Sipas kryetarit, vendimi \u00ebsht\u00eb miratuar \u201c<em>p\u00ebr mbrojtjen dhe menaxhimin e pasojave nga p\u00ebrhapja e virusit<\/em> <em>COVID \u2013 19. Gjendja e jasht\u00ebzakonshme do t\u00eb zgjas\u00eb 30 dit\u00eb dhe n\u00eb momentin kur Kuvendi do t\u00eb ket\u00eb mund\u00ebsi t\u00eb mblidhet, vendimi do parashtrohet p\u00ebr konfirmim. Para skadimit t\u00eb k\u00ebtij afati 30 ditor, pres q\u00eb Qeveria t\u00eb m\u00eb dor\u00ebzoj\u00eb raport t\u00eb holl\u00ebsish\u00ebm mbi efektet e masava t\u00eb nd\u00ebrmarra deri n\u00eb at\u00eb koh\u00eb dhe propozim t\u00eb arsyetuar p\u00ebr nevoj\u00ebn e zgjatjes s\u00eb mundshme t\u00eb gjendjes s\u00eb jasht\u00ebzakonshme edhe p\u00ebr 30 dit\u00eb t\u00eb tjera<\/em>.\u201d<\/p>\n<p>M\u00eb 25 mars 2020, <a href=\"https:\/\/data.consilium.europa.eu\/doc\/document\/ST-7002-2020-INIT\/en\/pdf\">K\u00ebshilli i bashkimit Evropian<\/a> bazuar n\u00eb rekomandimet e Komisionit Evropian, pa kusht\u00ebzime solli vendim politik p\u00ebr nisjen e bisedimeve p\u00ebr an\u00ebtar\u00ebsimin e Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut n\u00eb Bashkimin Evropian. Nj\u00ebkoh\u00ebsisht, Komisioni Evropian mori p\u00ebrsip\u00ebr q\u00eb p\u00ebr afat sa m\u00eb t\u00eb shkurt\u00ebr kohor ta p\u00ebrgatis\u00eb korniz\u00ebn negociuese n\u00eb p\u00ebrputhje me Metodologjin\u00eb e re t\u00eb bisedimeve. Me k\u00ebt\u00eb edhe nj\u00eb her\u00eb u konfirmua r\u00ebnd\u00ebsia e Kapitullit 23 \u2013 Sistemi gjyq\u00ebsor dhe t\u00eb drejtat themelore si kusht kryesor n\u00eb progresin e bisedimeve, si dhe ndikimin e tij ndaj t\u00ebr\u00eb procesit t\u00eb p\u00ebrafrimit. Si rezultat i k\u00ebsaj, monitorimi i organizatave qytetare p\u00ebr progresin n\u00eb Kapitullin 23 \u00ebsht\u00eb i r\u00ebnd\u00ebsis\u00eb esenciale. Duke e marr\u00eb parasysh k\u00ebt\u00eb m\u00eb lart\u00eb dhe duke e ndjekur zhvillimin e ngjarjeve, Komiteti i Helsinkit adresoi thirrje p\u00ebr respektimin e t\u00eb drejtave t\u00eb njeriut p\u00ebrmes njoftimit t\u00eb vazhduesh\u00ebm dhe transparent t\u00eb opinionit me informacione t\u00eb sakta me q\u00ebllim t\u00eb mbik\u00ebqyrjes m\u00eb t\u00eb madhe ndaj pushtetit ekzekutiv gjat\u00eb koh\u00ebs s\u00eb gjendjes s\u00eb jasht\u00ebzakonshme. <a href=\"https:\/\/mhc.org.mk\/news\/merkite-shto-se-prezemaat-dodeka-trae-vonrednata-sostojba-moraat-da-bidat-vo-soglasnost-so-principite-na-neophodnost-i-proporcionalnost\/?fbclid=IwAR2bfbLoLn_VBdzLDaVLggK5Ya9TmjaCxnDHmerffMA5nk-7oQQ5ciGesbw\">Porosia e Komitetit<\/a> \u00ebsht\u00eb se \u201c<em>shteti nuk guxon q\u00eb n\u00eb m\u00ebnyr\u00eb arbitrare ta ndaloj\u00eb zbatimin e t\u00eb drejtave t\u00eb njeriut ose arbitrarisht t\u2019i kufizoj\u00eb t\u00eb drejtat e njeriut, p\u00ebr mbrojtjen dhe sigurimin e t\u00eb cilave \u00ebsht\u00eb vet\u00eb p\u00ebrgjegj\u00ebse. Masat duhet t\u00eb nd\u00ebrmerren rrept\u00ebsisht n\u00eb p\u00ebrputhje me nevojat q\u00eb i k\u00ebrkon situata. Sipas standardeve vendore dhe nd\u00ebrkomb\u00ebtare, kufizimi i t\u00eb drejtave dhe lirive n\u00eb asnj\u00eb rast nuk guxon t\u00eb jet\u00eb diskriminues n\u00eb baz\u00eb gjinore, racore, t\u00eb ngjyr\u00ebs s\u00eb l\u00ebkur\u00ebs, gjuh\u00ebs, fes\u00eb, p\u00ebrkat\u00ebsis\u00eb etnike ose sociale, statusit pasuror ose shoq\u00ebror<\/em>\u201d.<\/p>\n<p>Fokusi i k\u00ebtij raporti mujor \u00ebsht\u00eb ndikimi i masave t\u00eb Qeveris\u00eb s\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut dhe gjendjes s\u00eb jasht\u00ebzakonshme n\u00eb situat\u00ebn mbi t\u00eb drejtat e njeriut. Sipas trendit t\u00eb p\u00ebrcaktuar, v\u00ebmendja duhet t\u00eb p\u00ebrqendrohet n\u00eb menaxhimin e kriz\u00ebs socio-ekonomike si rezultat i pandemis\u00eb &#8211; ve\u00e7an\u00ebrisht n\u00eb mbrojtjen e t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve dhe masave aktive p\u00ebr ta parandaluar dhe sanksionuar dhun\u00ebn n\u00eb familje. Komiteti gjithashtu u b\u00ebn thirrje institucioneve kompetente, ve\u00e7an\u00ebrisht Ministris\u00eb s\u00eb Pun\u00ebve t\u00eb Brendshme, p\u00ebr nj\u00eb qasje proaktive ndaj rritjes alarmante t\u00eb gjuh\u00ebs s\u00eb urrejtjes n\u00eb mediat sociale.<\/p>\n<p>T\u00cb DREJTAT E PUN\u00cbTOR\u00cbVE<\/p>\n<p><strong>Pun\u00ebtor\u00ebt n\u00eb koh\u00ebn e gjendjes s\u00eb jasht\u00ebzakonshme nj\u00ebkoh\u00ebsisht luftojn\u00eb kund\u00ebr virusit dhe p\u00ebr mbijetes\u00ebn e tyre<\/strong><\/p>\n<p><strong>\u00a0<\/strong>N\u00eb mars, Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut raportoi<strong> 65 denoncime p\u00ebr shkelje t\u00eb t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve, <\/strong>duke p\u00ebrfshir\u00eb af\u00ebrsisht<strong> 1.583 pun\u00ebtor\u00eb. <\/strong>Nga k\u00ebto<strong>, madje 60 denoncime n\u00eb lidhje me 1554 pun\u00ebtor\u00eb<\/strong><strong>,<\/strong><strong> jan\u00eb regjistruar menj\u00ebher\u00eb pas <\/strong><strong>zbatimit<\/strong><strong> t\u00eb mas\u00ebs s\u00eb par\u00eb t\u00eb Qeveris\u00eb s\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut p\u00ebr mbrojtjen dhe parandalimin e koronavirusit, m\u00eb 10 mars. <a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> <\/strong><\/p>\n<p>M\u00eb 10 mars, Qeveria miratoi nj\u00eb mas\u00eb q\u00eb e pezullon procesin arsimor dhe m\u00ebsimin n\u00eb t\u00eb gjitha kopshtet dhe shkollat \u200b\u200bfillore. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, Qeveria vendosi q\u00eb p\u00ebr ta zbatuar k\u00ebt\u00eb mas\u00eb, nj\u00ebri nga prind\u00ebrit, f\u00ebmij\u00ebt e t\u00eb cilit deri n\u00eb mosh\u00ebn dhjet\u00eb vje\u00e7are ndjekin m\u00ebsime n\u00eb kopsht apo shkoll\u00eb fillore, do t\u00eb lirohen nga obligimi p\u00ebr t\u00eb shkuar n\u00eb pun\u00eb. Menj\u00ebher\u00eb pas k\u00ebsaj, u p\u00ebrcaktuan kategorit\u00eb e personave q\u00eb duhet t\u00eb lirohen nga puna dhe aktivitetet e pun\u00ebs, p\u00ebr shkak t\u00eb kushteve t\u00eb caktuara sh\u00ebndet\u00ebsore. M\u00eb 14 mars, Qeveria rekomandoi q\u00eb t\u00eb gjith\u00eb pun\u00ebdh\u00ebn\u00ebsit n\u00eb vend, n\u00eb var\u00ebsi t\u00eb llojit dhe mund\u00ebsive t\u00eb pun\u00ebs, ta organizojn\u00eb pun\u00ebn dhe m\u00ebnyr\u00ebn e pun\u00ebs s\u00eb punonj\u00ebsve p\u00ebrmes institutit &#8220;pun\u00eb nga sht\u00ebpia&#8221;<strong>. M\u00eb 18 mars 2020, Republika e Maqedonis\u00eb<\/strong><strong> s\u00eb<\/strong><strong> Veri<\/strong><strong>ut<\/strong><strong> shpalli gjendje t\u00eb jasht\u00ebzakonshme n\u00eb <\/strong><strong>territorin e t\u00ebr\u00eb shtetit.<\/strong><\/p>\n<p>Qeveria miratoi edhe masa ekonomike p\u00ebr menaxhimin e pasojave nga koronavirusi, q\u00eb parashikojn\u00eb mb\u00ebshtetje t\u00eb drejtp\u00ebrdrejt\u00eb financiare t\u00eb likuiditetit t\u00eb nd\u00ebrmarrjeve mikro, nd\u00ebrmarrjeve t\u00eb vogla dhe t\u00eb mesme nga ana e Bank\u00ebs s\u00eb zhvillimit t\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> U miratua edhe nj\u00eb mas\u00eb, e cila kishte t\u00eb b\u00ebnte me mb\u00ebshtetjen e nd\u00ebrmarrjeve n\u00eb aspektin e pagimit t\u00eb pagave me an\u00eb t\u00eb subvencionimit t\u00eb kontributeve p\u00ebr pun\u00ebtor\u00ebt e nd\u00ebrmarrjeve t\u00eb prekura.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>Paralelisht me rritjen e numrit t\u00eb rasteve t\u00eb regjistruara me koronavirus, <strong>shkeljet e t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve<\/strong> ishin n\u00eb rritje. Menj\u00ebher\u00eb pas zbatimit t\u00eb mas\u00ebs s\u00eb par\u00eb nga Qeveria, Komiteti i Helsinkit i regjistroi parregullsit\u00eb e para t\u00eb raportuara nga shum\u00eb pun\u00ebtor\u00eb.<\/p>\n<p>Duke e keqp\u00ebrdorur gjendjen e jasht\u00ebzakonshme, pun\u00ebdh\u00ebn\u00ebsit filluan q\u00eb t\u2019i anulojn\u00eb kontratat e pun\u00ebsimit t\u00eb nj\u00eb numrit t\u00eb madh t\u00eb pun\u00ebtor\u00ebve, kurse atje ku kishin mund\u00ebsi ju b\u00ebnin ndikim p\u00ebr ta nd\u00ebrprer\u00ebe marr\u00ebdh\u00ebnien e pun\u00ebs me marr\u00ebveshje.<\/p>\n<p>Nj\u00eb pjes\u00eb t\u00eb pun\u00ebtor\u00ebve ua <strong>zvog\u00ebluan pagat<\/strong> n\u00eb m\u00ebnyr\u00eb t\u00eb konsiderueshme. <a href=\"https:\/\/www.alsat-m.tv\/mk\/%D0%BE%D1%85%D1%80%D0%B8%D0%B4-%D0%B7%D0%B3%D0%BE%D0%BB%D0%B5%D0%BC%D0%B5%D0%BD-%D0%B1%D1%80%D0%BE%D1%98-%D0%BE%D1%82%D0%BF%D1%83%D1%88%D1%82%D0%B0%D1%9A%D0%B0-%D0%BE%D0%B4-%D1%80%D0%B0%D0%B1%D0%BE\/\">Agjencia p\u00ebr pun\u00ebsim n\u00eb Oh\u00ebr ka pranuar denoncime<\/a> p\u00ebr <strong>\u00e7lajm\u00ebrimin<\/strong> e rreth 3000 pun\u00ebtor\u00ebve n\u00eb fabrikat e tekstilit, fabrikat p\u00ebr prodhimin e k\u00ebpuc\u00ebve, hotelet dhe restorantet.<\/p>\n<p>Disa prej pun\u00ebdh\u00ebn\u00ebsve i <strong>anuluan kontratat<\/strong> e pun\u00ebsimit p\u00ebr arsye afariste. Kudo q\u00eb Inspektorati t\u00eb konstatoj\u00eb shkelje t\u00eb t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve, \u00ebsht\u00eb i detyruar q\u00eb t\u2019i th\u00ebrret n\u00eb p\u00ebrgjegj\u00ebsi pun\u00ebdh\u00ebn\u00ebsit q\u00eb nuk i respektojn\u00eb ose i shkelin rekomandimet e Qeveris\u00eb.<\/strong><\/p>\n<p>DISKRIMINIMI<\/p>\n<p><strong>Ngacmimi seksual i grave pun\u00ebtore \u00ebsht\u00eb praktik\u00eb e shpesht\u00eb e pun\u00ebdh\u00ebn\u00ebsve<\/strong><\/p>\n<p><strong>Grat\u00eb pun\u00ebtore<\/strong> jo rrall\u00eb ballafaqohen me <strong>diskriminim n\u00eb baz\u00eb gjinore dhe seksi<\/strong> si n\u00eb vendin e pun\u00ebs, ashtu edhe gjat\u00eb pun\u00ebsimit. Gjat\u00eb pun\u00ebsimit, grave shpesh u parashtrohen pyetje n\u00ebse jan\u00eb t\u00eb martuar, n\u00ebse kan\u00eb f\u00ebmij\u00eb, n\u00ebse planifikojn\u00eb t\u00eb krijojn\u00eb familje, madje ballafaqohen edhe me pyetje dhe komente t\u00eb pak\u00ebndshme q\u00eb nuk kan\u00eb lidhje me arsimimin dhe p\u00ebrvoj\u00ebn e tyre t\u00eb pun\u00ebs. Konkurset p\u00ebr pun\u00ebsim edhe pse duhet t\u00eb jen\u00eb t\u00eb paanshme sa i p\u00ebrket gjinis\u00eb, shpesh shpallen p\u00ebr vende t\u00eb pun\u00ebs ku konkretisht k\u00ebrkohen burra ose gra.<\/p>\n<p><strong>Nj\u00eb rast i ngacmimit seksual u raportua n\u00eb Komitetin e Helsinkit n\u00eb<\/strong><strong> muajin<\/strong><strong> mars<\/strong><strong>,<\/strong><strong> pas aplikimit n\u00eb nj\u00eb <\/strong><strong>konkurs pun\u00ebsimi<\/strong> p\u00ebr sekretare afariste t\u00eb drejtorit t\u00eb p\u00ebrgjithsh\u00ebm n\u00eb nj\u00eb nd\u00ebrmarrje private. N\u00eb konkurs kan\u00eb aplikuar dy kandidate q\u00eb e kan\u00eb dor\u00ebzuar dokumentacionin e nevojsh\u00ebm. Pasi kan\u00eb aplikuar n\u00eb konkurs, ato menj\u00ebher\u00eb kan\u00eb marr\u00eb p\u00ebrgjigje nga personi q\u00eb e ka prezantuar veten si administrator i nd\u00ebrmarrjes. Korrespondenca midis kandidateve dhe administratorit t\u00eb nd\u00ebrmarrjes \u00ebsht\u00eb zhvilluar ndaras, p\u00ebrmes post\u00ebs elektronike. Administratori s\u00eb pari u ka ofruar kandidateve nj\u00eb takim p\u00ebr nj\u00eb intervist\u00eb, pastaj ua ka shpjeguar detyrat dhe obligimet e pun\u00ebs dhe n\u00eb fund t\u00eb dyja kandidateve u ka konfirmuar se t\u00eb dyjat jan\u00eb t\u00eb pun\u00ebsuara. Nga deklaratat e t\u00eb dyja kandidateve, n\u00ebn &#8220;aft\u00ebsi gojore&#8221; administratori i nd\u00ebrmarrjes nuk ka n\u00ebnkuptuar aft\u00ebsi pune, por k\u00ebt\u00eb e ka th\u00ebn\u00eb n\u00eb nj\u00eb konotacion seksual, gj\u00eb q\u00eb ka qen\u00eb shqet\u00ebsuese p\u00ebr t\u00eb dyja kandidatet.<\/p>\n<p><strong>\u00a0<\/strong>Rasti ishte raportuar n\u00eb Komitetin e Helsinkit p\u00ebr t\u00eb drejtat e njeriut nga t\u00eb dyja kandidatet dhe p\u00ebr k\u00ebt\u00eb rast \u00ebsht\u00eb<strong> inicuar<\/strong><strong> procedur\u00eb para Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs.<\/strong><\/p>\n<p>Ngacmimi seksual n\u00ebnkupton \u00e7do sjellje verbale, joverbale ose sjellje fizike t\u00eb nj\u00eb natyre seksuale q\u00eb e shkel dinjitetin personal, ve\u00e7an\u00ebrisht kur shkakton frik\u00ebsim, refuzim, degradim, posht\u00ebrim ose sjellje abuzive<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a>. Ky lloj ngacmimi q\u00eb jo rrall\u00eb u ndodh grave n\u00eb vendet e pun\u00ebs ose gjat\u00eb pun\u00ebsimit, paraqet dhun\u00eb me baz\u00eb gjinore q\u00eb \u00ebsht\u00eb nj\u00eb shkelje serioze e t\u00eb drejtave dhe lirive themelore t\u00eb njeriut, dinjitetit t\u00eb individit dhe paraqet <strong>diskriminim ndaj grave<\/strong>, vet\u00ebm p\u00ebr faktin se ato jan\u00eb gra.<\/p>\n<p>N\u00eb Maqedonin\u00eb e Veriut, n\u00eb m\u00ebnyr\u00eb t\u00eb konsiderueshme m\u00eb shum\u00eb gra (68%) jan\u00eb p\u00ebrballur me diskriminim gjat\u00eb pun\u00ebsimit sesa burrat (58%). Nga viktimat e ngacmimit seksual n\u00eb vendin e pun\u00ebs, 45% nuk e kan\u00eb ndar\u00eb ose raportuar p\u00ebrvoj\u00ebn; 29% i kan\u00eb than\u00eb nj\u00eb shoku\/shoqes ose nj\u00eb t\u00eb njohuri; kurse 20% e kan\u00eb ndar\u00eb p\u00ebrvoj\u00ebn e tyre me nj\u00eb an\u00ebtar t\u00eb familjes. Edhe pse ky \u00ebsht\u00eb nj\u00eb shembull i duksh\u00ebm i dhun\u00ebs n\u00eb baz\u00eb gjinore n\u00eb internet, kjo nuk \u00ebsht\u00eb adresuar qart\u00eb dhe n\u00eb m\u00ebnyr\u00eb t\u00eb duhur p\u00ebr publikun, gj\u00eb q\u00eb vet\u00ebm na kujton p\u00ebrs\u00ebri se institucionet, publiku dhe mediat nuk jan\u00eb t\u00eb njoftuar me dhun\u00ebn me baz\u00eb gjinore, ve\u00e7an\u00ebrisht t\u00eb k\u00ebtij lloji, dhe faji, si deri m\u00eb tani, u ishte adresuar vet\u00eb viktimave.<\/p>\n<p>N\u00eb k\u00ebt\u00eb marsh p\u00ebr nder t\u00eb 8 marsit, qart\u00eb ishin adresuar k\u00ebrkesat p\u00ebr drejt\u00ebsi p\u00ebr t\u00eb gjitha grat\u00eb viktima t\u00eb dhun\u00ebs, p\u00ebr institucionet q\u00eb n\u00eb vend q\u00eb t\u00eb kryejn\u00eb viktimizim t\u00eb dyfisht\u00eb, t\u00eb jen\u00eb gjithnj\u00eb n\u00eb an\u00ebn e viktim\u00ebs, si dhe p\u00ebr nj\u00eb angazhim t\u00eb qart\u00eb p\u00ebr barazin\u00eb gjinore nga shteti si n\u00ebnshkrues i Konvent\u00ebs s\u00eb Stambollit i cili e ka p\u00ebr detyrim ta parandaloj\u00eb dhe luftoj\u00eb dhun\u00ebn me baz\u00eb gjinore. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, k\u00ebrkesat e theksuan edhe nevoj\u00ebn p\u00ebr parandalimin, mbrojtjen dhe mb\u00ebshtetjen adekuate, n\u00eb koh\u00eb dhe efikase t\u00eb viktimave t\u00eb dhun\u00ebs me baz\u00eb gjinore nga t\u00eb gjitha institucionet q\u00eb jan\u00eb pjes\u00eb e sistemit p\u00ebr mbrojtje dhe sanksionim t\u00eb rrept\u00eb t\u00eb \u00e7do mosveprimi. Dhuna me baz\u00eb gjinore ka pasoja t\u00eb afatgjata dhe serioze mbi sh\u00ebndetin, ve\u00e7an\u00ebrisht mbi sh\u00ebndetin mendor dhe mir\u00ebqenien e viktimave, prandaj \u00ebsht\u00eb jasht\u00ebzakonisht e r\u00ebnd\u00ebsishme t\u2019u lejohet grave dhe vajzave q\u00eb t\u00eb ndihen t\u00eb sigurta edhe n\u00eb rrug\u00eb, edhe n\u00eb sht\u00ebpi, por edhe n\u00eb internet<\/p>\n<p>DHUNA N\u00cb FAMILJE<\/p>\n<p><strong>AUTORI I HOSPITALIZUAR, VIKTIMA E KTHYER N\u00cb SHT\u00cbPIN\u00cb E SAJ<\/strong><\/p>\n<p>Vitin e kaluar n\u00eb dhjetor, n\u00eb Komitetin e Helsinkit p\u00ebr t\u00eb drejtat e njeriut \u00ebsht\u00eb denoncuar nj\u00eb rast i dhun\u00ebs disavje\u00e7are n\u00eb familje e kryer nga ana e bashk\u00ebshortit ndaj bashk\u00ebshortes s\u00eb tij.<\/p>\n<p>Dhuna fizike dhe psikologjike \u00ebsht\u00eb kryer para syve t\u00eb n\u00ebnt\u00eb f\u00ebmij\u00ebve t\u00eb tyre, kurse viktima shpesh ka p\u00ebsuar l\u00ebndime trupore dhe l\u00ebndime t\u00eb r\u00ebnda fizike. P\u00ebr t\u2019i shtuar n\u00eb pesh\u00eb edhe m\u00eb shum\u00eb rastit, ka ndikuar edhe papun\u00ebsia e t\u00eb dy an\u00ebtar\u00ebve t\u00eb \u00e7iftit t\u00eb martuar, t\u00eb cil\u00ebt shumic\u00ebn e koh\u00ebs e kan\u00eb kaluar n\u00eb sht\u00ebpin\u00eb e tyre. Kjo rrethan\u00eb e ka rritur edhe m\u00eb shum\u00eb rrezikun p\u00ebr viktim\u00ebn, e cila vazhdimisht ka qen\u00eb n\u00eb prani t\u00eb dhunuesit.<\/p>\n<p>Sulmi i fundit ndaj viktim\u00ebs ka ndodhur n\u00eb fillim t\u00eb vitit 2019, kur ajo ka qen\u00eb e akomoduar n\u00eb Qendr\u00ebn e strehimit s\u00eb bashku me disa nga f\u00ebmij\u00ebt e saj. Kund\u00ebr dhunuesit jan\u00eb shqiptuar masa t\u00eb p\u00ebrkohshme p\u00ebr mbrojtje nga dhuna familjare nga ana e Gjykat\u00ebs Themelore Civile Shkup dhe p\u00ebr shkak se autori nuk i ka respektuar ato, kund\u00ebr tij \u00ebsht\u00eb ngritur edhe procedur\u00eb penale. Gjat\u00eb gjith\u00eb periudh\u00ebs p\u00ebr t\u00eb cil\u00ebn viktima ka qen\u00eb e kujdesur n\u00eb Qendr\u00ebn e strehimit, dhunuesi ka vazhduar me selljen e tij deviante, k\u00ebshtu q\u00eb k\u00ebsaj radhe viktima t\u00eb tij kan\u00eb qen\u00eb f\u00ebmij\u00ebt q\u00eb kan\u00eb mbetur t\u00eb jetojn\u00eb me t\u00eb. P\u00ebr ta b\u00ebr\u00eb situat\u00ebn edhe m\u00eb tragjike, nj\u00ebri prej f\u00ebmij\u00ebve ka qen\u00eb person me nj\u00eb kombinim t\u00eb aft\u00ebsive t\u00eb kufizuara i cili nuk ka qen\u00eb n\u00eb gjendje t\u00eb ushqehet, ec\u00ebn, vishet dhe flas\u00eb, etj. n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur.<\/p>\n<p>Pasi q\u00eb dhuna ndaj f\u00ebmij\u00ebve ka qen\u00eb e raportuar n\u00eb sh\u00ebrbimet sociale, ata kan\u00eb qen\u00eb t\u00eb kujdesur n\u00eb t\u00eb nj\u00ebjt\u00ebn Qend\u00ebr t\u00eb strehimit me n\u00ebn\u00ebn, p\u00ebrve\u00e7 f\u00ebmij\u00ebs me aft\u00ebsi t\u00eb kufizuara q\u00eb ka mbetur n\u00eb sht\u00ebpi. Duke pasur parasysh personalitetin e dhunuesit, historin\u00eb e tij t\u00eb dhun\u00ebs dhe var\u00ebsin\u00eb e tij nga alkooli, Komiteti i k\u00ebrkoi Qendr\u00ebs p\u00ebr pun\u00eb sociale q\u00eb menj\u00ebher\u00eb t\u00eb kryej\u00eb mbik\u00ebqyrje n\u00eb sht\u00ebpi dhe t\u00eb marr\u00eb masa p\u00ebr p\u00ebrkujdesjen e k\u00ebtij f\u00ebmije.<\/p>\n<p>N\u00eb nd\u00ebrkoh\u00eb, n\u00eb muajin mars na njoftuan se n\u00eb gjykat\u00eb p\u00ebrs\u00ebri \u00ebsht\u00eb parashtruar propozim p\u00ebr shqiptimin e masave mbrojt\u00ebse nga dhuna familjare, k\u00ebt\u00eb her\u00eb p\u00ebr mbrojtjen e f\u00ebmij\u00ebve. Gjykata m\u00eb n\u00eb fund e ka kuptuar seriozitetin e k\u00ebtij rasti, k\u00ebshtu q\u00eb mes masave t\u00eb p\u00ebrcaktuara ka qen\u00eb edhe masa e trajtimit t\u00eb detyruesh\u00ebm psikiatrik. Pas marrjes s\u00eb vendimit, policia, sh\u00ebrbimet sociale dhe sh\u00ebrbimet e urgjenc\u00ebs mjek\u00ebsore bashk\u00ebrisht e kan\u00eb d\u00ebrguar autorin n\u00eb trajtim psikiatrik n\u00eb ISHP Spitali psikiatrik &#8211; Shkup. Viktima s\u00eb bashku me f\u00ebmij\u00ebt e saj \u00ebsht\u00eb kthyer n\u00eb sht\u00ebpi dhe e ka marr\u00eb kujdesin e plot\u00eb ndaj f\u00ebmij\u00ebs me aft\u00ebsi t\u00eb kufizuara.<\/p>\n<p>Edhe pse n\u00eb k\u00ebt\u00eb rast viktim\u00ebs dhe f\u00ebmij\u00ebve askush nuk ua garanton sigurin\u00eb, prap\u00eb ky \u00ebsht\u00eb nj\u00eb nga shembujt e pakt\u00eb pozitiv kur abuzuesi largohet nga sht\u00ebpia, kurse viktima dhe f\u00ebmij\u00ebt mbesin n\u00eb t\u00eb. Theksojm\u00eb se institucionet duhet t\u00eb jen\u00eb seriozisht t\u00eb kujdessh\u00ebm dhe ta ndjekin me shum\u00eb v\u00ebmendje t\u00eb madhe k\u00ebt\u00eb rast, ve\u00e7an\u00ebrisht pas p\u00ebrfundimit t\u00eb trjtimit psikiatrik t\u00eb dhunuesit. ISHP Spitali psikiatrik &#8211; Shkup n\u00eb asnj\u00eb rast nuk guxon t\u00eb lejoj\u00eb q\u00eb ky person t\u00eb largohet vullnetarisht nga institucioni sh\u00ebndet\u00ebsor, sepse k\u00ebshtu, rreziku p\u00ebr nj\u00eb femicid tjet\u00ebr rritet.<\/p>\n<p><strong>DHUNA N\u00cb FAMILJE N\u00cbN KUSHTET E IZOLIMIT SHT\u00cbPIAK<\/strong><\/p>\n<p>Gjat\u00eb koh\u00ebzgjatjes s\u00eb gjendjes s\u00eb jasht\u00ebzkonshme n\u00eb vendin ton\u00eb, kur vlejn\u00eb rekomandimet e Qeveris\u00eb q\u00eb qytetar\u00ebt t\u00eb q\u00ebndrojn\u00eb n\u00eb sht\u00ebpit\u00eb e tyre, Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut ka regjistruar <strong>nj\u00eb denoncim t\u00eb dhun\u00ebs n\u00eb familje<\/strong> n\u00eb Berov\u00eb. Viktima e njoftoi Komitetin e Helsinkit se gjat\u00eb or\u00ebve t\u00eb vona t\u00eb mbr\u00ebmjes, nd\u00ebrsa ka qen\u00eb n\u00eb sht\u00ebpi me f\u00ebmij\u00ebn e saj q\u00eb vuan nga epilepsia, ish-partneri i saj n\u00eb gjendje alkoolike ka ardhur n\u00eb sht\u00ebpin\u00eb e tyre. Ai edhe m\u00eb par\u00eb e ka ngacmuar psiqikisht partneren e tij, kurse at\u00eb mbr\u00ebmje i \u00ebsht\u00eb drejtuar asaj me nj\u00eb ton t\u00eb lart\u00eb dhe e ka fyer viktim\u00ebn, gj\u00eb q\u00eb ka shkaktuar ndjenj\u00eb t\u00eb pasiguris\u00eb dhe frik\u00ebs tek ajo dhe f\u00ebmija. Rasti \u00ebsht\u00eb raportuar n\u00eb polici nga viktima, por sipas saj, n\u00ebpun\u00ebsit policor\u00eb fare nuk kan\u00eb ardhur n\u00eb sht\u00ebpi.<\/p>\n<p><strong>Konkluzion: Rekomandimet<\/strong><strong> e<\/strong><strong> Qeveris\u00eb p\u00ebr <\/strong><strong>vet\u00eb<\/strong><strong>izolim <\/strong><strong>q\u00eb jan\u00eb n\u00eb fuqi <\/strong><strong>mund t\u00eb kontribuojn\u00eb n\u00eb rritjen e rrezikut t\u00eb dhun\u00ebs n\u00eb familje. Prandaj, pas pranimit t\u00eb raportit, duke pasur parasysh veprimin joprofesional t\u00eb <\/strong><strong>n\u00ebpun\u00ebsve <\/strong><strong>polic<\/strong><strong>or\u00eb<\/strong><strong> n\u00eb k\u00ebt\u00eb rast, Komiteti i Helsinkit kontaktoi menj\u00ebher\u00eb Stacionin <\/strong><strong>p<\/strong><strong>olicor &#8211; Berov\u00eb. Oficer\u00ebt <\/strong><strong>e<\/strong><strong> policis\u00eb u <\/strong><strong>njoftuan<\/strong><strong> p\u00ebr nevoj\u00ebn<\/strong><strong> urgjente p\u00ebr veprim n\u00eb rast t\u00eb denoncimit t\u00eb s\u00ebrish\u00ebm nga ky person<\/strong><strong>, duke pasur parasysh mund\u00ebsin\u00eb e p\u00ebrs\u00ebritjes s\u00eb dhun\u00ebs, si dhe shkall\u00ebn e rrezikut <\/strong><strong>n\u00eb t\u00eb cilin gjenden viktima dhe f\u00ebmija i saj<\/strong><strong>. <\/strong><\/p>\n<p><strong>Rekomandim: Metoda kryesore e ruajtjes <\/strong><strong>s<\/strong><strong>\u00eb sh\u00ebndetit \u00ebsht\u00eb izolimi <\/strong><strong>sht\u00ebpiak<\/strong><strong>, k\u00ebshtu q\u00eb \u00ebsht\u00eb jasht\u00ebzakonisht e r\u00ebnd\u00ebsishme n\u00eb k\u00ebt\u00eb periudh\u00eb q\u00eb institucionet t\u00eb reagojn\u00eb n\u00eb m\u00ebnyr\u00eb<\/strong><strong> adekuate<\/strong><strong> dhe n\u00eb koh\u00eb dhe t\u00eb veprojn\u00eb <\/strong><strong>ndaj denoncimeve p\u00ebr dhun\u00eb<\/strong><strong> n\u00eb familje dhe<\/strong><strong> n\u00eb baz\u00eb<\/strong> <strong>gjinore, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb shmangen pasojat fatale.<\/strong><\/p>\n<p>INSTITUCIONE T\u00cb MBYLLURA<\/p>\n<p><strong>UDH\u00cbZIMET E OBSH-s\u00eb p\u00ebr mbrojtje nga pandemia domosdoSHM\u00cbRISHT duhet t\u00eb respektohen dhe t\u00eb implementohen plot\u00ebsisht n\u00eb t\u00eb gjitha institucionet e mbyllura<\/strong><\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut ka pranuar <strong>disa ankesa n\u00eb lidhje me trajtimin dhe sigurin\u00eb e t\u00eb d\u00ebnuarve q\u00eb <\/strong><strong>e <\/strong><strong>vuajn\u00eb<\/strong> mas\u00ebn e d\u00ebnimit n\u00eb burgun e Kumanov\u00ebs. Sipas raportimeve n\u00eb ankesat, rreth 30 shtetas t\u00eb huaj po vuajn\u00eb d\u00ebnimin me burg n\u00eb burgun e Kumanov\u00eb, t\u00eb drejtat e njeriut t\u00eb t\u00eb cil\u00ebve jan\u00eb shkelur vazhdimisht nga ana e institucionit. N\u00eb ankes\u00eb thuhet se k\u00ebtyre personave <strong>nuk u <\/strong><strong>ofrohen as<\/strong><strong> kushte<\/strong><strong>t<\/strong> <strong>bazike<\/strong><strong> t\u00eb jetes\u00ebs<\/strong>, p\u00ebr sa i p\u00ebrket neneve 156, 157, 159 dhe 160 (akomodim p\u00ebrkat\u00ebs, veshmbathje dhe shtrat t\u00eb past\u00ebr dhe e drejta p\u00ebr higjien\u00eb personale) t\u00eb Ligjit p\u00ebr zbatimin e sanksioneve.<\/p>\n<p>P\u00ebr m\u00eb tep\u00ebr, personat e gjykuar shtojn\u00eb se n\u00eb burgun e Kumanov\u00ebs <strong>nuk u sigurohet uj\u00eb i past\u00ebr p\u00ebr t\u00eb pir\u00eb, madje as uj\u00eb p\u00ebr mir\u00ebmbajtjen e higjien\u00ebs personale.<\/strong><\/p>\n<p>Problemi me furnizimin me uj\u00eb n\u00eb burgun e Kumanov\u00ebs ishte v\u00ebrejtur edhe gjat\u00eb vizit\u00ebs s\u00eb burgut m\u00eb 05.04.2019 nga ana e p\u00ebrfaq\u00ebsuesve t\u00eb Komitetit t\u00eb Helsinkit p\u00ebr t\u00eb drejtat e njeriut. Gjat\u00eb vizit\u00ebs, drejtori i burgut na informoi se n\u00eb bashk\u00ebpunim me nj\u00eb nd\u00ebrmarrje me p\u00ebrgjegj\u00ebsi shoq\u00ebrore n\u00eb rajon, problemi me furnizimin me uj\u00eb n\u00eb burg p\u00ebrkoh\u00ebsisht \u00ebsht\u00eb zgjidhur, duke b\u00ebr\u00eb rrjet n\u00ebnujor. N\u00eb bised\u00eb me disa prej t\u00eb burgosurve u kuptua q\u00eb n\u00eb burg nuk ka aspak uj\u00eb, kurse n\u00eb t\u00eb gjitha dhomat e burgut u v\u00ebrejt\u00ebn nj\u00eb num\u00ebr i madh i shisheve t\u00eb plastik\u00ebs me uj\u00eb. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, u gjet\u00ebn edhe shishe boshe t\u00eb vendosura n\u00eb hyrjet e toaleteve n\u00eb kapacitetet e akomodimit, me q\u00ebllim q\u00eb t\u00eb parandalohet era. M\u00eb 19.09.2019 u b\u00eb edhe nj\u00eb vizit\u00eb n\u00eb burgun e Kumanov\u00ebs, ku p\u00ebrs\u00ebri n\u00eb nj\u00eb bised\u00eb me personat e d\u00ebnuar ishte b\u00ebr\u00eb me dije se akoma nuk ka uj\u00eb fare, edhe q\u00eb t\u00eb d\u00ebnuarit mbushin shishe me uj\u00eb nga nj\u00ebsia e paraburgimit t\u00eb institucionit q\u00eb ndodhet n\u00eb katin e par\u00eb, pas marrjes paraprake t\u00eb lejes nga policia e burgut.<\/p>\n<p><strong>Konkluzion: Duke <\/strong><strong>e <\/strong><strong>pasur parasysh pandemin\u00eb e infeksionit t\u00eb <\/strong><strong>koronavirusit<\/strong><strong> (COVID-19), sipas mendimit t\u00eb Komiteti\u0442 p\u00ebr Parandalimin e Tortur\u00ebs dhe Trajtimit \u00c7njer\u00ebzor ose Degradues apo Nd\u00ebshkimit (KPT), p\u00ebr t\u00eb gjitha organet n\u00ebn juridiksionin e t\u00eb cil\u00ebve jan\u00eb persona<\/strong><strong>t<\/strong> <strong>e<\/strong><strong> privuar nga liria, n\u00eb territorin q\u00eb e p\u00ebrfshin K\u00ebshilli i Evrop\u00ebs &#8220;nd\u00ebrmarrja e t\u00eb gjitha masave t\u00eb mundshme p\u00ebr mbrojt<\/strong><strong>jen e<\/strong><strong> sh\u00ebndeti<\/strong><strong>t<\/strong><strong> dhe siguris\u00eb <\/strong><strong>s<\/strong><strong>\u00eb<\/strong><strong> t\u00eb gjith\u00eb personave t\u00eb privuar nga liria duhet t\u00eb jet\u00eb nj\u00eb parim themelor. <\/strong><strong>Nd\u00ebrmarrja<\/strong><strong> e k\u00ebtyre masave gjithashtu kontribuon n\u00eb ruajtjen e sh\u00ebndetit dhe siguris\u00eb s\u00eb punonj\u00ebsve n\u00eb k\u00ebto institucione. Kufizimet e takimeve me an\u00ebtar\u00ebt e familjes dhe bot\u00ebn e jashtme duhet t\u00eb kompensohen me lejen e personave q\u00eb t\u2019i p\u00ebrdorin telefonat ose t\u00eb ken\u00eb komunikim n\u00eb internet.<\/li>\n<li>Institucionet kompetente t\u00eb veprojn\u00eb n\u00eb p\u00ebrputhje me nenin 224 t\u00eb Ligjit p\u00ebr ekzekutimin e sanksioneve dhe t&#8217;i paraqesin gjykat\u00ebsit p\u00ebr ekzekutimin e sanksioneve nj\u00eb propozim p\u00ebr nd\u00ebrprerjen e vuajtjes s\u00eb d\u00ebnimit p\u00ebr personat q\u00eb jan\u00eb t\u00eb rrezikuar ndaj COVID-19, n\u00eb p\u00ebrputhje me List\u00ebn e s\u00ebmundjeve kronike me diagnoz\u00eb q\u00eb jan\u00eb t\u00eb liruar nga detyrat e pun\u00ebs t\u00eb Ministris\u00eb s\u00eb Sh\u00ebndet\u00ebsis\u00eb<a href=\"#_ftn11\" name=\"_ftnref11\"><sup>[11]<\/sup><\/a>, e cila sipas dokumentacionit p\u00ebrkat\u00ebs mjek\u00ebsor do t\u2019i largoj\u00eb p\u00ebrkoh\u00ebsisht personat e d\u00ebnuar nga institucioni p\u00ebr nj\u00eb periudh\u00eb m\u00eb t\u00eb gjat\u00eb se 30 dit\u00eb.<\/li>\n<li>N\u00ebse p\u00ebr koh\u00eb t\u00eb shkurt\u00ebr nuk mund t\u00eb sigurohet gjykat\u00ebs p\u00ebr ekzekutimin e sanksioneve, apelojm\u00eb q\u00eb Drejtoria p\u00ebr ekzekutimin e sanskioneve t\u00eb veproj\u00eb n\u00eb p\u00ebrputhje me nenin 225 t\u00eb Ligjit p\u00ebr ekzekutimin e sanksioneve dhe ta miratoj\u00eb aktvendim p\u00ebr nd\u00ebrprerjen e vuajtjes s\u00eb d\u00ebnimit n\u00eb koh\u00ebzgjatje deri n\u00eb 30 dit\u00eb, bazuar n\u00eb paragrafin 3, respektivisht pun\u00eb t\u00eb shkaktuara nga fatkeq\u00ebsi elementare.<\/li>\n<li>Drejtoria p\u00ebr ekzekutimin e sanksioneve n\u00eb bashk\u00ebpunim me drejtor\u00ebt e institucioneve t\u00eb tjera, t\u00eb paraqes\u00eb nj\u00eb propozim n\u00eb gjykat\u00ebn kompetente p\u00ebr lirimin me kusht t\u00eb personave q\u00eb kan\u00eb treguar rezultate n\u00eb periudh\u00ebn e prov\u00ebs dhe q\u00eb i plot\u00ebsojn\u00eb kushtet ligjore me q\u00ebllim t\u00eb zvog\u00eblimit t\u00eb mbipopullimit n\u00eb institucionet korrektuese-nd\u00ebshkimore dhe nj\u00ebherit zbatimin e masave m\u00eb efektive p\u00ebr mbrojtje nga COVID &#8211; 19.<\/li>\n<li>Gjykat\u00ebsit, mas\u00ebn e paraburgimit ta p\u00ebrdorin vet\u00ebm n\u00eb situata t\u00eb jasht\u00ebzakonshme dhe si mas\u00eb t\u00eb fundit, sidomos p\u00ebr shkak se n\u00eb k\u00ebt\u00eb situat\u00eb kur jan\u00eb t\u00eb mbyllur kufijt shtet\u00ebror\u00eb, \u00ebsht\u00eb ulur rreziku nga ikja e t\u00eb akuzuarve.<\/li>\n<li>Gjykat\u00ebsit me propozim t\u00eb prokurorit publik n\u00eb vend t\u00eb burgut, p\u00ebr veprat penale, ku \u00ebsht\u00eb e mundshme, t\u00eb shqiptojn\u00eb masa alternative \u2013 pun\u00eb e dobishme p\u00ebr shoq\u00ebrin\u00eb, nd\u00ebrprerje me kusht t\u00eb procedur\u00ebs penale dhe arrest sht\u00ebpie gjat\u00eb periudh\u00ebs s\u00eb pandemis\u00eb.<\/li>\n<li>Edhe n\u00eb kushtet e pandemis\u00eb, sistemi gjyq\u00ebsor duhet ta garantoj\u00eb mbrojtjen e t\u00eb drejtave t\u00eb njeriut dhe t\u00eb mbetet funksional dhe efikas, n\u00eb ve\u00e7anti kur vendos p\u00ebr lirin\u00eb e njeriut si nj\u00eb e drejt\u00eb e pacenueshme.<\/li>\n<\/ul>\n<p>SISTEMI GJYQ\u00cbSOR<\/p>\n<p><strong>\u00cbsht\u00eb miratuar Dekreti p\u00ebr afatet n\u00eb proceset gjyq\u00ebsore n\u00eb koh\u00ebn e gjendjes s\u00eb jasht\u00ebzakonshme<\/strong><\/p>\n<p>M\u00eb 30.03.2020, Qeveria e miratoi Dekretin me fuqi ligjore p\u00ebr afatet n\u00eb proceset gjyq\u00ebsore gjat\u00eb koh\u00ebs s\u00eb gjendjes s\u00eb jasht\u00ebzakonshme p\u00ebr veprim t\u00eb gjykatave dhe Prokurorive publike.<\/p>\n<p>Sipas Dekretit, afatet ligjore dhe kohore p\u00ebr parashtrimin e aktakuzave n\u00eb procedur\u00eb kontestimore, aktakuzave private n\u00eb procedur\u00eb penale, propozimeve p\u00ebr ndjekje penale, propozimeve p\u00ebr ngritjen e procedur\u00ebs jasht\u00ebkontestimore, parashtrimin e k\u00ebrkes\u00ebs p\u00ebr p\u00ebrmbarim me forc\u00eb, procedur\u00ebn p\u00ebr sigurimin e k\u00ebrkesave, aktakuzave p\u00ebr ngritjen e kontestit administrativ, ngritjen e procedur\u00ebs para Gjykat\u00ebs kushtetuese ose ngritjen e ndonj\u00eb procedure tjet\u00ebr gjyq\u00ebsore, \u00a0ndalohen t\u00eb rrjedhin n\u00eb momentin e hyrjes n\u00eb fuqi t\u00eb k\u00ebtij Dekreti deri n\u00eb nd\u00ebrprerjen e gjendjes s\u00eb jasht\u00ebzakonshme.<\/p>\n<p>Afatet ligjore dhe kohore p\u00ebr deklarimin e masave juridike, mjeteve juridike ose p\u00ebr nd\u00ebrmarrjen e veprimeve procedurale n\u00eb procedur\u00eb pushojn\u00eb s\u00eb rrjedhuri gjat\u00eb koh\u00ebs s\u00eb gjendjes s\u00eb jasht\u00ebzakonshme.<\/p>\n<p>N\u00eb procedurat penale dhe kund\u00ebrvajt\u00ebse, afatet e paraqitjes s\u00eb ankes\u00ebs ose kund\u00ebrshtimit ndaj vendimit me t\u00eb cilin mbaron procedura, si dhe p\u00ebr deklarimin e masave t\u00eb jasht\u00ebzakonshme juridike, ndalojn\u00eb s\u00eb rrjedhuri gjat\u00eb koh\u00ebs s\u00eb gjendjes s\u00eb jasht\u00ebzakonshme.<\/p>\n<p>Me k\u00ebt\u00eb Dekret, l\u00ebshimi i akteve t\u00eb referenc\u00ebs p\u00ebr shqiptimin e mas\u00ebs s\u00eb d\u00ebnimit me burg deri tre vjet shtyhet deri m\u00eb 1 shtator 2020, p\u00ebrve\u00e7 rasteve ku ekziston rreziku i parashkrimit t\u00eb ekzekutimit t\u00eb d\u00ebnimit.<\/p>\n<p>Mandate i gjyqtar\u00ebve-an\u00ebtar\u00ebve t\u00eb juris\u00eb, q\u00eb skadon gjat\u00eb gjendjes s\u00eb jasht\u00ebzakonshme, n\u00eb baz\u00eb t\u00eb k\u00ebtij Dekreti, zgjatet deri n\u00eb p\u00ebrfundimin e procedurave n\u00eb l\u00ebnd\u00ebn gjyq\u00ebsore. Gjykatat n\u00eb Republik\u00ebn e Maqedonis\u00eb s\u00eb Veriut jan\u00eb t\u00eb detyruara t&#8217;i p\u00ebrmbahen Vendimit t\u00eb K\u00ebshillit Gjyq\u00ebsor t\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut, t\u00eb veprojn\u00eb n\u00eb Gjykatat e Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut n\u00eb kushte t\u00eb rrezikut t\u00eb shtuar nga virusi COVID-19, duke filluar nga 17.03.2020. M\u00eb 11.03.2020 OBSH-ja shpalli pandemi p\u00ebr shkak t\u00eb s\u00ebmundjes COVID-19.<\/p>\n<p><a href=\"#_ftnref2\" name=\"_ftn2\">[2]<\/a> \u00c7do nd\u00ebrmarrje, var\u00ebsisht nga numri i t\u00eb pun\u00ebsuarve, do t\u00eb mund t\u00eb merr nga 3 deri n\u00eb 30 mij\u00eb euro. Nd\u00ebrmarrjet mikro, deri n\u00eb 10 pun\u00ebtor\u00eb, do t\u00eb mund t\u00eb marrin kredi nga 3 deri n\u00eb 5 mij\u00eb euro, nd\u00ebrmarrjet e vogla me 10 deri 50 t\u00eb pun\u00ebsuar, do t\u00eb mund t\u00eb marrin kredi prej 10 deri n\u00eb 15 mij\u00eb euro dhe nd\u00ebrmarrjet e mesme me 50 deri n\u00eb 250 pun\u00ebtor\u00eb, do t\u00eb mund t\u00eb marrin kredi prej 15 deri n\u00eb 30 mij\u00eb euro. Kredit\u00eb jan\u00eb pa interes, me norm\u00eb interesi prej 0 p\u00ebrqind me grejs periudh\u00eb prej 6 muaj dhe afat kthimi prej 2 viteve.<\/p>\n<p><a href=\"#_ftnref3\" name=\"_ftn3\">[3]<\/a> Qeveria parashikoi mb\u00ebshtetje p\u00ebr nd\u00ebrmarrjet n\u00eb pjes\u00ebn e pagimit t\u00eb pagave me an\u00eb t\u00eb subvencionimit t\u00eb kontributeve p\u00ebr t\u00eb pun\u00ebsuarit n\u00eb nd\u00ebrmarrjet nga sektor\u00ebt turiz\u00ebm, transport, hoteleri dhe nd\u00ebrmarrje t\u00eb tjera t\u00eb prekura, p\u00ebr muajt prill, maj dhe qershor 2020, me subvencion t\u00eb kontributeve p\u00ebr pun\u00ebtor n\u00eb shkall\u00eb prej 50% t\u00eb rrog\u00ebs mesatare t\u00eb paguar n\u00eb vitin 2019, me kusht q\u00eb nd\u00ebrmarrja t\u00eb mos e zvog\u00ebloj\u00eb numrin e pun\u00ebtor\u00ebve n\u00ebn numrin e regjistruar n\u00eb muajin shkurt 2020 dhe kjo t\u00eb vlej\u00eb nga dita e shfryt\u00ebzimit t\u00eb mas\u00ebs; m\u00eb tej, nd\u00ebrmarrja t\u00eb mos paguaj\u00eb divident\u00eb gjat\u00eb vitit 2020, deri n\u00eb dit\u00ebn e parashtrimit t\u00eb llogaris\u00eb p\u00ebrfundimtare, respektivisht raporteve financiare p\u00ebr vitin 2020 dhe nd\u00ebrmarrja t\u00eb mos paguaj\u00eb shp\u00ebrblime-bonus pas hyrjes n\u00eb fuqi t\u00eb mas\u00ebs.
