Prandaj, nuk \u00ebsht\u00eb p\u00ebr t&#8217;u habitur q\u00eb Inspektorati Shtet\u00ebror i Pun\u00ebs (IShP) dhe nj\u00ebsit\u00eb e tij rajonale jan\u00eb mekanizmat institucional\u00eb p\u00ebr pun\u00ebn e t\u00eb cil\u00ebve, qytetar\u00ebt shprehin <strong>nivelin m\u00eb t\u00eb lart\u00eb t\u00eb pak\u00ebnaq\u00ebsis\u00eb.<\/strong><\/p>\n<p>Kjo \u00ebsht\u00eb n\u00eb ve\u00e7anti brengos\u00ebse sepse rastet m\u00eb t\u00eb shpeshta q\u00eb i shqyrton IShP-ja jan\u00eb t\u00eb lidhura me mospagimin e pagave dhe kontributeve, largimin (shkarkimin) nga puna, pun\u00ebn e palajm\u00ebruar jasht\u00eb orarit t\u00eb pun\u00ebs, manipulimin me obligimin p\u00ebr pages\u00ebn e regresit p\u00ebr pushim vjetor (K-15), sigurin\u00eb dhe sh\u00ebndetin n\u00eb pun\u00eb (SShP), t\u00eb gjitha k\u00ebto\u00a0<strong>t\u00eb lidhura ngusht\u00eb me statusin ekzistencial t\u00eb pun\u00ebtorit.\u00a0<\/strong><strong>Duke marr\u00eb<\/strong> <strong>parasysh se vitin e kaluar u miratua plot\u00ebsisht<\/strong>\u00a0<a href=\"https:\/\/mhc.org.mk\/wp-content\/uploads\/2019\/10\/10-zin-mk.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Ligj i ri p\u00ebr mbik\u00ebqyrje inspektuese<\/strong><\/a>, i cili filloi t\u00eb zbatohet para pothuajse tre muajve (<a href=\"https:\/\/mhc.org.mk\/wp-content\/uploads\/2019\/10\/10-zin-mk.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>neni 110<\/strong><\/a>), kjo \u00ebsht\u00eb nj\u00eb mund\u00ebsi e mir\u00eb q\u00eb t\u00eb analizohet puna e IShP-s\u00eb dhe t\u00eb rishikohen dob\u00ebsit\u00eb e tij m\u00eb t\u00eb m\u00ebdha.<\/p>\n<h2><strong>A \u00ebsht\u00eb p\u00ebrgjegj\u00ebs Inspektorati i pun\u00ebs p\u00ebr problemet n\u00eb veprimtarin\u00eb (pun\u00ebn) e tij?<\/strong><\/h2>\n<p>Inspektorati i pun\u00ebs \u00ebsht\u00eb i obliguar\u00a0<a href=\"https:\/\/mhc.org.mk\/wp-content\/uploads\/2019\/10\/9-zit-mk.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>p\u00ebr mbrojtjen par\u00ebsore institucionale t\u00eb drejtave nga marr\u00ebdh\u00ebniet e pun\u00ebs<\/strong><\/a>\u00a0dhe duhet t\u00eb garantoj\u00eb respektim dhe zbatim t\u00eb p\u00ebrpikt\u00eb t\u00eb rregullativ\u00ebs nga sfera e pun\u00ebs.<\/p>\n<p>IShP-ja \u00ebsht\u00eb organ n\u00eb cil\u00ebsin\u00eb e subjektit juridik n\u00eb kuad\u00ebr t\u00eb Ministris\u00eb p\u00ebr pun\u00eb dhe politik\u00eb sociale (MPPS) dhe puna e tij n\u00eb mas\u00eb t\u00eb madhe \u00ebsht\u00eb e definuar me\u00a0<a href=\"https:\/\/mhc.org.mk\/wp-content\/uploads\/2019\/10\/10-zin-mk.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Ligjin p\u00ebr mbik\u00ebqyrje inspektuese<\/strong><\/a>,\u00a0<a href=\"https:\/\/mhc.org.mk\/wp-content\/uploads\/2019\/10\/9-zit-mk.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Ligjin p\u00ebr inspektimin e pun\u00ebs<\/strong><\/a>\u00a0dhe\u00a0<a href=\"https:\/\/www.pravdiko.mk\/wp-content\/uploads\/2013\/11\/Zakon-za-prekrshotsite-17-05-2019.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Ligjin p\u00ebr kund\u00ebrvajtje<\/strong><\/a>. Megjithat\u00eb, IShP-ja vet\u00ebm formalisht \u00ebsht\u00eb organ n\u00eb kuad\u00ebr t\u00eb MPPS-s\u00eb, sepse Inspektorati disponon me llogari personale buxhetore si shfryt\u00ebzues buxhetor i linj\u00ebs s\u00eb par\u00eb, n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur b\u00ebn pun\u00ebsime, kurse drejtori em\u00ebrohet dhe shkarkohet nga Qeveria (<a href=\"https:\/\/mhc.org.mk\/wp-content\/uploads\/2019\/10\/10-zin-mk.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>neni 27[1]<\/strong><\/a>). Inspektor\u00ebt e pun\u00ebs mund t\u00eb inicojn\u00eb procese para gjykat\u00ebs kompetente dhe t\u00eb shqiptojn\u00eb ndalesa, gjoba dhe sanksione t\u00eb tjera, kurse mbi pun\u00ebn e tyre, kontroll efektiv kryen K\u00ebshilli i Inspektimit, i cili nj\u00ebashtu paraqet nj\u00eb organ t\u00eb pavarur (<a href=\"https:\/\/mhc.org.mk\/wp-content\/uploads\/2019\/10\/10-zin-mk.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>neni 16 [1]<\/strong><\/a>). Kjo do t\u00eb thot\u00eb se IShP-ja i ka parakushtet e nevojshme p\u00ebr pavar\u00ebsi dhe efikasitet, t\u00eb parashikuara n\u00eb direktivat e BE-s\u00eb dhe dokumentet nd\u00ebrkomb\u00ebtare,\u00a0<a href=\"https:\/\/www.ilo.org\/dyn\/normlex\/en\/f?p=NORMLEXPUB:11200:0::NO::P11200_COUNTRY_ID:103555\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>t\u00eb cilat i ka ratifikuar Maqedonia<\/strong><\/a>\u00a0dhe me k\u00ebt\u00eb hidhet posht\u00eb supozimi se problemet n\u00eb IShP jan\u00eb rezultat i konfigurimit t\u00eb sistemit.<\/p>\n<p><strong>P\u00ebrse at\u00ebher\u00eb, n\u00eb praktik\u00eb, inspektor\u00ebt nuk i shfryt\u00ebzojn\u00eb deri n\u00eb fund mund\u00ebsit\u00eb e dh\u00ebna dhe pse sistemi p\u00ebr denoncimin e shkeljeve t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve nuk \u00ebsht\u00eb p\u00ebrshtatur me nevojat e pun\u00ebtor\u00ebve?<\/strong><\/p>\n<p>N\u00ebse i pyesni\u00a0<a href=\"https:\/\/mhc.org.mk\/wp-content\/uploads\/2019\/03\/Standardi-Mk.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>p\u00ebrfaq\u00ebsuesit e IShP-s\u00eb<\/strong><\/a>, ata do t\u2019ju adresojn\u00eb mang\u00ebsit\u00eb kadrovike dhe materiale t\u00eb inspektorateve, nevoj\u00ebn p\u00ebr trajnim t\u00eb vazhduesh\u00ebm t\u00eb inspektor\u00ebve si dhe domosdoshm\u00ebrin\u00eb e rritjes s\u00eb pagave dhe pages\u00ebn e rrezikut p\u00ebr pun\u00eb n\u00eb terren. \u00cbsht\u00eb e pakontestueshme se ekziston mang\u00ebsi personeli n\u00eb sektor\u00eb t\u00eb caktuar (<a href=\"https:\/\/dit.gov.mk\/?page_id=838\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>si\u00e7 \u00ebsht\u00eb numri i vog\u00ebl prej 35 inspektor\u00eb<\/strong><\/a><strong>ve<\/strong><strong> p\u00ebr siguri dhe sh\u00ebndet n\u00eb pun\u00eb (SShP<\/strong>), si dhe mang\u00ebsi t\u00eb resurseve, si p\u00ebr shembull, p\u00ebr mjete transportuese ose t\u00eb pakt\u00ebn nj\u00eb informaticient dhe\/ose sh\u00ebrbim p\u00ebr mir\u00ebmbajtjen e kompjuter\u00ebve dhe sistemit.\u00a0<strong>Megjithat\u00eb, \u00ebsht\u00eb e pashmangshme t\u00eb mos parashtrohet pyetja se me \u00e7far\u00eb efikasiteti IShP-ja i shfryt\u00ebzon edhe ato resurse q\u00eb tashm\u00eb i ka n\u00eb dispozicion.<\/strong><\/p>\n<p>Sipas t\u00eb dh\u00ebnave, IShP-ja num\u00ebron <strong>103 inspektor\u00eb t\u00eb pun\u00ebsuar p\u00ebr sferat e marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs dhe SShP-s\u00eb, t\u00eb shp\u00ebrndar\u00eb n\u00eb 30 rajone<\/strong>. T\u00eb gjith\u00eb inspektor\u00ebt s\u00eb bashku, n\u00eb vitin 2017 kan\u00eb kryer zyrtarisht gjithsej <strong>31.690 mbik\u00ebqyrje inspektuese<\/strong>, respektivisht <strong>vet\u00ebm 1.2 mbik\u00ebqyrje inspektuese n\u00eb dit\u00eb, p\u00ebr nj\u00eb inspektor<\/strong>. Ky \u00ebsht\u00eb viti i fundit p\u00ebr t\u00eb cilin jan\u00eb n\u00eb dispozicion t\u00eb dh\u00ebnat n\u00eb faqen e internetit t\u00eb IShP-s\u00eb, por edhe kjo shif\u00ebr \u00ebsht\u00eb jorealisht e lart\u00eb. Shum\u00eb shpesh, menj\u00ebher\u00eb pas raportimit, inspektor\u00ebt i kontaktojn\u00eb pun\u00ebdh\u00ebn\u00ebsit dhe <strong>k\u00ebshtu i neutralizojn\u00eb shkeljet dhe parregullsit\u00eb e mundshme<\/strong> ose fare nuk i kryejn\u00eb mbik\u00ebqyrjet inspektuese. P\u00ebr m\u00eb tep\u00ebr, personat udh\u00ebheq\u00ebs t\u00eb IShP-s\u00eb jan\u00eb nd\u00ebr personat m\u00eb t\u00eb heshtur n\u00eb publik, k\u00ebshtu q\u00eb v\u00ebshtir\u00eb se mund t\u00eb gjendet ndonj\u00eb regjistrim mediatik ku ata k\u00ebrkojn\u00eb zgjidhje p\u00ebr problemet me t\u00eb cilat p\u00ebrballen dhe t\u00eb cilat i p\u00ebrs\u00ebrisin ato sa her\u00eb q\u00eb k\u00ebrkohet p\u00ebrgjegj\u00ebsi p\u00ebr mosveprimin e tyre. <strong>T\u00eb gjitha rastet, inspektor\u00ebt i menaxhojn\u00eb me dor\u00eb, n\u00eb form\u00eb t\u00eb shkruar dhe t\u00eb gjitha informacionet mblidhen dhe shp\u00ebrndahen manualisht<\/strong>, pa e marr\u00eb n\u00eb konsiderat\u00eb mund\u00ebsin\u00eb p\u00ebr nj\u00eb sistem softverik bashk\u00ebkohor p\u00ebr menaxhimin e rasteve, kurse disa nj\u00ebsi rajonale, madje nuk kan\u00eb as linja funksionale telefoni.<\/p>\n<p>E gjith\u00eb kjo tregon se <strong>sfidat kryesore t\u00eb IShP-s\u00eb nuk ajn\u00eb t\u00eb natyr\u00ebs organizative<\/strong>, sepse <strong>Inspektorati nuk i shfryt\u00ebzon n\u00eb m\u00ebnyr\u00eb efikase as edhe resurset q\u00eb tashm\u00eb i ka n\u00eb dispozicion<\/strong>, pavar\u00ebsisht se p\u00ebr <strong>\u00e7do vit ka nj\u00eb buxhet t\u00eb q\u00ebndruesh\u00ebm prej rreth 1,7 milion\u00eb euro<\/strong>.<\/p>\n<h2><strong>Vall\u00eb dhe sa \u00ebsht\u00eb efikase IShP-ja n\u00eb mbrojtjen e t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve?<\/strong><\/h2>\n<p>P\u00ebr 18 muajt e fundit, Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut <strong>e ka monitoruar pun\u00ebn e IShP-s\u00eb<\/strong> dhe veprimet e tij n\u00eb lidhje me shkeljet e t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve. Ekipi juridik i Komitetit t\u00eb Helsinkit e ka p\u00ebrdorur mjetin juridik p\u00ebr parashtrimin e k\u00ebrkesave p\u00ebr mbik\u00ebqyrje t\u00eb jasht\u00ebzakonshme inspektuese, atje ku \u00ebsht\u00eb e qart\u00eb se ekzistojn\u00eb shkelje t\u00eb cilat duhet t\u00eb m\u00ebnjanohen. Sidoqoft\u00eb, p\u00ebrkund\u00ebr pritjeve q\u00eb IShP-ja n\u00eb shumic\u00ebn e k\u00ebtyre rasteve t\u00eb k\u00ebrkonte m\u00ebnjanimin e shkeljeve, <strong>pothuajse kat\u00ebr nga pes\u00eb raste<\/strong> <strong>kan\u00eb pasur epilog negativ<\/strong>, respektivisht vet\u00ebm 22 p\u00ebrqind e t\u00eb gjitha rasteve t\u00eb raportuara kan\u00eb p\u00ebrfunduar me shkelje t\u00eb konstatuara t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve. Konkretisht, n\u00eb periudh\u00ebn nga gushti i vitit 2018 deri n\u00eb janar t\u00eb vitit 2020, jan\u00eb parashtruar <strong>gjithsej 100 k\u00ebrkesa p\u00ebr mbik\u00ebqyrje t\u00eb jasht\u00ebzakonshme inspektuese<\/strong>. P\u00ebr 41 prej tyre, asnj\u00ebher\u00eb nuk \u00ebsht\u00eb dor\u00ebzuar p\u00ebrgjigje, kurse p\u00ebr 37 raste IShP-ja \u00ebsht\u00eb p\u00ebrgjigjur se nuk ka konstatuar shkelje t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve. Pothuajse p\u00ebr t\u00eb gjitha 63 rastet q\u00eb ka pasur p\u00ebrgjigje, me p\u00ebrjashtim t\u00eb dy rasteve, IShP-ja ka dor\u00ebzuar vet\u00ebm njoftim, pa mund\u00ebsuar fare inspektimin e dokumentacionit t\u00eb plot\u00eb t\u00eb mbik\u00ebqyrjes s\u00eb kryer.<\/p>\n<p>N\u00eb k\u00ebt\u00eb drejtim, nuk mund t\u00eb v\u00ebrehet asnj\u00eb dallim i duksh\u00ebm nd\u00ebrmjet Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs dhe nj\u00ebsive t\u00eb tij rajonale n\u00eb t\u00eb gjith\u00eb vendin, pasi veprimet duket se ngjajn\u00eb me nj\u00ebra-tjetr\u00ebn pa marr\u00eb parasysh se n\u00eb cil\u00ebn nj\u00ebsi rajonale ato zbatohen. P\u00ebr ilustrim, n\u00eb periudh\u00ebn nga <strong>prilli deri n\u00eb qershor t\u00eb vitit 2019<\/strong>, p\u00ebr t\u00eb gjitha k\u00ebrkesat e parashtruara, p\u00ebrgjigjet jan\u00eb dor\u00ebzuar n\u00eb afat prej 30 deri n\u00eb 45 dit\u00eb ose m\u00eb shum\u00eb.<\/p>\n<p>Shkelja specifike p\u00ebr t\u00eb cil\u00ebn \u00ebsht\u00eb b\u00ebr\u00eb k\u00ebrkesa nuk luan asnj\u00eb rol p\u00ebr IShP-n\u00eb. Kjo edhe nj\u00eb her\u00eb afirmohet nga fakti se gjat\u00eb t\u00ebr\u00eb periudh\u00ebs 18-mujore, Komiteti i Helsinkit i ka theksuar <strong>t\u00eb nj\u00ebjtat rekomandime<\/strong> q\u00eb IShP-ja refuzon t\u2019i implementoj\u00eb apo edhe ta rishikoj\u00eb zbatueshm\u00ebrin\u00eb e tyre.<\/p>\n<h2><strong>Si t\u00eb veprohet?<\/strong><\/h2>\n<p>IShP-ja urgjentisht duhet ta <strong>shnd\u00ebrroj\u00eb rolin e tij<\/strong> nga nj\u00eb organ &#8220;i prapambetur&#8221; q\u00eb shpesh nuk arrin t\u00eb veproj\u00eb si\u00e7 duhet ose nuk vepron fare, n\u00eb nj\u00eb institucion q\u00eb kryesisht do t\u00eb ndikoj\u00eb n\u00eb m\u00ebnyr\u00eb parandaluese n\u00eb drejtim t\u00eb sigurimit t\u00eb mbrojtjes s\u00eb pun\u00ebtor\u00ebve. Inspektorati mund t\u00eb filloj\u00eb me p\u00ebrmir\u00ebsimin e kapaciteteve t\u00eb tij, ashtu q\u00eb, s\u00eb bashku me MPPS-n\u00eb dhe Qeverin\u00eb, t\u00eb p\u00ebrpilojn\u00eb nj\u00eb metodologji dhe standarde se si t\u00eb ndahen fonde shtes\u00eb buxhetore p\u00ebr mb\u00ebshtetje institucionale dhe p\u00ebr organizimin e trajnimeve t\u00eb rregullta t\u00eb personelit n\u00eb fjal\u00eb.<\/p>\n<p>Kjo do t\u00eb p\u00ebrfshinte kryesisht dixhitalizimin e pun\u00ebs s\u00eb IShP-s\u00eb dhe rritjen e transparenc\u00ebs p\u00ebrmes arkivimit t\u00eb detyruesh\u00ebm dhe publikimit t\u00eb informacioneve jokonfidenciale. Deri at\u00ebher\u00eb, IShP-ja <strong>ka detyrim ligjor q\u00eb t\u00eb veproj\u00eb <\/strong><strong>rr\u00ebnj\u00ebsisht<\/strong><strong> n\u00eb lidhje me shkeljet e denoncuara<\/strong>, kurse K\u00ebshilli i Inspektimit <strong>ta kontrolloj\u00eb pun\u00ebn e IShP-s\u00eb<\/strong>. Mekanizmat e vendosura p\u00ebr raportimin e shkeljeve t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve dhe t\u00ebr\u00eb sjellja e ISHP-s\u00eb, n\u00eb k\u00ebt\u00eb \u00e7ast jan\u00eb jofunksionale dhe figurojn\u00eb vet\u00ebm si nj\u00eb sistem mbrojtjeje zyrtarisht n\u00eb dispozicion, pa p\u00ebrfitime reale p\u00ebr pun\u00ebtor\u00ebt. Meqen\u00ebse korniza ligjore n\u00eb lidhje me inspektoratin e pun\u00ebs \u00ebsht\u00eb e mjaftueshme dhe adekuate, roli i v\u00ebrtet\u00eb i IShP-s\u00eb nuk k\u00ebrkon ndryshime ligjore, por <strong>ndryshime praktike q\u00eb do ta \u00e7lirojn\u00eb at\u00eb nga ndikimet e jashtme<\/strong> dhe do ta forcojn\u00eb at\u00eb si t\u00eb pavarur, <strong>madje edhe si t\u00eb papreksh\u00ebm p\u00ebr organet e pushtetit<\/strong>.
