V\u00ebshtir\u00ebsi shtes\u00eb p\u00ebr marrjen e veprimeve v\u00ebrehen te viktimat e dhun\u00ebs n\u00eb familje q\u00eb jan\u00eb prind\u00ebr t\u00eb f\u00ebmij\u00ebve t\u00eb mitur, t\u00eb cil\u00ebt shpesh jan\u00eb d\u00ebshmitar\u00eb t\u00eb dhun\u00ebs.<\/p>\n<p>Dy nga viktimat e kishin denoncuar dhun\u00ebn n\u00eb polici dhe n\u00eb qendr\u00ebn p\u00ebr pun\u00eb sociale, kurse dy nga viktimat jan\u00eb drejtuar deri te Komiteti i Helsinkit me q\u00ebllim t\u00eb marrjes s\u00eb informacioneve se n\u00eb \u00e7\u2019m\u00ebnyr\u00eb mund ta denoncojn\u00eb dhun\u00ebn dhe se cilat hapa duhet ti nd\u00ebrmarrin p\u00ebr mbrojtjen e tyre.<\/p>\n<p>Gjat\u00eb procedimit t\u00eb rasteve, Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut ka regjistruar l\u00ebshime n\u00eb pun\u00ebn e Qendr\u00ebs p\u00ebr pun\u00eb sociale. M\u00eb sakt\u00eb, nj\u00ebra nga viktimat gjat\u00eb koh\u00eb e ka duruar dhun\u00ebn e ushtruar nga partneri martesor, t\u00eb cilin edhe e ka denoncuar shum\u00eb her\u00eb. P\u00ebr shkak t\u00eb situat\u00ebs s\u00eb padurueshme ka qen\u00eb e detyruar ta l\u00ebshoj\u00eb sht\u00ebpin\u00eb, me \u00e7rast kat\u00ebr f\u00ebmij\u00ebt e saj t\u00eb mitur kan\u00eb mbetur te babai i tyre i cili \u00ebsht\u00eb edhe autori i dhun\u00ebs, nd\u00ebrsa q\u00eb at\u00ebher\u00eb po p\u00ebrpiqet t\u00eb gjej\u00eb m\u00ebnyr\u00eb p\u00ebr ti kontaktuar f\u00ebmij\u00ebt.<\/p>\n<p>Q\u00ebndra p\u00ebr pun\u00eb sociale me p\u00eblqimin e saj ka parashtruar propozim p\u00ebr shqiptimin e masave t\u00eb p\u00ebrkohshme p\u00ebr mbrojtje nga dhuna n\u00eb familje deri te gjykata kompetente, e cila me vendim i ka shqiptuar masat e p\u00ebrkohshme.<\/p>\n<p>Edhe pse ekipi profesional i Qendr\u00ebs p\u00ebr pun\u00eb sociale ka parashtruar propozim deri te gjykata kompetente, ky ekip ka b\u00ebr\u00eb edhe nj\u00eb varg l\u00ebshimesh gjat\u00eb procedimit, n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb nuk e ka njoftuar viktim\u00ebn mbi t\u00eb drejt\u00ebn e saj p\u00ebr tu akomoduar n\u00eb Sht\u00ebpin\u00eb e sigurt. Ky ekip nga Qendra p\u00ebr pun\u00eb sociale duke pasur parasysh faktin se jeta, sh\u00ebndeti dhe siguria e saj kishin qen\u00eb skajshm\u00ebrisht t\u00eb rrezikuara nuk ka kryer vler\u00ebsim p\u00ebrkat\u00ebs t\u00eb rrezikut.<\/p>\n<p>N\u00eb m\u00ebnyr\u00eb shtes\u00eb, n\u00eb p\u00ebrputhje me nenin 10 t\u00eb Ligjit p\u00ebr parandalimin, pengimin dhe mbrojtjen nga dhuna n\u00eb familje, f\u00ebmija \u00ebsht\u00eb viktim\u00eb kur p\u00ebrjeton dhun\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb, kur \u00ebsht\u00eb prezent gjat\u00eb marr\u00ebdh\u00ebnieve t\u00eb dhunshme nd\u00ebrmjet an\u00ebtar\u00ebve t\u00eb familjes s\u00eb tij ose kur jeton n\u00eb mjedis ku ekzistojn\u00eb marr\u00ebdh\u00ebnie t\u00eb dhunshme. N\u00eb k\u00ebto raste, Qendra p\u00ebr pun\u00eb sociale ka obligim t\u00eb kujdeset p\u00ebr interesat e f\u00ebmij\u00ebve dhe ti mbroj\u00eb nga dhuna n\u00eb familje, nd\u00ebrsa sipas vler\u00ebsimit t\u00eb rrezikut, t\u00eb kufizoj\u00eb ose ti ndaloj\u00eb marr\u00ebdh\u00ebniet personale dhe kontaktet e drejtp\u00ebrdrejta me autorin e dhun\u00ebs. N\u00eb rastin konkret, Qendra duke mos i respektuar k\u00ebto dispozita ligjore i ka shkelur t\u00eb drejtat p\u00ebr mbrojtjen e f\u00ebmij\u00ebve q\u00eb jan\u00eb t\u00eb l\u00ebn\u00eb n\u00eb rrezik nga viktimizimi dhe riviktimizimi nga ana e babait t\u00eb tyre me t\u00eb cilin p\u00ebr momentin jetojn\u00eb.<\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut p\u00ebr k\u00ebto l\u00ebshime ka parashtruar k\u00ebrkes\u00eb p\u00ebr mbikqyrje t\u00eb jasht\u00ebzakonshme inspektimi deri te Sektori p\u00ebr mbikqyrje inspektoriale n\u00eb mbrojtje sociale pran\u00eb Ministris\u00eb p\u00ebr pun\u00eb dhe politik\u00eb sociale.<\/p>\n<p><strong><u>Rekomandim<\/u><\/strong><strong><u>:<\/u><\/strong> F\u00ebmij\u00ebt shum\u00eb shpesh jan\u00eb viktima t\u00eb dhun\u00ebs s\u00eb kryer n\u00eb familje, me \u00e7rast i b\u00ebn\u00eb nj\u00ebsoj viktima t\u00eb dhun\u00ebs. Ngjarja ku kan\u00eb qen\u00eb d\u00ebshmitar\u00eb ose viktima ka pasoja afatgjata mbi rritjen dhe zhvillimin e tyre t\u00eb m\u00ebtutjesh\u00ebm dhe n\u00eb formimin e personaliteteve t\u00eb tyre. Institucionet kompetente, n\u00eb ve\u00e7anti policia dhe qendra p\u00ebr pun\u00eb sociale kan\u00eb p\u00ebr obligim q\u00eb t\u00eb veprojn\u00eb me kujdes t\u00eb ve\u00e7ant\u00eb n\u00eb rastet ku f\u00ebmij\u00ebt jan\u00eb viktima t\u00eb drejtp\u00ebrdrejta ose d\u00ebshmitar\u00eb t\u00eb dhun\u00ebs, me q\u00ebllim t\u00eb mbrojtjes s\u00eb tyre.<\/p>\n<p><strong>INSTITUCIONE T\u00cb MBYLLURA<\/strong><\/p>\n<p>KEQP\u00cbRDORIMI I MAS\u00cbS S\u00cb PARABURGIMIT N\u00cb PROCEDURAT PENALE<\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut n\u00eb kuad\u00ebr t\u00eb misionit dhe vizionit t\u00eb tij i monitoron gjendjet n\u00eb institucionet e mbyllura n\u00eb aspekt t\u00eb mbrojtjes s\u00eb t\u00eb drejtave t\u00eb njeriut p\u00ebr personat q\u00eb jan\u00eb t\u00eb privuar nga liria.<\/p>\n<p>Deri te Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut gjat\u00eb muajit gusht ka arritur nj\u00eb parashtres\u00eb p\u00ebr person q\u00eb vuan mas\u00ebn e paraburgimit p\u00ebr m\u00eb tep\u00ebr se tre muaj n\u00eb gjendje t\u00eb r\u00ebnd\u00eb sh\u00ebndet\u00ebsore n\u00eb EDK Burgu Shkup, pa kujdes dhe terapi p\u00ebrkat\u00ebse sh\u00ebndet\u00ebsore t\u00eb nevojshme p\u00ebr gjendjen e tij. N\u00eb parashtres\u00eb \u00ebsht\u00eb theksuar se personi ka kryer intervenim kirurgjik n\u00eb gju, me \u00e7rast \u00ebsht\u00eb p\u00ebrpiluar edhe raport dhe mendim ekpertize. N\u00eb k\u00ebt\u00eb ekspertiz\u00eb \u00ebsht\u00eb konfirmuar se n\u00eb institucionin ku e vuan mas\u00ebn e paraburgimit nuk ekzistojn\u00eb kushte p\u00ebr rihabilitimin e tij dhe p\u00ebr kujdesin p\u00ebrkat\u00ebs postoperativ. Por, nuk \u00ebsht\u00eb marr\u00eb asgj\u00eb parasysh me rastin e vendimit p\u00ebr vazhdimin e mas\u00ebs s\u00eb paraburgimit dhe p\u00ebr k\u00ebt\u00eb arsye n\u00eb pik\u00ebpyetje \u00ebsht\u00eb edhe kurimi i tij postoperativ. Si pasoj\u00eb e intervenimit kirurgjik, personi l\u00ebviz me ndihm\u00ebn e patericave, kurse p\u00ebr shkak t\u00eb kushteve t\u00eb pap\u00ebrshtatshme n\u00eb EDK Burgu Shkup gjat\u00eb kryerjes s\u00eb nevojave higjienike \u00ebsht\u00eb rr\u00ebzuar dhe ka marr\u00eb l\u00ebndime, pas s\u00eb cil\u00ebs \u00ebsht\u00eb d\u00ebrguar n\u00eb kontroll n\u00eb entin sh\u00ebndet\u00ebsor dhe p\u00ebrs\u00ebri \u00ebsht\u00eb kthyer n\u00eb EDK Burgu Shkup. Mbrojta deri te gjykata ka parashtruar propozim p\u00ebr heqjen e mas\u00ebs s\u00eb paraburgimit dhe z\u00ebvend\u00ebsim t\u00eb mas\u00ebs me paraburgim sht\u00ebpiak dhe garanci t\u00eb ofruar n\u00eb vler\u00eb prej 103.000 euro n\u00eb kundrvler\u00eb t\u00eb denarit, p\u00ebr t\u00eb cilin propozim p\u00ebr m\u00eb tep\u00ebr se 4 muaj ende nuk ka vendim p\u00ebrfundimtar. Si dokumente shoq\u00ebruese me parashtres\u00ebn jan\u00eb d\u00ebrguar edhe ankesat e parashtruara dhe aktvendimet p\u00ebr propozim vazhdimin e mas\u00ebs s\u00eb paraburgimit. Nga shqyrtimi i k\u00ebtij dokumentacioni, mund t\u00eb konstatohet se t\u00eb kat\u00ebr aktvendimet jan\u00eb formale dhe t\u00eb pabazuara n\u00eb d\u00ebshmi p\u00ebr aryetimet n\u00eb to, p\u00ebr m\u00eb tep\u00ebr secili aktvendim \u00ebsht\u00eb kopje e aktvendimit paraprak.<\/p>\n<p>Kjo praktik\u00eb \u00ebsht\u00eb evidentuar edhe me rastin e vizitave t\u00eb enteve t\u00eb d\u00ebnimit dhe korrektimit, ku p\u00ebrfaq\u00ebsuesit kan\u00eb regjistruar m\u00eb tep\u00ebr raste t\u00eb p\u00ebrdorimit t\u00eb mas\u00ebs s\u00eb paraburgimit n\u00eb kushte ku ekzistojn\u00eb rrethana p\u00ebr shqiptimin e masave t\u00eb tjera n\u00eb p\u00ebrputhje me Ligjin p\u00ebr procedur\u00eb penale. N\u00eb ve\u00e7anti nj\u00eb fenomen problematik q\u00eb \u00ebsht\u00eb v\u00ebrejtur \u00ebsht\u00eb most\u00ebrheqja e mas\u00ebs s\u00eb paraburgimit nga ana e gjykat\u00ebs, respektivisht z\u00ebvend\u00ebsimi i saj me masa t\u00eb tjera sigurie, n\u00eb kushte kur personi gjendet n\u00eb gjendje t\u00eb r\u00ebnd\u00eb sh\u00ebndet\u00ebsore. Gjat\u00eb vizit\u00ebs s\u00eb EDK Burgu Prilep, Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut ka regjistruar dy raste ku persona n\u00eb gjendje t\u00eb r\u00ebnd\u00eb sh\u00ebndet\u00ebsore edhe krahas deklaratave t\u00eb drejtoris\u00eb s\u00eb burgut se nuk ka kushte p\u00ebr mjekim adekuat t\u00eb tyre n\u00eb burg, gjykata kompetente nuk \u00ebsht\u00eb t\u00ebrhequr nga zbatimi i mas\u00ebs s\u00eb paraburgimit.<\/p>\n<p>Me mas\u00ebn e paraburgimit sigurohet prezenca e t\u00eb akuzuarit dhe drejtimi me sukses i procedur\u00ebs penale, por nj\u00ebherit masa e paraburgimit \u00ebsht\u00eb masa m\u00eb e r\u00ebnd\u00eb sepse me t\u00eb kufizohet e drejta e liris\u00eb s\u00eb njeriut. Masa e paraburgimit paraqet mas\u00eb t\u00eb paraqitjes me forc\u00eb e cila p\u00ebr shkak t\u00eb drejtimit t\u00eb papenguar t\u00eb procedur\u00ebs penale nd\u00ebrhyn n\u00eb t\u00eb drejt\u00ebn e liris\u00eb dhe siguris\u00eb s\u00eb individit. Koh\u00ebzgjatja e paraburgimit duhet t\u00eb vendoset p\u00ebr koh\u00eb sa m\u00eb t\u00eb shkurt\u00ebr t\u00eb mundshme, t\u00eb p\u00ebrdoret si mas\u00eb e kujdesit n\u00eb situata t\u00eb jasht\u00ebzakonshme dhe jo si mekaniz\u00ebm dhe d\u00ebnim represiv. N\u00eb k\u00ebt\u00eb drejtim, Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut e p\u00ebrs\u00ebrit rekomandimin dhe i th\u00ebrret Gjykatat q\u00eb gjat\u00eb shqiptimit t\u00eb mas\u00ebs s\u00eb paraburgimit seriozisht dhe me shum\u00eb kujdes ti marrin parasysh propozimet dhe rekomandimet e dh\u00ebna nga ana e Gjyk\u00ebt\u00ebs Evropiane p\u00ebr t\u00eb drejtat e njeriut.<\/p>\n<p><strong>GJUHA E URREJTJES<\/strong><\/p>\n<p>RASTI \u201eZHVATJA\u201c SI SHKAS P\u00cbR GJUH\u00cb T\u00cb URREJTJES N\u00cb MEDIAT SOCIALE<\/p>\n<p>Gjat\u00eb muajit gusht, n\u00eb portalin <u>www.govornaomraza.mk<\/u> u verifikuan 45 denoncime p\u00ebr gjuh\u00eb t\u00eb urrejtjes n\u00eb mediat sociale. Gjithashtu jan\u00eb evidentuar edhe thirrje p\u00ebr lin\u00e7im publik t\u00eb personave publik\u00eb. Trendi i gjuh\u00ebs s\u00eb urrejtjes mbi baza t\u00eb orientimit seksual dhe identitetit gjinor ka vazhduar edhe gjat\u00eb muajit gusht e q\u00eb lidhet me rastin \u201cZhvatja\u201d.<\/p>\n<p><strong>T\u00cb DREJTAT E PUN\u00cbTOR\u00cbVE<\/strong><strong>\u00a0<\/strong><\/p>\n<p>mbrojtja e pun\u00ebtor\u00ebve n\u00eb pun\u00eb n\u00eb kushtet e val\u00ebs s\u00eb nxeht\u00ebsis\u00eb<\/p>\n<p>Gjat\u00eb muajit gusht, Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut ka regjistruar 8 raste t\u00eb shkeljes s\u00eb t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve dhe qasjes n\u00eb pun\u00ebsim. T\u00eb nj\u00ebjt\u00ebn dit\u00eb, Komiteti i Helsinkit ka regjistruar nj\u00eb rast ku pun\u00ebtor\u00ebt kryenin pun\u00eb nd\u00ebrtimore n\u00eb periudh\u00ebn rreth or\u00ebs 13:00. Duke pasur parasysh k\u00ebt\u00eb, duhet q\u00eb Inspektorati shtet\u00ebror i pun\u00ebs ti rrit kontrollet e tyre n\u00eb terren gjat\u00eb periudh\u00ebs verore dhe t\u00eb q\u00ebndroj\u00eb n\u00eb an\u00ebn e pun\u00ebtor\u00ebve.<\/p>\n<p><strong>DISKRIMINIMI<\/strong><strong>\u00a0<\/strong><\/p>\n<p>fond diskriminues shp\u00ebrblyes n\u00eb garat e tenisit<\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut n\u00eb rrjetet sociale ka v\u00ebrejtur nj\u00eb shpallje p\u00ebr ngjarjen Gara e Hapur e Maqedonis\u00eb n\u00eb tenis \u2013 senior\u00eb dhe seniore e cila do t\u00eb mbahet nga data 28.08.2019 deri m\u00eb 01.09.2019 n\u00eb Veles. N\u00eb vet\u00eb shpalljen p\u00ebr k\u00ebt\u00eb ngjarje \u00ebsht\u00eb p\u00ebrmendur edhe fondi shp\u00ebrblyes i parashikuar p\u00ebr senior\u00ebt dhe senioret q\u00eb do t\u00eb merrnin nj\u00eb prej kat\u00ebr vendeve n\u00eb renditje. Fondi i parashikuar shp\u00ebrblyes p\u00ebr vendin e tret\u00eb p\u00ebr senior\u00eb ishte 6.000 denar\u00eb, kurse p\u00ebr seniore 3.000 denar\u00eb, p\u00ebr vendin e dyt\u00eb p\u00ebr senior\u00eb 12.000 denar\u00eb, kurse p\u00ebr seniore 6.000 denar\u00eb. P\u00ebr vendin e par\u00eb p\u00ebr senior\u00eb ishte 24.000 denar\u00eb, kurse p\u00ebr seniore 12.000 denar\u00eb. Sipas k\u00ebsaj, \u00ebsht\u00eb shum\u00eb evidente se fondi shp\u00ebrblyes p\u00ebr senior\u00eb ishte dyfish m\u00eb i madh se fondi i parashikuar p\u00ebr seniore p\u00ebr t\u00eb tre vendet e para n\u00eb renditje.<\/p>\n<p>Ky lloj fondi shp\u00ebrblyes \u00ebsht\u00eb diskriminues n\u00eb baz\u00eb t\u00eb seksit dhe gjinis\u00eb edhe at\u00eb p\u00ebr disa arsye. Diskriminimi i drejtp\u00ebrdrejt\u00eb n\u00eb baz\u00eb t\u00eb seksit ka t\u00eb b\u00ebj\u00eb pik\u00ebrisht me fondin dyfish m\u00eb t\u00eb madh t\u00eb parashikuar p\u00ebr meshkujt nga ai i p\u00ebrcaktuar p\u00ebr femrat, kurse diskriminimi n\u00eb baz\u00eb t\u00eb gjinis\u00eb ka t\u00eb b\u00ebj\u00eb me supozimin p\u00ebr sportin si sfer\u00eb ku pjes\u00ebmarrje m\u00eb t\u00eb madhe kan\u00eb meshkujt, respektivisht si aktivitet tipik i gjinis\u00eb mashkullore. Sipas Ligjit p\u00ebr parandalim dhe mbrojtje nga diskriminimi dhe Ligjit p\u00ebr mund\u00ebsi t\u00eb barabarta t\u00eb femrave dhe meshkujve, \u00ebsht\u00eb i ndaluar diskriminimi n\u00eb baz\u00eb t\u00eb seksit dhe gjinis\u00eb n\u00eb form\u00ebn e dallueshm\u00ebris\u00eb, p\u00ebrjashtimit, kufizimit ose dh\u00ebnies p\u00ebrpar\u00ebsi mb\u00ebshtetur n\u00eb baz\u00eb diskriminimi. Me fondin e parashikuar shp\u00ebrblyes, organizatori po kryen diskriminim t\u00eb drejtp\u00ebrdrejt\u00eb mbi k\u00ebto dy baza, n\u00eb t\u00ebr\u00ebsi duke mos i respektuar parimet p\u00ebr pjes\u00ebmarrje t\u00eb barabart\u00eb n\u00eb garat sportive t\u00eb meshkujve dhe femrave.<\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut ka reagur publikisht deri te organizatori i turneut dhe deri te Komuna e Velesit, e cila paraqitet si mb\u00ebshtet\u00ebs i turneut, q\u00eb ta t\u00ebrheqin dhe ta korrigjojn\u00eb fondin shp\u00ebrblyes p\u00ebr Gar\u00ebn e Hapur t\u00eb Maqedonis\u00eb n\u00eb tenis \u2013 senior\u00eb dhe seniore n\u00eb drejtim t\u00eb p\u00ebrcaktimit t\u00eb fondit t\u00eb barabart\u00eb shp\u00ebrblyes si p\u00ebr meshkujt ashtu edhe p\u00ebr femrat. Lidhur me k\u00ebt\u00eb reagim, organizatori d\u00ebrgoi p\u00ebrgjigje deri te Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut, duke informuar se i pranon v\u00ebrejtjet e shprehura dhe se fondi shp\u00ebrblyes do t\u00eb korrigjohet.
