Kjo do t\u00eb thot\u00eb q\u00eb t\u00eb gjith\u00eb personat t\u00eb cil\u00ebt ishin t\u00eb pun\u00ebsuar q\u00eb nga 1 korriku ose m\u00eb par\u00eb, duhet t\u00eb paguhen t\u00eb pakt\u00ebn 11.159 denar\u00eb n\u00eb em\u00ebr t\u00eb regresit p\u00ebr pushiim vjetor (K-15) p\u00ebr vitin 2020.<\/em><\/p>\n<p>Pun\u00ebdh\u00ebn\u00ebsit q\u00eb kan\u00eb v\u00ebshtir\u00ebsi n\u00eb pun\u00eb, duke vler\u00ebsuar gjendjen ekonomiko-financiare t\u00eb pun\u00ebdh\u00ebn\u00ebsit, mund t\u00eb paguajn\u00eb nj\u00eb <a href=\"https:\/\/mhc.org.mk\/wp-content\/uploads\/2019\/12\/pravno-mislenje-za-pravoto-na-regres-za-godishen-odmor.pdf\">shum\u00eb n\u00ebn minimumin e garantuar<\/a> prej 40%, n\u00eb p\u00ebrputhje me Marr\u00ebveshjen p\u00ebr ndryshimin e Marr\u00ebveshjes Kolektive p\u00ebr sektorin privat nga fusha e ekonomis\u00eb. Sidoqoft\u00eb, paqart\u00ebsia ligjore n\u00eb munges\u00eb t\u00eb kritereve t\u00eb qarta p\u00ebr p\u00ebrcaktimin e v\u00ebshtir\u00ebsive objektive n\u00eb pun\u00eb dhe vler\u00ebsimin e duhur t\u00eb madh\u00ebsis\u00eb s\u00eb problemeve, shkakton nj\u00eb pasiguri ligjore te pun\u00ebtor\u00ebt. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, ajo ndalon Inspektoratin Shtet\u00ebror t\u00eb Pun\u00ebs t\u00eb identifikoj\u00eb shkeljet e t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve nga marr\u00ebveshja kolektive, p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb kritereve dhe procedurave t\u00eb sakta p\u00ebr p\u00ebrcaktimin e v\u00ebshtir\u00ebsive n\u00eb pun\u00ebn e pun\u00ebdh\u00ebn\u00ebsit.<\/p>\n<p>Nj\u00eb situat\u00eb e till\u00eb lejon q\u00eb pun\u00ebdh\u00ebn\u00ebsi t\u00eb paraqes\u00eb thjesht nj\u00eb fatur\u00eb p\u00ebrfundimtare q\u00eb tregon nj\u00eb fitim m\u00eb t\u00eb ul\u00ebt n\u00eb vitin kalendarik, krahasuar me at\u00eb t\u00eb m\u00ebparsh\u00ebm, p\u00ebr t\u00eb provuar se ai ka pasur v\u00ebshtir\u00ebsi n\u00eb pun\u00eb dhe t\u00eb paguaj\u00eb m\u00eb shum\u00eb m\u00eb t\u00eb vog\u00ebl regresi p\u00ebr pushim vjetor sesa minimumi i parashikuar prej 40% t\u00eb shum\u00ebs baz\u00eb. N\u00eb kushte t\u00eb tilla, pun\u00ebdh\u00ebn\u00ebsit kishin <em>der\u00ebn e hapur<\/em> p\u00ebr t\u00eb abuzuar me kriz\u00ebn e shkaktuar nga pandemia e virusit korona. K\u00ebshtu, prirja e mospagimit ose pagimit t\u00eb regresit p\u00ebr pushim vjetor (K-15) n\u00eb nj\u00eb shum\u00eb m\u00eb t\u00eb vog\u00ebl dhe t\u00eb par\u00ebnd\u00ebsishme vazhdoi edhe k\u00ebt\u00eb vit. Pun\u00ebdh\u00ebn\u00ebsit thirren n\u00eb uljen e volumit t\u00eb pun\u00ebs p\u00ebr shkak t\u00eb kriz\u00ebs, si nj\u00eb arsyetim p\u00ebr t\u00eb paguar m\u00eb pak se minimumi i parashikuar i K-15. N\u00eb disa prej rasteve q\u00eb kemi regjistruar, pun\u00ebtor\u00ebt jan\u00eb paguar p\u00ebr K-15 n\u00eb vler\u00eb prej vet\u00ebm 500 denar\u00eb. K\u00ebto dhe shkelje t\u00eb ngjashme, t\u00eb tilla si mospagimi i regresit, jan\u00eb raportuar n\u00eb Inspektoratin Shtet\u00ebror t\u00eb Pun\u00ebs, por prej atje ende jemi duke pritur p\u00ebr nj\u00eb p\u00ebrgjigje.<\/p>\n<p><strong><em>E diela<\/em><\/strong><strong><em>, <\/em><\/strong><strong><em>dit\u00eb p\u00ebr pushim javor<\/em><\/strong><\/p>\n<p>Organizata Nd\u00ebrkomb\u00ebtare e Pun\u00ebs (ONP) e p\u00ebrkufizon konceptin e \u201epun\u00ebs s\u00eb dinjitetshme \u201c dhe n\u00ebnkupton prmovimin e mund\u00ebsive p\u00ebr grat\u00eb dhe burrat q\u00eb t\u00eb punojn\u00eb nj\u00eb pun\u00eb produktive dhe me dinjitet, n\u00eb kushte t\u00eb lira, n\u00eb p\u00ebrputhje me parimet e drejt\u00ebsis\u00eb, siguris\u00eb dhe respektimit t\u00eb dinjitetit t\u00eb njeriut. Ky vizion \u00ebsht\u00eb nj\u00eb udh\u00ebzues p\u00ebr t\u00eb gjitha p\u00ebrpjekjet e ONP-s\u00eb p\u00ebr t\u00eb arritur kat\u00ebr q\u00ebllime strategjike:<\/p>\n<ul>\n<li>avancimin e parimeve themelore dhe t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve;<\/li>\n<li>avancimin e pun\u00ebsimit;<\/li>\n<li>fuqizimin e mbrojtjes sociale dhe<\/li>\n<li>zgjerimin e dialogut social.<\/li>\n<\/ul>\n<p>Pjes\u00eb e konceptit t\u00eb pun\u00ebs dinjitoze \u00ebsht\u00eb pushimi javor p\u00ebr t\u00eb gjith\u00eb pun\u00ebtor\u00ebt. K\u00ebt\u00eb aspekt t\u00eb pun\u00ebs, ONP-ja m\u00eb sakt\u00eb e rregullon me Konvent\u00ebn num\u00ebr 14 p\u00ebr pushimin javor (n\u00eb industri)<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a> e vitit 1921 dhe Konvent\u00ebn num\u00ebr 106 p\u00ebr pushimin javor (n\u00eb tregti dhe pun\u00ebn n\u00eb zyr\u00eb) e vitit 1957.<a href=\"#_ftn2\" name=\"_ftnref2\"><sup>[2]<\/sup><\/a> K\u00ebto konventa p\u00ebrcaktojn\u00eb q\u00eb \u00e7do pun\u00ebtor ka t\u00eb drejt\u00eb p\u00ebr 24 or\u00eb pushim javor t\u00eb pand\u00ebrprer\u00eb. ONP-ja p\u00ebrcakton q\u00eb kudo q\u00eb t\u00eb jet\u00eb e mundur, dita e pushimit javor duhet t\u00eb p\u00ebrcaktohet n\u00eb p\u00ebrputhje me zakonet dhe traditat e vendit. N\u00eb vendet an\u00ebtare t\u00eb Bashkimit Evropian (BE), Direktiva 88\/2003<a href=\"#_ftn3\" name=\"_ftnref3\"><sup>[3]<\/sup><\/a> mbi orarin e pun\u00ebs i garanton pun\u00ebtorit t\u00eb drejt\u00ebn e pushimit 24-or\u00ebsh p\u00ebr \u00e7do jav\u00eb, zakonisht t\u00eb diel\u00ebn, si dhe 11 or\u00eb pushim shtes\u00eb p\u00ebr \u00e7do dit\u00eb pune, nd\u00ebrmjet turneve t\u00eb pun\u00ebs. Megjith\u00ebse legjislacioni komb\u00ebtar parashikon vet\u00ebm nj\u00eb dit\u00eb pushim n\u00eb jav\u00eb, marr\u00ebveshjet kolektive dhe e drejta zakonore n\u00eb vendet an\u00ebtare t\u00eb BE-s\u00eb p\u00ebrcaktojn\u00eb <a href=\"https:\/\/www.ilo.org\/wcmsp5\/groups\/public\/---ed_protect\/---protrav\/---travail\/documents\/publication\/wcms_170725.pdf\">standardet p\u00ebr nj\u00eb jav\u00eb pune 5-ditore<\/a>.<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> Organizata Nd\u00ebrkomb\u00ebtare e Pun\u00ebs. Zgjedhja e an\u00ebtar\u00ebve u realizua n\u00eb p\u00ebrputhje me Ligjin e ri p\u00ebr parandalim dhe mbrojtje nga diskriminimi, i cili duhej t\u00eb miratohej dy her\u00eb pasi ligji fillestar ishte shfuqizuar nga ana e Gjykat\u00ebs Kushtetuese, sepse n\u00eb vitin 2019 nuk ishte miratuar me shumic\u00ebn e k\u00ebrkuar. N\u00eb nd\u00ebrkoh\u00eb, ky institucion nuk ka qen\u00eb funksional q\u00eb nga mesi i vitit 2019, kur kishte skaduar mandati i komisionit t\u00eb m\u00ebparsh\u00ebm. Ligji i ri forcon kapacitetin e Komisionit p\u00ebr Parandalim dhe Mbrojtje nga Diskriminimi dhe ka zgjeruar kompetencat e tij n\u00eb drejtim t\u00eb parandalimit t\u00eb diskriminimit n\u00eb shoq\u00ebrin\u00eb ton\u00eb.<\/p>\n<p><strong>Avokati i Popullit konstatoi nj\u00eb lloj m\u00eb t\u00eb r\u00ebnd\u00eb t\u00eb diskriminimit t\u00eb zgjatur nga Ministria e Pun\u00ebve t\u00eb Brendshme kund\u00ebr nj\u00eb n\u00ebpun\u00ebse policie p\u00ebr shkak t\u00eb seksit dhe gjinis\u00eb<\/strong><\/p>\n<p>N\u00eb muajin shtator t\u00eb vitit 2020, Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut parashtroi nj\u00eb ankes\u00eb tek Avokati i Popullit p\u00ebr diskriminim n\u00eb baz\u00eb t\u00eb seksit dhe gjinis\u00eb kund\u00ebr nj\u00eb n\u00ebpun\u00ebse policie e pun\u00ebsuar n\u00eb Nj\u00ebsin\u00eb p\u00ebr detyra t\u00eb posa\u00e7me t\u00eb Ministris\u00eb s\u00eb Pun\u00ebve t\u00eb Brendshme. N\u00eb fakt, n\u00ebpun\u00ebsja e policis\u00eb, e pun\u00ebsuar n\u00eb Ministri n\u00eb vitin 2013 po p\u00ebrballet me diskriminim n\u00eb vendin e pun\u00ebs p\u00ebr shkak t\u00eb pamund\u00ebsis\u00eb p\u00ebr t&#8217;u avancuar n\u00eb karrier\u00ebn e saj ose p\u00ebr t&#8217;u trajnuar profesionalisht n\u00eb pun\u00eb.<\/p>\n<p>Gjat\u00eb pushimit t\u00eb lehonis\u00eb, n\u00ebpun\u00ebsja e policis\u00eb ishte caktuar verbalisht p\u00ebr t\u00eb punuar pun\u00eb n\u00eb zyr\u00eb. Pas p\u00ebrfundimit t\u00eb pushimit t\u00eb lehonis\u00eb, ajo ishte l\u00ebn\u00eb q\u00ebllimisht t\u00eb vazhdoj\u00eb t\u00eb punoj\u00eb pun\u00ebn n\u00eb zyr\u00eb si nj\u00eb n\u00ebpun\u00ebse administrative, pa marr\u00eb parasysh k\u00ebrkes\u00ebn e saj p\u00ebr t&#8217;u kthyer n\u00eb Nj\u00ebsin\u00eb p\u00ebr detyra t\u00eb posa\u00e7me, p\u00ebr t\u00eb vazhduar nd\u00ebrtimin e karrier\u00ebs s\u00eb saj dhe p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb st\u00ebrvitjet dhe trajnimet e planifikuara. Arsyetimi i Ministris\u00eb s\u00eb pun\u00ebve t\u00eb brendshme Brendshme \u00ebsht\u00eb se \u00ebsht\u00eb vepruar k\u00ebshtu p\u00ebr ta mbrojtjur at\u00eb si nj\u00eb grua dhe n\u00ebn\u00eb.<\/p>\n<p>M\u00eb tej, Ministria n\u00eb p\u00ebrgjigjen e saj e kishte informuar Avokatin e Popullit q\u00eb n\u00ebpun\u00ebsja e policis\u00eb, nga 18 qershor 2016 deri m\u00eb 13 prill 2017 dhe nga 12 n\u00ebntor 2018 e deri m\u00eb 8 gusht 2019 kishte shfryt\u00ebzuar pushimin e lehonis\u00eb p\u00ebr shkak t\u00eb shtatz\u00ebnis\u00eb, lindjes s\u00eb f\u00ebmij\u00ebs dhe prind\u00ebris\u00eb dhe n\u00eb at\u00eb periudh\u00eb ajo nuk ka mundur t\u00eb avancohej. Nd\u00ebr t\u00eb tjera, n\u00eb periudh\u00ebn nga 16 mars 2020 deri m\u00eb 26 mars 2020 dhe nga 4 gusht 2020 e deri n\u00eb mesin e muajit shtator, ajo ka shfryt\u00ebzuar masat e parashikuara me vendim qeverie p\u00ebr mbrojtjen dhe parandalimin e Kovid-19 si nj\u00eb n\u00ebn\u00eb e f\u00ebmij\u00ebve deri n\u00eb mosh\u00ebn 10 vje\u00e7. Me fjal\u00eb t\u00eb tjera, gjat\u00eb gjith\u00eb p\u00ebrvoj\u00ebs s\u00eb saj t\u00eb pun\u00ebs n\u00eb Ministri ajo nuk ishte n\u00eb gjendje t\u00eb zhvillonte dhe p\u00ebrmir\u00ebsonte plot\u00ebsisht cil\u00ebsit\u00eb e saj profesionale dhe aft\u00ebsit\u00eb e pun\u00ebs.<\/p>\n<p>P\u00ebr shkak t\u00eb k\u00ebtyre rrethanave, n\u00ebpun\u00ebsja i kishte dor\u00ebzuar komandantit dy k\u00ebrkesa p\u00ebr mbrojtje nga ngacmimet n\u00eb pun\u00eb, nj\u00ebra m\u00eb 26 gusht 2020 dhe tjetra m\u00eb 10 shtator 2020. Asnj\u00eb nga k\u00ebrkesat e punonj\u00ebses nuk ishte p\u00ebrgjigjur, kurse shpjegimi i Ministris\u00eb ishte se duke marr\u00eb parasysh q\u00eb punonj\u00ebses nuk iu p\u00ebrgjigj\u00ebn brenda afatit ligjor prej tet\u00eb dit\u00ebsh, ajo po t\u00eb d\u00ebshironte, mund t\u00eb kishte filluar nj\u00eb procedur\u00eb gjyq\u00ebsore p\u00ebr mbrojtje nga ngacmimet n\u00eb vendin e pun\u00ebs.<\/p>\n<p>N\u00eb nd\u00ebrkoh\u00eb, n\u00eb muajin shtator t\u00eb vitit 2020, n\u00ebpun\u00ebsja e policis\u00eb kishte marr\u00eb nj\u00eb vendim t\u00eb ri me t\u00eb cilin ajo ishte vendosur n\u00eb nj\u00eb pozit\u00eb edhe m\u00eb t\u00eb ul\u00ebt t\u00eb vendit t\u00eb pun\u00ebs &#8211; police n\u00eb Nj\u00ebsin\u00eb p\u00ebr mbrojtjen e objekteve me r\u00ebnd\u00ebsi t\u00eb ve\u00e7ant\u00eb. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb ajo ishte degraduar p\u00ebrs\u00ebri n\u00eb grad\u00eb sepse iu mor shtesa e pag\u00ebs. Ministria nuk ka dh\u00ebn\u00eb asnj\u00eb shpjegim pse ata e kishin vendosur p\u00ebrs\u00ebri n\u00ebpun\u00ebsen n\u00eb nj\u00eb vend t\u00eb ri pune, respektivisht ata deklarojn\u00eb se kjo ishte e nevojshme p\u00ebr Ministrin\u00eb. Prandaj, pretendimet se ajo ishte degraduar dhe diskriminuar nga em\u00ebrimi n\u00eb vendin e ri t\u00eb pun\u00ebs konsiderohen t\u00eb pabazuara, sepse \u00ebsht\u00eb b\u00ebr\u00eb fjal\u00eb p\u00ebr nj\u00eb akt individual, p\u00ebr t\u00eb cilin n\u00ebpun\u00ebsja aktualisht po zhvillonte nj\u00eb proces gjyq\u00ebsor.<\/p>\n<p>Konstatimi i Avokatit t\u00eb Popullit \u00ebsht\u00eb q\u00eb vet\u00eb Ministria konfirmon q\u00eb grat\u00eb gjat\u00eb pushimit t\u00eb lehonis\u00eb nuk mund t\u00eb promovohen\/avancohen n\u00eb karrier\u00eb sepse nuk kan\u00eb marr\u00eb pjes\u00eb n\u00eb trajnime dhe ushtrime t\u00eb detyrueshme p\u00ebr n\u00ebpun\u00ebsit e policis\u00eb. Kjo zgjidhje sistemike pretendon se grat\u00eb po p\u00ebrballen me pushimin e sh\u00ebrbimit t\u00eb tyre n\u00eb Ministri n\u00ebse vendosin t\u00eb b\u00ebhen n\u00ebna dhe t\u00eb mbeten shtatz\u00ebn\u00eb, gj\u00eb q\u00eb e b\u00ebn pozicionin e tyre shum\u00eb m\u00eb t\u00eb v\u00ebshtir\u00eb krahasuar me pozicionin e burrave.<\/p>\n<p>Si rrjedhoj\u00eb, Avokati i Popullit beson se Ministria nuk merr parasysh aspak se me riem\u00ebrimin\/rivendosjen e saj n\u00eb vendin e ri t\u00eb pun\u00ebs, ata jan\u00eb duke e degraduar dhe diskriminuar n\u00ebpun\u00ebsen. N\u00eb vend q\u00eb ta korrigjojn\u00eb l\u00ebshimin, ata e kan\u00eb riem\u00ebruar n\u00ebpun\u00ebsen n\u00eb nj\u00eb vend pune q\u00eb mund t\u00eb korrespondoj\u00eb me nivelin dhe kategorin\u00eb e nivelit t\u00eb saj t\u00eb njohurive, por q\u00eb nuk nd\u00ebrlidhet me detyrat e m\u00ebparshme t\u00eb n\u00ebpun\u00ebses, gj\u00eb q\u00eb \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me Ligjin p\u00ebr pun\u00ebt e brendshme, ku parashikohet q\u00eb riem\u00ebrimi\/rivendosja n\u00eb vend t\u00eb ri pune duhet t\u00eb jet\u00eb n\u00eb t\u00eb nj\u00ebjtin nivel dhe kategori, por t\u00eb \u00e7\u00ebshtjeve q\u00eb lidhen me to.<\/p>\n<p>Avokati i Popullit konstaton se n\u00eb rastin konkret pun\u00ebdh\u00ebn\u00ebsi nuk ka aft\u00ebsin\u00eb dhe kapacitetin p\u00ebr t\u00eb par\u00eb se n\u00eb \u00e7far\u00eb situate ai po i sjell grat\u00eb si n\u00ebna, duke i vendosur ato n\u00eb nj\u00eb nivel m\u00eb t\u00eb ul\u00ebt se burrat, respektivisht i pamund\u00ebson ato t\u00eb p\u00ebrparojn\u00eb n\u00eb karrier\u00ebn e tyre, ashtu sikur burrat. Avokati i Popullit konstaton se pun\u00ebdh\u00ebn\u00ebsi n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb ka kryer nj\u00eb form\u00eb m\u00eb serioze t\u00eb diskriminimit t\u00eb zgjatur bazuar n\u00eb seksin dhe gjinin\u00eb e n\u00ebpun\u00ebses, i cili vazhdon edhe sot, megjith\u00eb rekomandimet e tij drejtuar Ministris\u00eb s\u00eb Pun\u00ebve t\u00eb Brendshme n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb eliminohen t\u00eb gjitha parregullsit\u00eb dhe mang\u00ebsit\u00eb.<\/p>\n<p>Komiteti i Helsinkit mir\u00ebpret vendimin e Avokatit t\u00eb Popullit dhe i b\u00ebn thirrje Ministris\u00eb s\u00eb Pun\u00ebve t\u00eb Brendshme t\u00eb veproj\u00eb n\u00eb afat sa m\u00eb t\u00eb shkurt\u00ebr kohor n\u00eb lidhje me rekomandimet e dh\u00ebna nga ana e Avokatit t\u00eb Popullit dhe t&#8217;i jap\u00eb fund praktik\u00ebs shum\u00ebvje\u00e7are t\u00eb trajtimit diskriminues t\u00eb n\u00ebpun\u00ebseve t\u00eb policis\u00eb t\u00eb pun\u00ebsuara n\u00eb Ministrin\u00eb e Pun\u00ebve t\u00eb Brendshme.<\/p>\n<p><strong>INSTITUCIONET E MBYLLURA<\/strong><\/p>\n<p><strong>Tortur\u00eb dhe veprim \u00e7njer\u00ebzor n\u00eb INK Burgu Manastir <\/strong><\/p>\n<p>Nj\u00eb person i d\u00ebnuar q\u00eb vuan nj\u00eb d\u00ebnim me burg n\u00eb INK Burgu Manastir iu drejtua Komitetit t\u00eb Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut p\u00ebr shkak t\u00eb vuajtjes nga torturat dhe trajtimi \u00e7njer\u00ebzor nga ana e nj\u00eb komandanti, i pun\u00ebsuar n\u00eb institucionin nd\u00ebshkimor-korrektues. N\u00eb fakt, personi ka deklaruar se pasi ka k\u00ebrkuar terapin\u00eb e tij mjek\u00ebsore, komandanti, pa ndonj\u00eb arsye paraprake, kishte filluar ta rrahte, n\u00eb nj\u00eb m\u00ebnyr\u00eb q\u00eb me disa goditje me duar n\u00eb trup t\u00eb shkaktonte d\u00ebmtime t\u00eb dukshme trupore n\u00eb zon\u00ebn e fytyr\u00ebs dhe brinj\u00ebt. Incidenti ishte d\u00ebshmuar nga disa t\u00eb d\u00ebnuar t\u00eb tjer\u00eb n\u00eb burg t\u00eb cil\u00ebt thirr\u00ebn nj\u00eb ndihm\u00eb t\u00eb shpejt\u00eb mjek\u00ebsore dhe b\u00ebn\u00eb foto t\u00eb plag\u00ebve dhe d\u00ebmtimeve t\u00eb t\u00eb d\u00ebnuarit. Mjek\u00ebt i kishin injektuar personit t\u00eb d\u00ebnuar nj\u00eb injeksion p\u00ebr shkak t\u00eb dhimbjeve t\u00eb shkaktuara nga sulmi fizik.<\/p>\n<p>Pas ngjarjes, me k\u00ebrkes\u00eb t\u00eb nj\u00eb an\u00ebtari t\u00eb policis\u00eb s\u00eb burgut, kishte filluar nj\u00eb procedur\u00eb p\u00ebr sanksionim disiplinor t\u00eb personit t\u00eb d\u00ebnuar i cili ishte sulmuar fizikisht nga ana e komandantit. Nj\u00eb vendim i l\u00ebshuar nga Drejtoria e institucionit nd\u00ebshkimor-korrektues do t\u00eb shqiptoj\u00eb nj\u00eb d\u00ebnim disiplinor p\u00ebr personin e d\u00ebnuar &#8211; izolim n\u00eb vetmi p\u00ebr nj\u00eb periudh\u00eb prej 5 dit\u00ebsh p\u00ebr shkak t\u00eb refuzimit t\u00eb pretenduar p\u00ebr t\u00eb marr\u00eb terapin\u00eb mjek\u00ebsore dhe thirrjes s\u00eb papranueshme t\u00eb ndihm\u00ebs s\u00eb shpejt\u00eb mjek\u00ebsore nga t\u00eb d\u00ebnuarit e tjer\u00eb, pasi ai kishte p\u00ebsuar nj\u00eb l\u00ebndim t\u00eb leht\u00eb n\u00eb institucion. Si rezultat i d\u00ebmtimit t\u00eb supozuar t\u00eb leht\u00eb n\u00eb institucion, administrata e burgut kishte miratuar edhe nj\u00eb Vendim p\u00ebr kthimin mbrapa t\u00eb tij nga grupi A i pavijonit t\u00eb hapur n\u00eb grupin B t\u00eb pavijonit gjysm\u00eb t\u00eb hapur.<\/p>\n<p>P\u00ebr t\u00eb verifikuar k\u00ebto pretendime dhe p\u00ebr t\u00eb hetuar plot\u00ebsisht k\u00ebt\u00eb ngjarje, Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut s\u00eb bashku me Shoqat\u00ebn Maqedonase t\u00eb Avokat\u00ebve t\u00eb Rinj, n\u00eb Drejtorin\u00eb p\u00ebr Ekzekutimin e Sanksioneve kishin parashtruar nj\u00eb k\u00ebrkes\u00eb p\u00ebr kryerjen e nj\u00eb inspektimi t\u00eb jasht\u00ebzakonsh\u00ebm. Drejtoris\u00eb iu k\u00ebrkua t\u00eb merrte t\u00eb gjitha masat dhe veprimet e nevojshme si sigurimi i video regjistrimeve nga burgu, certifikata mjek\u00ebsore e l\u00ebshuar nga Ndihma e shpejt\u00eb mjek\u00ebsore dhe t\u00eb zhvillohej nj\u00eb bised\u00eb me personin e d\u00ebmtuar dhe d\u00ebshmitar\u00ebt e ngjarjes, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb konstatohet si duhet gjendja faktike dhe inicimi i mundsh\u00ebm i nj\u00eb procedure para Prokuroris\u00eb Themelore Publike p\u00ebr ndjekjen dhe hetimin e veprave penale t\u00eb kryera nga persona me kompetenca policore dhe an\u00ebtar\u00eb t\u00eb policis\u00eb s\u00eb burgjeve kund\u00ebr komandantit, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb konstatohet p\u00ebrgjegj\u00ebsia e tij dhe sanksionimi i tij.<\/p>\n<p><strong>GJUHA E URREJTJES<\/strong><\/p>\n<p><strong>Viti filloi me nj\u00eb intensitet t\u00eb lart\u00eb t\u00eb gjuh\u00ebs s\u00eb urrejtjes n\u00eb mediat sociale <\/strong><strong>\u00a0<\/strong><\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut n\u00eb muajin janar 2021, ngjash\u00ebm si n\u00eb t\u00ebr\u00eb vitin 2020, vuri n\u00eb dukje nj\u00eb num\u00ebr t\u00eb lart\u00eb t\u00eb rasteve t\u00eb gjuh\u00ebs s\u00eb urrejtjes n\u00eb mediat sociale. Gjuha e urrejtjes n\u00eb baz\u00eb t\u00eb p\u00ebrkat\u00ebsis\u00eb etnike ishte p\u00ebrs\u00ebri n\u00eb krye t\u00eb denoncimeve, respektivisht 39% e t\u00eb gjitha rasteve t\u00eb regjistruara p\u00ebr muajin aktual jan\u00eb me baz\u00eb etnike. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, denoncimet bazuar n\u00eb p\u00ebrkat\u00ebsin\u00eb politike sh\u00ebnuan nj\u00eb rritje, respektivisht 34% e numrit t\u00eb p\u00ebrgjithsh\u00ebm t\u00eb denoncimeve.<\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut, <strong><em>p\u00ebr muajin janar t\u00eb vitit 2021 ka verifikuar gjithsej<\/em><\/strong> <strong><em>101 <\/em><\/strong><strong><em>denoncime,<\/em><\/strong> <strong><em>q\u00eb paraqet nj\u00eb rritje p\u00ebr<\/em><\/strong><strong><em> 67% <\/em><\/strong><strong><em>krahasuar me muajin e nj\u00ebjt\u00eb n\u00eb vitin<\/em><\/strong><strong><em>\u00a0 2020. <\/em><\/strong>Shumica e rasteve n\u00eb muajin janar iu referuan p\u00ebrs\u00ebri pretendimeve t\u00eb gjuh\u00ebs s\u00eb urrejtjes bazuar n\u00eb p\u00ebrkat\u00ebsin\u00eb etnike, t\u00eb cilat kan\u00eb qen\u00eb n\u00eb rritje t\u00eb vazhdueshme q\u00eb nga fillimi i pandemis\u00eb globale. Retorika negative k\u00ebt\u00eb muaj n\u00eb mediat sociale ishte p\u00ebrshkall\u00ebzuar p\u00ebrs\u00ebri, q\u00eb kontribuan n\u00eb numrin e lart\u00eb t\u00eb denoncimeve p\u00ebrmes k\u00ebtyre kanaleve.<\/p>\n<p>Gjithashtu, zhvillimet e brendshme politike kan\u00eb \u00e7uar n\u00eb thellimin e retorik\u00ebs negative, e cila shpesh her\u00eb bazohet n\u00eb keqinformim dhe lajme t\u00eb rreme, pa kontrolluar faktet p\u00ebr t\u00eb zhvilluar nj\u00eb diskutim t\u00eb m\u00ebtejsh\u00ebm. Mund t\u00eb konkludohet se shpesh, kur nuk ka informacion t\u00eb mjaftuesh\u00ebm nga ana e institucioneve kompetente p\u00ebr nj\u00eb vendim ose propozim t\u00eb caktuar, diskutimi n\u00eb mediat sociale p\u00ebrshkall\u00ebzohet menj\u00ebher\u00eb.<\/p>\n<p>Bazuar n\u00eb monitorimin e vendosur t\u00eb mediave sociale, Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut vuri n\u00eb dukje se rritja e gjuh\u00ebs s\u00eb urrejtjes gjat\u00eb muajit ishte p\u00ebr shkak t\u00eb zhvillimeve aktuale politike n\u00eb vend. Ekziston frik\u00eb dhe keqkuptim midis bashk\u00ebsive etnike, p\u00ebr t\u00eb cilat gjithashtu kontribuon edhe nd\u00ebrtimi i q\u00ebndrimeve mbi dezinformata dhe lajme t\u00eb rreme. P\u00ebrdorimi i epiteteve jasht\u00ebzakonisht fyese dhe degraduese ndaj &#8216;t\u00eb tjer\u00ebve&#8217; \u00ebsht\u00eb gjithashtu intensiv.
