioni Evropian miratoi nj\u00eb paket\u00eb masash p\u00ebr ta mb\u00ebshtetur Ballkanin Per\u00ebndimor n\u00eb trajtimin e COVID-19, si dhe propozim masa p\u00ebr normalizimin e situat\u00ebs n\u00eb vendet q\u00eb do t\u00eb konfirmohen n\u00eb muajin maj gjat\u00eb Samitit BE &#8211; Ballkani Per\u00ebndimor. Masat p\u00ebrfshijn\u00eb mb\u00ebshtetje financiare p\u00ebr sektor\u00ebt ekonomik\u00eb t\u00eb vendeve, mb\u00ebshtetje p\u00ebr sistemin sh\u00ebndet\u00ebsor p\u00ebr ta trajtuar pandemin\u00eb, si dhe nj\u00eb paket\u00eb masash p\u00ebr t\u2019i riaktivizuar aktivitetet ekonomike n\u00eb k\u00ebto vende. Propozimi i Komisionit vendos nj\u00eb theks t\u00eb qart\u00eb n\u00eb vazhdimin e reformave n\u00eb sferat themelore &#8211; ve\u00e7an\u00ebrisht n\u00eb funksionimin e institucioneve demokratike dhe shtetin e s\u00eb drejt\u00ebs. N\u00eb k\u00ebt\u00eb drejtim, theksohet r\u00ebnd\u00ebsia se t\u00eb gjitha masat e pushtetit ekzekutiv gjat\u00eb gjendjes s\u00eb jasht\u00ebzakonshme duhet t\u00eb jen\u00eb proporcionale dhe t\u2019i ken\u00eb parasyh parimet dhe vlerat themelore p\u00ebr respektimin e t\u00eb drejtave t\u00eb njeriut.<\/p>\n<p>T\u00cb DREJTAT E PUN\u00cbTOR\u00cbVE<\/p>\n<p><strong>PUN\u00cbTORET DHE PUN\u00cbTOR\u00cbT JAN\u00cb NJ\u00cbRA ND\u00cbR KATEGORIT\u00cb M\u00cb T\u00cb RREZIKUARA GJAT\u00cb P\u00cbRBALLJES ME VIRUSIN KORONA<\/strong><\/p>\n<p>Pun\u00ebtor\u00ebt ishin t\u00eb par\u00ebt q\u00eb u godit\u00ebn pas shpalljes s\u00eb gjendjes s\u00eb jasht\u00ebzakonshme n\u00eb territorin e gjith\u00eb vendit p\u00ebr shkak t\u00eb p\u00ebrballjes me pasojat e virusit korona.<strong> N\u00eb prill, Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut regjistroi 85 denoncime p\u00ebr shkelje t\u00eb t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve, duke p\u00ebrfshir\u00eb af\u00ebrsisht 920 pun\u00ebtor\u00eb.<\/strong><\/p>\n<p>Shum\u00eb pun\u00ebtor\u00eb raportuan se pun\u00ebdh\u00ebn\u00ebs t\u00eb caktuar, p\u00ebrkund\u00ebr t\u00eb gjitha rekomandimeve dhe masave, <strong>abuzuan me gjendjen e jasht\u00ebzakonshme<\/strong> dhe <strong>ua <\/strong><strong>anuluan kontratat e tyre t\u00eb <\/strong><strong>pun\u00ebsimit<\/strong> p\u00ebr grupe t\u00eb t\u00ebra t\u00eb personave t\u00eb pun\u00ebsuar. Numri m\u00eb i madh i pun\u00ebtor\u00ebve nuk mor\u00ebn asnj\u00eb <strong>njoftim me shkrim<\/strong>, por pun\u00ebdh\u00ebn\u00ebsit thjesht i \u00e7lajm\u00ebruan nga Agjencia e Pun\u00ebsimit. Komiteti regjistroi <strong>18 denoncime p\u00ebr af<\/strong><strong>\u00eb<\/strong><strong>r 77 pun\u00ebtor\u00eb<\/strong> q\u00eb u pushuan nga puna gjat\u00eb k\u00ebtij muaji, por shum\u00eb m\u00eb shqet\u00ebsues \u00ebsht\u00eb numri i <strong>265 pun\u00ebtor\u00ebve<\/strong> q\u00eb ishin detyruar t\u00eb n\u00ebnshkruajn\u00eb <strong>marr\u00ebveshje p\u00ebr <\/strong><strong>nd\u00ebrprerjen e kontratave t\u00eb tyre t\u00eb pun\u00ebsimit<\/strong>. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, atyre <strong>iu mohua<\/strong> \u00e7do <strong>qasje n\u00eb<\/strong> <strong>mekanizmat mbrojt\u00ebs<\/strong> dhe ata mbet\u00ebn t\u00eb luftojn\u00eb thjesht p\u00ebr ekzistenc\u00ebn e tyre n\u00eb margjinat e shoq\u00ebris\u00eb. Nj\u00eb goditje tjet\u00ebr p\u00ebr ta \u00ebsht\u00eb pamund\u00ebsia p\u00ebr t\u00eb p\u00ebrfituar kompensim monetar n\u00eb rast papun\u00ebsie, sepse pun\u00ebsimi i tyre ishte nd\u00ebrprer\u00eb me marr\u00ebveshje.<\/p>\n<p><strong>Si p\u00ebrgjigje<\/strong><strong> ndaj k\u00ebsaj<\/strong><strong>, pasi masat fillestare t\u00eb <\/strong><strong>Q<\/strong><strong>everis\u00eb d\u00ebshtuan t<\/strong><strong>\u2019<\/strong><strong>i<\/strong><strong> mbroj<\/strong><strong>n\u00eb<\/strong><strong> pun\u00ebtor\u00ebt, Komiteti i Helsinkit, s\u00eb bashku me <\/strong><strong>dhjet\u00ebra<\/strong><strong> sindikata dhe organizata t\u00eb tjera, parashtroi nj\u00eb paket\u00eb k\u00ebrkesash <\/strong><strong>deri te Qeveria<\/strong><strong> me propozime \u00a0p\u00ebr<\/strong><strong>kat\u00ebse dhe<\/strong><strong> konkrete p\u00ebr zbatimin e secil<\/strong><strong>\u00ebs prej tyre<\/strong><strong>. Komiteti gjithashtu k\u00ebrkoi q\u00eb <\/strong><strong>t\u00eb<\/strong><strong> drejt\u00ebn e kompensimit monetar p\u00ebr personat e papun\u00eb <\/strong><strong>gjat\u00eb<\/strong><strong> kriz\u00eb<\/strong><strong>s, ta g\u00ebzojn\u00eb edhe personat<\/strong><strong>, pun\u00ebsimi i t\u00eb cil\u00ebve \u00ebsht\u00eb <\/strong><strong>nd\u00ebrprer\u00eb<\/strong><strong> me deklarat\u00ebn e tyre<\/strong><strong> personale<\/strong><strong>, me marr\u00ebveshje ose p\u00ebr shkak <\/strong><strong>kinse <\/strong><strong>t\u00eb prishjes s\u00eb disiplin\u00ebs. <\/strong><\/p>\n<p><strong>Mosp\u00ebrputhshm\u00ebri n\u00eb zbatimin e masave qeveritare nga ana e institucioneve<\/strong><\/p>\n<p>Gjat\u00eb k\u00ebtij muaji, <strong>realizimi i kompensimit monetar<\/strong> n\u00eb rast <strong>papun\u00ebsie<\/strong> ishte <strong>p<\/strong><strong>amund\u00ebsuar<\/strong> edhe p\u00ebr nj\u00eb grup punonj\u00ebsish q\u00eb kishin t\u00eb drejt\u00eb p\u00ebr t\u00eb. Pun\u00ebtor\u00ebt na informuan se nd\u00ebrsa p\u00ebrpiqeshin ta ushtronin t\u00eb drejt\u00ebn e tyre p\u00ebr kompensim monetar, ata has\u00ebn n\u00eb disa <strong>probleme dhe mosp\u00ebrputhshm\u00ebri<\/strong> t\u00eb caktuara. P\u00ebr ta leht\u00ebsuar ndjesh\u00ebm ushtrimin e t\u00eb drejtave t\u00eb qytetar\u00ebve m\u00eb t\u00eb prekur nga gjendja e jasht\u00ebzakonshme, <u>Komiteti i Helsinkit k\u00ebrkoi q\u00eb Agjencia e Pun\u00ebsimit t\u00eb <\/u><u>p\u00ebrpiloj\u00eb<\/u><u>, miratoj\u00eb dhe publikoj\u00eb udh\u00ebzime konkrete p\u00ebr zbatimin e masave t\u00eb miratuara qeveritare. Komiteti <\/u><u>e <\/u><u>theksoi nevoj\u00ebn p\u00ebr t\u00eb krijuar nj\u00eb praktik\u00eb uniforme p\u00ebr vendimmarrje dhe nj\u00eb p\u00ebrcaktim t\u00eb qart\u00eb t\u00eb m\u00ebnyr\u00ebs dhe kushteve <\/u><u>q\u00eb<\/u><u> qytetar\u00ebt t<\/u><u>\u00eb<\/u><u> jen\u00eb n\u00eb gjendje t<\/u><u>\u2019i<\/u><u> ushtrojn\u00eb t\u00eb drejtat e tyre. <\/u><\/p>\n<p>N\u00eb gjysm\u00ebn e dyt\u00eb t\u00eb muajit, p\u00ebrve\u00e7 r\u00ebnies s\u00eb denoncimeve p\u00ebr pushime nga puna, rritej numri i denoncimeve t\u00eb pun\u00ebtor\u00ebve, pagat e t\u00eb cil\u00ebve nuk ishin paguar ose ishin zvog\u00ebluar madje edhe deri n\u00eb 50 p\u00ebrqind, duke u thirrur paligjsh\u00ebm n\u00eb institutin &#8220;forca madhore&#8221;. Lidhja e Sindikatave t\u00eb Maqedonis\u00eb (LSM) reagoi fuqish\u00ebm dhe qart\u00eb me nj\u00eb konstatim t\u00eb qart\u00eb se vendimet e Qeveris\u00eb q\u00eb e ndalojn\u00eb plot\u00ebsisht veprimtarin\u00eb e personave juridik\u00eb n\u00eb veprimtari t\u00eb caktuara p\u00ebr ta parandaluar p\u00ebrhapjen e virusit korona, nuk paraqesin nj\u00eb forc\u00eb madhore.<\/p>\n<p><strong>Si rrjedhoj\u00eb<\/strong><strong>, Komiteti i Helsinkit n\u00eb <\/strong><strong>paket\u00ebn<\/strong><strong> e k\u00ebrkesave, s\u00eb bashku me <\/strong><strong>Lidhjen e Sindikatave t\u00eb Maqedonis\u00eb<\/strong><strong>, i k\u00ebrkuan Qeveris\u00eb t\u00eb miratoj\u00eb nj\u00eb dekret me t\u00eb cil\u00ebn do t\u00eb rregullohe<\/strong><strong>t<\/strong> <strong>q<\/strong><strong>\u00eb pagat e pun\u00ebtor\u00ebve t\u00eb mos mund t\u00eb zvog\u00eblohen p\u00ebr m\u00eb shum\u00eb se 20% gjat\u00eb <\/strong><strong>koh\u00ebs s\u00eb <\/strong><strong>kriz\u00ebs, si\u00e7 <\/strong><strong>\u00ebsht\u00eb definuar<\/strong><strong> me Marr\u00ebveshjen e <\/strong><strong>p<\/strong><strong>\u00ebrgjithshme <\/strong><strong>k<\/strong><strong>olektive (<\/strong><strong>MPK<\/strong><strong>) p\u00ebr sektorin privat. N\u00eb k\u00ebt\u00eb rast, <\/strong><strong>MPK-ja<\/strong><strong> p\u00ebr sektorin privat p\u00ebrmban dispozita q\u00eb parashikojn\u00eb t\u00eb drejta m\u00eb t\u00eb favorshme p\u00ebr pun\u00ebtor\u00ebt <\/strong><strong>sesa<\/strong><strong> Ligji p\u00ebr marr\u00ebdh\u00ebniet e pun\u00ebs dhe <\/strong><strong>ato duhet t\u00eb zbatohen<\/strong><strong>.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> Komiteti i Helsinkit regjistroi 599 pun\u00ebtor\u00eb<\/strong><strong>,<\/strong><strong> pagat e t\u00eb cil\u00ebve nuk <\/strong><strong>ishin<\/strong><strong> paguar ose <\/strong><strong>ishin zvog\u00ebluar p\u00ebr k\u00ebt\u00eb muaj<\/strong><strong>. Me mospagimin e pagave dhe kontributeve n\u00eb dy muajt e fundit, nj\u00eb num\u00ebr i madh i pun\u00ebtor\u00ebve dhe familjeve t\u00eb tyre mbet\u00ebn pa sigurime sh\u00ebndet\u00ebsore, n\u00eb nj\u00eb nga momentet m\u00eb kritike p\u00ebr sh\u00ebndetin e njer\u00ebzve n\u00eb vendin ton\u00eb.<\/strong><\/p>\n<p><strong>Mosrespektimi i masave nga ana e pun\u00ebdh\u00ebn\u00ebsve<\/strong><\/p>\n<p>Num\u00ebr i madh pun\u00ebdh\u00ebn\u00ebsish <strong>nuk<\/strong><strong> i<\/strong><strong> respektuan masat dhe rekomandimet<\/strong> e Qeveris\u00eb dhe Ministris\u00eb s\u00eb Sh\u00ebndet\u00ebsis\u00eb p\u00ebr parandalimin dhe mbrojtjen nga virusi korona. N\u00eb ve\u00e7anti <strong>t\u00eb pambrojtur dhe t\u00eb rrezikuar<\/strong> ishin pun\u00ebtor\u00ebt n\u00eb linj\u00ebn e par\u00eb t\u00eb luft\u00ebs kund\u00ebr virusit, pun\u00ebtor\u00ebt e supermarketeve, shit\u00ebsit dhe shit\u00ebset. Duke i injoruar rregullat e pun\u00ebs p\u00ebr siguri n\u00eb pun\u00eb, <strong>pun\u00ebdh\u00ebn\u00ebsit nuk u siguruan<\/strong> atyre <strong>pajisje <\/strong><strong>t\u00eb p\u00ebrshtatshme <\/strong><strong>mbrojt\u00ebse<\/strong>, k\u00ebshtu q\u00eb ata i kryenin detyrat e tyre, duke e ekspozuar veten n\u00eb nj\u00eb rrezik serioz p\u00ebr sh\u00ebndetin dhe jet\u00ebn e tyre. P\u00ebr m\u00eb tep\u00ebr, ata nuk p\u00ebrfituan rritje t\u00eb pagave n\u00eb raport me rrezikun e shtuar n\u00eb vendin e pun\u00ebs.<\/p>\n<p>Disa pun\u00ebtor\u00eb k\u00ebrkuan informacione p\u00ebr zbatimin e masave t\u00eb miratuara nga Qeveria, ve\u00e7an\u00ebrisht n\u00eb lidhje me mas\u00ebn p\u00ebr lirimin nga puna t\u00eb nj\u00eb prindi i nj\u00eb f\u00ebmije deri n\u00eb dhjet\u00eb vje\u00e7. M\u00eb 10 mars 2020, Qeveria miratoi nj\u00eb mas\u00eb p\u00ebr <strong>t<\/strong><strong>a<\/strong> <strong>nd\u00ebrprer\u00eb<\/strong><strong> procesin <\/strong><strong>edukativo-<\/strong><strong>arsimor dhe m\u00ebsimdh\u00ebnien<\/strong> n\u00eb t\u00eb gjitha kopshtet dhe shkollat \u200b\u200bfillore. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, Qeveria vendosi q\u00eb p\u00ebr ta zbatuar k\u00ebt\u00eb mas\u00eb, <strong>nj\u00ebri nga prind\u00ebrit<\/strong>, f\u00ebmija i t\u00eb cilit deri n\u00eb mosh\u00ebn dhjet\u00eb vje\u00e7e i ndjek m\u00ebsimet n\u00eb kopsht apo shkoll\u00eb fillore, do <strong>t\u00eb lirohen nga detyrimi<\/strong> p\u00ebr t\u2019i kryer detyrat e pun\u00ebs. Nj\u00eb punonj\u00ebse n\u00eb sektorin publik, bashk\u00ebshorti i s\u00eb cil\u00ebs ishte i papun\u00eb, ka k\u00ebrkuar ndihm\u00eb juridike nga Komiteti i Helsinkit. <strong>Dhuna n\u00eb familje<\/strong> nga ana e bashk\u00ebshortit, me t\u00eb cil\u00ebn ajo dhe f\u00ebmij\u00ebt e saj jan\u00eb p\u00ebrballur n\u00eb t\u00eb kaluar\u00ebn, ka shkaktoi ndarje t\u00eb partner\u00ebve, t\u00eb cil\u00ebt aktualisht nuk jetojn\u00eb bashk\u00eb, por ligj\u00ebrisht jan\u00eb hala t\u00eb martuar. Kjo situat\u00eb paraqiste nj\u00eb problem p\u00ebr punonj\u00ebsen, sepse epror\u00ebt i k\u00ebrkuan asaj q\u00eb t\u00eb parashtronte nj\u00eb v\u00ebrtetim se bashk\u00ebshorti i saj ishte n\u00eb marr\u00ebdh\u00ebnie pune n\u00eb m\u00ebnyr\u00eb q\u00eb ajo t\u00eb lirohej nga obligimet n\u00eb vendin e pun\u00ebs. Bashk\u00ebshorti i saj si person, kryer\u00ebsi i dhun\u00ebs n\u00eb familje, jo vet\u00ebm q\u00eb \u00ebsht\u00eb i paaft\u00eb t\u00eb kujdeset, t\u2019i ruaj\u00eb dhe t\u2019i edukoj\u00eb f\u00ebmij\u00ebt e tyre, por paraqet edhe nj\u00eb k\u00ebrc\u00ebnim p\u00ebr sh\u00ebndetin dhe sigurin\u00eb e tyre. Duke i p\u00ebrdorur k\u00ebto argumente, Komiteti i Helsinkit i mund\u00ebsoi ndihm\u00eb juridike punonj\u00ebses n\u00eb p\u00ebrgatitjen e njoftimit p\u00ebr pun\u00ebdh\u00ebn\u00ebsin, i cili m\u00eb pas e liroi at\u00eb nga obligimet n\u00eb vendin e pun\u00ebs.<\/p>\n<p><strong>Duke<\/strong><strong> e<\/strong> <strong>marr\u00eb parasysh faktin se<\/strong><strong> n\u00eb praktik\u00eb ekzistojn\u00eb situata t\u00eb ndryshme dhe m\u00eb t\u00eb nd\u00ebrlikuara, si kjo, Komiteti rekomandon q\u00eb gjat\u00eb zbatimit t\u00eb k\u00ebsaj mase, si n\u00eb k\u00ebt\u00eb shembull, t\u00eb vepro<\/strong><strong>het<\/strong><strong> n\u00eb interesin m\u00eb t\u00eb mir\u00eb t\u00eb f\u00ebmij\u00ebve, ve\u00e7an\u00ebrisht t\u00eb atyre q\u00eb jan\u00eb ose kan\u00eb qen\u00eb viktima t\u00eb <\/strong><strong>ndonj\u00eb<\/strong><strong> lloj<\/strong><strong>i t\u00eb dhun\u00ebs n\u00eb familje<\/strong><strong>. <\/strong><\/p>\n<p>Edhe dy kategori t\u00eb tjera njer\u00ebzish mbesin <strong>t\u00eb pambrojtur<\/strong> n\u00eb k\u00ebt\u00eb situat\u00eb krize: <strong>pun\u00ebtor\u00eb<\/strong><strong>t<\/strong><strong> me nofka<\/strong> (pun\u00ebtor\u00ebt me honorare, frilenser\u00ebt dhe t\u00eb ngjashmit) dhe pun\u00ebtor\u00ebt me kontrata <strong>pun\u00ebsimi p\u00ebr afat t\u00eb caktuar kohor<\/strong>. T\u00eb par\u00ebt mbesin jasht\u00eb, madje edhe nga mbrojtja (e supozuar) q\u00eb u ofrohet pun\u00ebtor\u00ebve t\u00eb tjer\u00eb me <strong>Ligjin <\/strong><strong>p\u00ebr marr\u00ebdh\u00ebniet e pun\u00ebs<\/strong>. Komiteti i Helsinkit k\u00ebrkoi q\u00eb t\u00eb ofrohet mbrojtje dhe mb\u00ebshtetje p\u00ebrkat\u00ebse financiare n\u00eb periudh\u00ebn e kriz\u00ebs p\u00ebr k\u00ebt\u00eb kategori t\u00eb pun\u00ebtor\u00ebve t\u00eb rrezikuar, t\u00eb cil\u00ebt nuk kan\u00eb pothuajse asnj\u00eb sigurim shoq\u00ebror ose sh\u00ebndet\u00ebsor. Grupi i dyt\u00eb i pun\u00ebtor\u00ebve \u00ebsht\u00eb manipuluar nga pun\u00ebdh\u00ebn\u00ebsit e pand\u00ebrgjegjsh\u00ebm, t\u00eb cil\u00ebt vendosin q\u00eb nuk kan\u00eb m\u00eb nevoj\u00eb p\u00ebr to, k\u00ebshtu q\u00eb pas skadimit t\u00eb afatit t\u00eb caktuar kohor p\u00ebr t\u00eb cilin kan\u00eb n\u00ebnshkruar kontrat\u00eb, ata <strong>nuk <\/strong><strong>ua<\/strong><strong> zgjasin kontratat e tyre <\/strong>t\u00eb pun\u00ebsimit. N\u00eb k\u00ebt\u00ebj periudhe, kjo \u00ebsht\u00eb nj\u00eb goditje e konsiderueshme p\u00ebr ekzistenc\u00ebn e nj\u00eb prej kategorive m\u00eb t\u00eb prekura t\u00eb pun\u00ebtor\u00ebve. N\u00eb rolin e tij si lajm\u00ebtar p\u00ebr student\u00ebt, edhe Kuvendi universitar i student\u00ebve (KUS) pran\u00eb Universitetit &#8220;Sh\u00ebn Kirili dhe Metodi&#8221; n\u00eb Shkup, k\u00ebrkoi miratim t\u00eb nj\u00eb mase t\u00eb p\u00ebrkohshme ekonomike, n\u00eb form\u00ebn e bursave t\u00eb jasht\u00ebzakonshme sociale. KUS-i ka b\u00ebr\u00eb thirrje q\u00eb kjo mas\u00eb t\u00eb zbatohet p\u00ebr student\u00eb nga familje me t\u00eb ardhura t\u00eb ul\u00ebta, si dhe p\u00ebr student\u00ebt q\u00eb do t\u00eb paraqesin d\u00ebshmi se nj\u00eb ose m\u00eb shum\u00eb an\u00ebtar\u00eb t\u00eb familjes e kan\u00eb humbur vendin e tyre t\u00eb pun\u00ebs si rezultat i gjendjes s\u00eb jasht\u00ebzakonshme.<\/p>\n<p>M\u00eb n\u00eb fund, Komiteti i Helsinkit n\u00eb k\u00ebrkesat e tij t\u00eb p\u00ebrmendura m\u00eb par\u00eb k\u00ebrkoi q\u00eb <strong>t\u00eb mos u jepe<\/strong><strong>t<\/strong><strong> ndihm\u00eb financiare<\/strong> kompanive q\u00eb kan\u00eb <strong>pushuar<\/strong><strong> pun\u00ebtor\u00eb<\/strong> nga puna q\u00eb nga fillimi i marsit. Qeveria e Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut, jo vet\u00ebm q\u00eb nuk kishte vesh p\u00ebr k\u00ebt\u00eb k\u00ebrkes\u00eb, por p\u00ebrkundrazi, e p\u00ebrkeq\u00ebsoi ndjesh\u00ebm situat\u00ebn duke e <strong>ndryshuar dekretin<\/strong> p\u00ebrs\u00ebri. Komiteti i Helsinkit, s\u00eb bashku me disa sindikata dhe shoqata qytetare q\u00eb luftojn\u00eb dhe angazhohen p\u00ebr t\u00eb drejtat e pun\u00ebtor\u00ebve dhe p\u00ebr jet\u00eb dinjitoze t\u00eb pun\u00ebtor\u00ebve, e kund\u00ebrshtuan dhe d\u00ebnuan fuqish\u00ebm paralajm\u00ebrimin e till\u00eb t\u00eb ministres s\u00eb finacave dhe Qeveris\u00eb s\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut. Si rezultat i <strong>pandemis\u00eb<\/strong>, ato p\u00ebrballen me nj\u00eb <strong>barr\u00eb t\u00eb dyfisht\u00eb<\/strong>: turne m\u00eb t\u00eb gjata n\u00eb vendet e pun\u00ebs dhe kujdes shtes\u00eb n\u00eb sht\u00ebpit\u00eb e tyre.<\/p>\n<p>Organizata Nd\u00ebrkomb\u00ebtare e Pun\u00ebs na p\u00ebrkujton se p\u00ebr pothuajse 100 milion punonj\u00ebse n\u00eb sh\u00ebndet\u00ebsi n\u00eb t\u00eb gjith\u00eb bot\u00ebn, balancimi i obligimeve t\u00eb pun\u00ebs dhe p\u00ebrgjegj\u00ebsive n\u00eb sht\u00ebpi ka qen\u00eb gjithmon\u00eb nj\u00eb sfid\u00eb, kurse kjo kriz\u00eb vet\u00ebm se e ka konfirmuar luft\u00ebn shum\u00ebvje\u00e7are me pabarazin\u00eb gjinore.<\/p>\n<p>N\u00eb rrethana normale, grat\u00eb b\u00ebjn\u00eb pun\u00eb t\u00eb papaguar sht\u00ebpiake p\u00ebr 4 or\u00eb e 25 minuta, nd\u00ebrsa burrat p\u00ebr 1 or\u00eb e 23 minuta. P\u00ebr shkak t\u00eb pandemis\u00eb, shkollat, kopshtet dhe institucionet e tjera t\u00eb kujdesit u mbyll\u00ebn, dhe si rezultat i k\u00ebsaj, koha e shpenzuar p\u00ebr pun\u00eb t\u00eb papaguar n\u00eb sht\u00ebpi \u00ebsht\u00eb rriurt n\u00eb m\u00ebnyr\u00eb dramatike. Stresi i shkaktuar nga situata e p\u00ebrgjithshme n\u00eb vend, por edhe globalisht, mund t\u00eb jet\u00eb nj\u00eb faktor q\u00eb do t\u00eb kontribuoj\u00eb n\u00eb rritjen e rrezikut nga sjelljet e dhunshme.<\/p>\n<p>Sipas statistikave t\u00eb Ministris\u00eb s\u00eb Pun\u00ebve t\u00eb Brendshme, n\u00eb periudh\u00ebn nga <strong>12 mars deri n\u00eb 12 prill 2020<\/strong>, jan\u00eb regjistruar <strong>79 <\/strong><strong>vepra penale<\/strong> t\u00eb dhun\u00ebs n\u00eb familje, q\u00eb \u00ebsht\u00eb nj\u00eb shif\u00ebr p\u00ebr <strong>28% m\u00eb e ul\u00ebt<\/strong> n\u00eb krahasim me t\u00eb nj\u00ebjt\u00ebn periudh\u00eb t\u00eb <strong>vitit t\u00eb kaluar<\/strong>. N\u00eb nivel javor, rritje \u00ebsht\u00eb v\u00ebrejtur vet\u00ebm n\u00eb jav\u00ebn e par\u00eb t\u00eb muajit prill, kurse gjat\u00eb jav\u00ebve t\u00eb tjera, rastet e dhun\u00ebs n\u00eb familje ishin n\u00eb stagnacion.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> Krahasuar me shum\u00eb vende t\u00eb Evrop\u00ebs, por edhe n\u00eb nivel global, ku rritja e dhun\u00ebs n\u00eb familje q\u00eb nga fillimi i izolimit arriti mbi 25%,<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> kemi arsye t\u00eb besojm\u00eb se <strong>t\u00eb dh\u00ebnat<\/strong> e konfirmojn\u00eb problemin shum\u00ebvje\u00e7ar t\u00eb <strong>mo<\/strong><strong>s<\/strong><strong>denoncimit nga ana e viktimave<\/strong>, por edhe m\u00ebnyr\u00ebn e pap\u00ebrshtatshme t\u00eb regjistrimit t\u00eb veprave penale dhe mbajtjen e <strong>statistikave t\u00eb zb\u00ebrthyera sipas gjinis\u00eb<\/strong>. Nj\u00eb arsye tjet\u00ebr p\u00ebr k\u00ebt\u00eb shif\u00ebr \u00ebsht\u00eb edhe m\u00ebnyra jo adekuate e kualifikimit t\u00eb rasteve t\u00eb dhun\u00ebs n\u00eb familje, t\u00eb cilat shpesh trajtohen si <strong>vepra t\u00eb kund\u00ebrvajtjes<\/strong><strong> ndaj rendit <\/strong><strong>dhe qet\u00ebsis\u00eb <\/strong><strong>publik<\/strong><strong>e<\/strong>, n\u00eb vend se t\u00eb kualifikohen si vepra penale. K\u00ebrkesa i p\u00ebrmend n\u00eb m\u00ebnyr\u00eb specifike rreziqet q\u00eb jan\u00eb specifike p\u00ebr dhun\u00ebn n\u00eb familje dhe ofron propozim-masa urgjente p\u00ebr trajtimin e dhun\u00ebs n\u00eb familje dhe pasojat e saj.<\/p>\n<p>Menj\u00ebher\u00eb pas parashtrimit t\u00eb k\u00ebrkes\u00ebs, Qeveria miratoi nj\u00eb dekret me t\u00eb cilin grat\u00eb viktima dhe f\u00ebmij\u00ebt e tyre q\u00eb e l\u00ebshojn\u00eb sht\u00ebpin\u00eb p\u00ebr shkak t\u00eb kanosjes ose rrezikut t\u00eb drejtp\u00ebrdrejt\u00eb nga dhuna, gjat\u00eb or\u00ebs policore mund t\u00eb udh\u00ebtojn\u00eb pa pengesa deri te stacioni m\u00eb i af\u00ebrt i policis\u00eb, ose n\u00ebse ata kan\u00eb nevoj\u00eb p\u00ebr kujdes sh\u00ebndet\u00ebsor deri te institucioni m\u00eb i af\u00ebrt sh\u00ebndet\u00ebsor, respektivisht nuk kan\u00eb nevoj\u00eb p\u00ebr leje t\u00eb posa\u00e7me t\u00eb l\u00ebvizjes p\u00ebr k\u00ebto nevoja.
