Analiza ka p\u00ebr q\u00ebllim t\u00eb identifikoj\u00eb drejtimet kryesore t\u00eb zhvillimit t\u00eb rregullativ\u00ebs ligjore, e cila \u00ebsht\u00eb n\u00eb lidhje me mbrojtjen e pun\u00ebtorit, nivelin e harmonizimit t\u00eb rregullativ\u00ebs me standardet nd\u00ebrkomb\u00ebtare t\u00eb pranuara dhe reterimet n\u00eb praktik\u00eb, si nga ligjet pozitive ashtu edhe nga standardet nd\u00ebrkomb\u00ebtare. Problemet themelore gjat\u00eb zbatimit t\u00eb legjislacionit jan\u00eb paraqitur n\u00ebp\u00ebrmjet kryq\u00ebzimit t\u00eb korniz\u00ebs s\u00eb p\u00ebrgjithshme nd\u00ebrkomb\u00ebtare, n\u00eb t\u00eb cil\u00ebn trajtohen mbrojtja e t\u00eb drejtave t\u00eb pun\u00ebtorit dhe kushtet minimale p\u00ebr pun\u00eb, me zgjidhjet ligjore themelore n\u00eb nivel nacional.<\/p>\n<p>Nga ana tjet\u00ebr, problemet jan\u00eb ilustruar me p\u00ebrmbledhjen e perceptimeve t\u00eb pjes\u00ebmarr\u00ebsve t\u00eb drejtp\u00ebrdrejt\u00eb n\u00eb nd\u00ebrtimin e politikave p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb pun\u00ebtorit, respektivisht mbrojtjen e drejtp\u00ebrdrejt\u00eb t\u00eb tyre dhe n\u00eb t\u00eb nj\u00ebjt\u00ebn m\u00ebnyr\u00eb jan\u00eb adresuar ndryshimet t\u00eb cilat duhet t\u00eb b\u00ebhen. Analiza tregoi se ka probleme n\u00eb transponimin p\u00ebrkat\u00ebs t\u00eb standardeve dhe zgjidhjeve normative t\u00eb ONP, K\u00ebshillin e Evrop\u00ebs dhe BE direktivat, mir\u00ebpo, se problemi kryesor gjendet n\u00eb praktik\u00eb dhe n\u00eb mos plot\u00ebsimin e obligimeve nd\u00ebrkomb\u00ebtare dhe zgjidhjeve ligjore. V\u00ebmendje e ve\u00e7ant\u00eb n\u00eb analiz\u00eb i \u00ebsht\u00eb kushtuar korniz\u00ebs institucionale aktuale p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb pun\u00ebtorit dhe rolin t\u00eb cilin duhet ta ken\u00eb bart\u00ebsit e ndrysh\u00ebm t\u00eb kompetencave n\u00eb k\u00ebt\u00eb fush\u00eb. S\u00eb k\u00ebndejmi rezulton vendosja e theksit mbi sindikatat dhe aktivitetet e sindikatave, si aktor\u00eb kryesor n\u00eb procesin e formulimit t\u00eb zgjidhjeve normative m\u00eb p\u00ebrkat\u00ebse dhe n\u00eb pjes\u00ebn e shfryt\u00ebzimit t\u00eb mund\u00ebsive ligjore ekzistuese. Mbrojtja e t\u00eb drejtave t\u00eb pun\u00ebs kontribuon n\u00eb nj\u00eb produktivitet m\u00eb t\u00eb madh n\u00eb vendin e pun\u00ebs, i cili nga ana tjet\u00ebr \u00ebsht\u00eb nj\u00eb rezultat i d\u00ebshiruar nga pun\u00ebdh\u00ebn\u00ebsit.<\/p>\n<p>Duke e pasur parasysh k\u00ebt\u00eb, rekomandimet e dh\u00ebna i referohen p\u00ebrshtatjes p\u00ebrkat\u00ebse t\u00eb legjislacionit me nevojat reale t\u00eb pun\u00ebtor\u00ebve dhe pun\u00ebdh\u00ebn\u00ebsve, me an\u00eb t\u00eb plot\u00ebsimit t\u00eb zbraz\u00ebtirave n\u00eb mbrojtjen materiale, si dhe n\u00ebp\u00ebrmjet thjesht\u00ebsimit dhe sakt\u00ebsimit t\u00eb procedurave.
