Komiteti i Helsinkit n\u00eb raportin e tij p\u00ebr muajin dhjetor 2020 i referohet k\u00ebtyre fushave\/sferave: t\u00eb drejtat e pun\u00ebtor\u00ebve, diskriminimi, dhuna me baz\u00eb gjinore, institucionet e mbyllura dhe gjuha e urrejtjes.<\/p>\n<p>Duke pasur parasysh rishikimin e p\u00ebrgjithsh\u00ebm t\u00eb procesit t\u00eb qasjes n\u00eb pjes\u00ebn e kapitujve politik\u00eb, procesi i negociatave do t\u00eb filloj\u00eb dhe do t\u00eb p\u00ebrfundoj\u00eb me grupin\/kllasterin e par\u00eb themelor (n\u00eb fakt edhe Kapitulli 23 &#8211; Gjyq\u00ebsori dhe t\u00eb Drejtat Themelore). Megjith\u00ebse vendi nuk ka filluar zyrtarisht negociatat e an\u00ebtar\u00ebsimit, Komiteti i Helsinkit thekson r\u00ebnd\u00ebsin\u00eb e Kapitullit 23 &#8211; Gjyq\u00ebsori dhe t\u00eb Drejtat Themelore si nj\u00eb katalizator i proceseve reformuese n\u00eb vitin 2021. Komiteti gjithashtu thekson r\u00ebnd\u00ebsin\u00eb e avancimit t\u00eb zbatimit t\u00eb legjislacionit kund\u00ebr gjuh\u00ebs s\u00eb urrejtjes dhe planit t\u00eb veprimit p\u00ebr zbatimin e Konvent\u00ebs s\u00eb Stambollit. Gjuha e urrejtjes \u00ebsht\u00eb ende nj\u00eb sfid\u00eb kryesore p\u00ebr vendin n\u00eb periudh\u00ebn e ardhshme, duke pasur parasysh trendin e mbi 100 denoncimeve n\u00eb muaj q\u00eb nga fillimi i pandemis\u00eb n\u00eb muajin mars t\u00eb vitit 2020. N\u00eb k\u00ebt\u00eb kontekst, nj\u00eb r\u00ebnd\u00ebsi t\u00eb ve\u00e7ant\u00eb ka zbatimi i legjislacionit n\u00eb luft\u00ebn kund\u00ebr korrupsionit, si nj\u00eb element themelor n\u00eb sigurimin e sundimit t\u00eb ligjit. Nj\u00eb p\u00ebrpar\u00ebsi kryesore mbetet zbatimi i plot\u00eb i korniz\u00ebs ligjore p\u00ebr luft\u00ebn kund\u00ebr diskriminimit.<\/p>\n<p>N\u00eb vitin 2020, Komisioni Evropian publikoi raportin p\u00ebr Republik\u00ebn e Maqedonis\u00eb s\u00eb Veriut mbi procesin e aderimit, i cili gjithashtu duhej t\u00eb sh\u00ebrbente si baz\u00eb p\u00ebr fillimin e negociatave p\u00ebr aderim. Propozimi i Korniz\u00ebs s\u00eb negocimit (bisedimeve), i propozuar nga presidenca gjermane, kishte p\u00ebr q\u00ebllim krijimin e infrastruktur\u00ebs s\u00eb nevojshme ligjore p\u00ebr zbatimin e legjislacionit t\u00eb BE-s\u00eb dhe nd\u00ebrtimit t\u00eb nj\u00eb dosje suksesi n\u00eb zbatimin e reformave t\u00eb nd\u00ebrmarra p\u00ebrpara p\u00ebrfundimit t\u00eb negociatave dhe n\u00ebnshkrimit t\u00eb Marr\u00ebveshjes p\u00ebr an\u00ebtar\u00ebsim.<\/p>\n<p>Megjithat\u00eb, p\u00ebrkund\u00ebr insistimit t\u00eb presidenc\u00ebs gjermane dhe negociatave intensive midis delegacioneve t\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut dhe Republik\u00ebs s\u00eb Bullgaris\u00eb, K\u00ebshilli i Bashkimit Evropian n\u00eb muajin dhjetor nuk arriti unanimitet p\u00ebr fillimin e negociatave dhe mbajtjen e konferenc\u00ebs s\u00eb par\u00eb nd\u00ebrqeveritare n\u00eb muajin dhjetor. Pavar\u00ebsisht insistimit p\u00ebr t\u00eb p\u00ebrfshir\u00eb k\u00ebrkesat e Bullgaris\u00eb n\u00eb Korniz\u00ebn e negocimit, vendet e tjera an\u00ebtare nj\u00ebz\u00ebri refuzuan k\u00ebt\u00eb k\u00ebrkes\u00eb. Megjith\u00ebse m\u00eb n\u00eb fund u arrit nj\u00eb konsensus fillestar mbi miratimin e nj\u00eb pakete konkluzionesh p\u00ebr vendet n\u00eb proces aderimi, me insistimin e Sllovakis\u00eb dhe Republik\u00ebs \u00c7eke brenda K\u00ebshillit Evropian, konkluzionet nuk u miratuan.<strong>\u00a0<\/strong><\/p>\n<p><strong>T\u00cb DREJTAT E PUN\u00cbTOR\u00cbVE<\/strong><strong>\u00a0<\/strong><\/p>\n<p><em>Pun\u00ebtor\u00ebt <\/em><em>i vuajn\u00eb<\/em><em> pasojat e t\u00eb metave t\u00eb <\/em><em>nj\u00eb <\/em><em>sistemi t\u00eb korruptuar<\/em><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" width=\"489\" height=\"312\" class=\"aligncenter size-full wp-image-12029\" src=\"https:\/\/mhc.org.mk\/wp-content\/uploads\/2021\/01\/hrights122020al.png\" alt=\"\" srcset=\"https:\/\/mhc.org.mk\/wp-content\/uploads\/2021\/01\/hrights122020al.png 489w, https:\/\/mhc.org.mk\/wp-content\/uploads\/2021\/01\/hrights122020al-250x160.png 250w, https:\/\/mhc.org.mk\/wp-content\/uploads\/2021\/01\/hrights122020al-120x77.png 120w, https:\/\/mhc.org.mk\/wp-content\/uploads\/2021\/01\/hrights122020al-2x1.png 2w\" sizes=\"auto, (max-width: 489px) 100vw, 489px\" \/><\/p>\n<p><strong>Leksionet<\/strong><strong> e pa m\u00ebsuara u kushtojn\u00eb shtrenjt\u00eb pun\u00ebtor\u00ebve<\/strong><\/p>\n<p>Pasi Drejtoria e t\u00eb Hyrave Publike (DHP) n\u00eb muajin korrik publikoi t\u00eb dh\u00ebna p\u00ebr 708 pun\u00ebdh\u00ebn\u00ebs t\u00eb cil\u00ebt p\u00ebr muajt prill dhe maj kishin marr\u00eb mb\u00ebshtetje financiare n\u00eb shum\u00eb totale prej 384.730,00 euro, por nuk ua kishin paguar pagat 1706 punonj\u00ebsve, s\u00eb bashku me disa sindikata dhe shoqata t\u00eb qytetar\u00ebve ne reaguam duke apeluar q\u00eb ndihma financiare n\u00eb t\u00eb ardhmen duhet t\u00eb drejtohet drejtp\u00ebrdrejt ndaj pun\u00ebtor\u00ebve, p\u00ebr t\u00eb shmangur mund\u00ebsin\u00eb q\u00eb ajo t\u00eb abuzohet p\u00ebrs\u00ebri.<\/p>\n<p>Gjat\u00eb muajve gusht dhe shtator, Qeveria njoftoi se po mbante takime t\u00eb rregullta me dhomat (odat), organizatat e pun\u00ebdh\u00ebn\u00ebsve, sindikatat, profesor\u00ebt universitar\u00eb dhe praktikant\u00ebt p\u00ebr t\u00eb miratuar paket\u00ebn e kat\u00ebrt t\u00eb masave ekonomike. Kjo paket\u00eb u miratua m\u00eb 27 shtator si vazhdim i tre paketave paraprake dhe shuma e saj totale u vler\u00ebsua n\u00eb 470 milion euro. Paketa e masave kishte p\u00ebr q\u00ebllim sigurimin e mb\u00ebshtetjes s\u00eb drejtp\u00ebrdrejt\u00eb financiare, ndihm\u00ebn e likuiditetit t\u00eb sektorit privat dhe stimulimin e nd\u00ebrmarrjeve p\u00ebr kthimin dhe mbajtjen e pun\u00ebtor\u00ebve n\u00eb vendet e pun\u00ebs. Pjes\u00eb e k\u00ebsaj pakete ishte edhe masa p\u00ebr t\u00eb mb\u00ebshtetur nd\u00ebrmarrjet p\u00ebr t\u00eb paguar pagat e punonj\u00ebsve p\u00ebr muajt tetor, n\u00ebntor dhe dhjetor. Nj\u00eb risi e k\u00ebsaj mase \u00ebsht\u00eb p\u00ebrcaktimi shkall\u00ebzues (gradual) i mb\u00ebshtetjes sipas r\u00ebnies s\u00eb t\u00eb ardhurave t\u00eb nd\u00ebrmarrjeve &#8211; sa m\u00eb e madhe t\u00eb jet\u00eb r\u00ebnia e t\u00eb ardhurave, aq m\u00eb e madhe do t\u00eb jet\u00eb mb\u00ebshtetja nga shteti p\u00ebr pagimin e pagave.<\/p>\n<p>P\u00ebrfaq\u00ebsuesit e dhomave (odave) t\u00eb tregtis\u00eb ishin t\u00eb k\u00ebnaqur q\u00eb edhe k\u00ebt\u00eb her\u00eb ata ishin t\u00eb p\u00ebrfshir\u00eb n\u00eb krijimin e masave dhe se Qeveria pranoi nj\u00eb num\u00ebr t\u00eb madh propozimesh t\u00eb tyre. P\u00ebr dallim nga to, nevojat e pun\u00ebtor\u00ebve q\u00eb u pasqyruan n\u00eb k\u00ebrkesat e sindikatave dhe organizatave t\u00eb shoq\u00ebris\u00eb civile nuk u mor\u00ebn parasysh edhe n\u00eb k\u00ebt\u00eb paket\u00eb masash. Masat financiare q\u00eb n\u00eb dukje kan\u00eb p\u00ebr q\u00ebllim t\u00eb ndihmojn\u00eb dhe mb\u00ebshtesin pun\u00ebtor\u00ebt, p\u00ebrs\u00ebri nuk u jan\u00eb paguar drejtp\u00ebrdrejt atyre, dhe k\u00ebshtu ka mbetur rreziku real q\u00eb t\u00eb abuzohen p\u00ebrs\u00ebri.<\/p>\n<p>Leksionet e pa m\u00ebsuara u kushtojn\u00eb shtrenjt\u00eb pun\u00ebtor\u00ebve dhe n\u00eb m\u00ebnyr\u00eb shtes\u00eb rrezikojn\u00eb edhe vet\u00eb ekzistenc\u00ebn e tyre. N\u00eb muajin dhjetor, Drejtoria e t\u00eb Hyrave Publike publikoi nj\u00eb Analiz\u00eb t\u00eb mb\u00ebshtetjes financiare t\u00eb pun\u00ebdh\u00ebn\u00ebsve p\u00ebr pagimin e pagave t\u00eb punonj\u00ebsve p\u00ebr muajin tetor 2020. Prej gjithsej 179 pun\u00ebdh\u00ebn\u00ebsish t\u00eb cil\u00ebt kishin marr\u00eb mb\u00ebshtetje financiare n\u00eb vler\u00eb prej 5.271.771,00 denar\u00eb, nuk e kan\u00eb p\u00ebrmbushur detyrimin p\u00ebr t\u00eb paguar pag\u00ebn e muajit tetor p\u00ebr 338 t\u00eb pun\u00ebsuar.<\/p>\n<p><strong>K\u00ebta pun\u00ebdh\u00ebn\u00ebs jan\u00eb nga k\u00ebto veprimtari<\/strong><strong>:<\/strong><strong>\u00a0<\/strong><\/p>\n<ul>\n<li><strong>40 <\/strong><strong>pun\u00ebdh\u00ebn\u00ebs nga veprimtaria<\/strong> <strong><em>tregti me pakic\u00eb<\/em><\/strong> <strong>kan\u00eb marr\u00eb ndihm\u00eb financiare prej<\/strong><strong>254<\/strong><strong>,00 denar\u00eb, kurse 63 punonj\u00ebsve nuk ua kan\u00eb paguar pagat<\/strong><strong>.<\/strong><\/li>\n<li><strong>23 <\/strong><strong>nd\u00ebrmarrje q\u00eb kryejn\u00eb<\/strong> <strong><em>p\u00ebrgatitje t\u00eb shujtave dhe sh\u00ebrbime ushqimi<\/em><\/strong> <strong>kan\u00eb marr\u00eb ndihm\u00eb financiare prej<\/strong><strong>614<\/strong><strong>,00 denar\u00eb, kurse<\/strong><strong> 55<\/strong><strong> punonj\u00ebsve nuk ua kan\u00eb paguar pagat<\/strong><strong>.<\/strong><\/li>\n<li><strong>12 <\/strong><strong>nd\u00ebrmarrje nga veprimtaria<\/strong> <strong><em>transport<\/em><\/strong><strong>, <\/strong><strong>kan\u00eb marr\u00eb ndihm\u00eb financiare prej<\/strong><strong>512<\/strong><strong>,00 denar\u00eb, kurse 25 punonj\u00ebsve nuk ua kan\u00eb paguar pagat<\/strong><strong>. <\/strong><\/li>\n<li><strong>K\u00ebtu p\u00ebrfshihen edhe veprimtarit\u00eb<\/strong> <strong><em>tregti me <\/em><\/strong><strong><em>shumic\u00eb,<\/em><\/strong> <strong><em>nd\u00ebrtim nd\u00ebrtesash<\/em><\/strong><strong>, <\/strong><strong><em>tregti me shumic\u00eb dhe pakic\u00eb me mjete motorike dhe moto\u00e7ikleta<\/em><\/strong><strong>.<\/strong><strong>\u00a0<\/strong><\/li>\n<\/ul>\n<p><strong>Sipas rajoneve<\/strong><strong>, <\/strong><strong>numri m\u00eb i madh i nd\u00ebrmarrjeve q\u00eb nuk i kan\u00eb paguar pagat jan\u00eb nga<\/strong><strong>: <\/strong><strong>Shkupi<\/strong><strong> 52, <\/strong><strong>Tetova<\/strong><strong> 41 <\/strong><strong>dhe<\/strong> <strong>Gostivari<\/strong><strong> 15<\/strong><strong>.<\/strong><strong>\u00a0<\/strong><\/p>\n<p>Sa i p\u00ebrket nd\u00ebrmarrjeve q\u00eb nuk kan\u00eb paguar pagat p\u00ebr muajt prill, maj dhe qershor t\u00eb vitit 2020, DHP-ja informoi se \u00ebsht\u00eb kryer pages\u00eb e detyruar p\u00ebr shkak t\u00eb pagave t\u00eb papaguara. P\u00ebr k\u00ebta pun\u00ebdh\u00ebn\u00ebs jan\u00eb d\u00ebrguar t\u00eb dh\u00ebna t\u00eb holl\u00ebsishme n\u00eb Prokurorin\u00eb Publike, p\u00ebr inicimin e procedurave penale.<\/p>\n<ul>\n<li><strong>prill &#8211; 55 <\/strong><strong>pun\u00ebdh\u00ebn\u00ebs nuk i kan\u00eb paguar pagat<\/strong><strong>; <\/strong><\/li>\n<li><strong>maj &#8211; 48 <\/strong><strong>pun\u00ebdh\u00ebn\u00ebs<\/strong><strong>; <\/strong><strong>dhe<\/strong><\/li>\n<li><strong>qershor &#8211; 82 <\/strong><strong>pun\u00ebdh\u00ebn\u00ebs<\/strong>.<\/li>\n<li><strong>149 <\/strong><strong>pun\u00ebdh\u00ebn\u00ebs nuk i kan\u00eb paguar pagat vet\u00ebm p\u00ebr nj\u00eb muaj<\/strong><strong>; <\/strong><\/li>\n<li><strong>25 <\/strong><strong>pun\u00ebdh\u00ebn\u00ebs nuk i kan\u00eb paguar pagat p\u00ebr dy muaj<\/strong><strong>; <\/strong><strong>dhe<\/strong><\/li>\n<li><strong>5 <\/strong><strong>pun\u00ebdh\u00ebn\u00ebs nuk i kan\u00eb paguar pagat p\u00ebr t\u00eb tre muajt<\/strong><strong> (<\/strong><strong>prill, maj dhe qershor<\/strong><strong>).<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Pun\u00ebdh\u00ebn\u00ebsit q\u00eb kan\u00eb marr\u00eb mb\u00ebshtetje financiare nga shteti, por nuk i kan\u00eb paguar pagat e pun\u00ebtor\u00ebve t\u00eb tyre do t&#8217;i n\u00ebnshtrohen kontrolleve t\u00eb holl\u00ebsishme nga Drejtoria dhe Inspektorati Shtet\u00ebror i Pun\u00ebs. Kontrollet do t\u00eb shoq\u00ebrohen me mbik\u00ebqyrje inspektuese t\u00eb nd\u00ebrmarrjeve q\u00eb kan\u00eb paguar nj\u00eb pag\u00eb m\u00eb t\u00eb ul\u00ebt se shuma minimale e p\u00ebrcaktuar ligj\u00ebrisht. Lista e nd\u00ebrmarrjeve q\u00eb kan\u00eb keqp\u00ebrdorur mb\u00ebshtetjen financiare nga shteti \u00ebsht\u00eb dor\u00ebzuar n\u00eb Sekretariatin e P\u00ebrgjithsh\u00ebm t\u00eb Qeveris\u00eb, p\u00ebr t\u2019i publikuar mospaguesit publikisht dhe n\u00eb m\u00ebnyr\u00eb transparente dhe kjo list\u00eb nuk mund t\u00eb ndryshohet, pavar\u00ebsisht n\u00ebse pas publikimit ndonj\u00eb tatimpagues do t\u00eb paguaj\u00eb pagat e punonj\u00ebsve t\u00eb tij.<\/p>\n<p>N\u00eb fund t\u00eb muajit u paralajm\u00ebrua paketa e pest\u00eb e masave ekonomike, edhe k\u00ebsaj here p\u00ebr nd\u00ebrmarrjet. Problemet dhe mang\u00ebsit\u00eb q\u00eb po shp\u00ebrfillen gjat\u00eb zbatimit t\u00eb masave ekonomike, do t\u00eb thot\u00eb q\u00eb pun\u00ebtor\u00ebt p\u00ebrs\u00ebri do t\u2019i vuajn\u00eb pasojat e t\u00eb metave t\u00eb nj\u00eb sistemi t\u00eb korruptuar.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>P\u00ebrgjegj\u00ebsi p\u00ebr inspektor\u00ebt e pun\u00ebs q\u00eb shkelin parimet e pun\u00ebs gjat\u00eb kryerjes s\u00eb mbik\u00ebqyrjeve inspektuese<\/strong><\/p>\n<p><em>Rasti i<\/em><em> 1<\/em><em>-r\u00eb<\/em><em>:<\/em><\/p>\n<p>N\u00eb muajin dhjetor, na u drejtua nj\u00eb pun\u00ebtore q\u00eb ishte pushuar nga puna nd\u00ebrsa kishte qen\u00eb n\u00eb pushim mjek\u00ebsor dhe kund\u00ebr k\u00ebtij pushimi nga puna ajo kishte ngritur nj\u00eb procedur\u00eb kontestimore p\u00ebr anulimin e tij. Megjith\u00ebse ishte miratuar gjat\u00eb koh\u00ebs s\u00eb pushimit mjek\u00ebsor t\u00eb pun\u00ebtores, vendimi nuk p\u00ebrmbante arsyet e pushimit nga puna. Pun\u00ebdh\u00ebn\u00ebsi nuk e d\u00ebshmoi arsyen e pushimit nga puna dhe nuk e kishte specifikuar at\u00eb n\u00eb arsyetimin e vendimit.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> P\u00ebr m\u00eb tep\u00ebr, pun\u00ebdh\u00ebn\u00ebsi nuk e kishte arsyetuar me shkrim anulimin e kontrat\u00ebs s\u00eb pun\u00ebs dhe as nuk e kishte respektuar detyrimin ligjor p\u00ebr ta referuar punonj\u00ebsen p\u00ebr mbrojtje ligjore.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p>P\u00ebr shkak t\u00eb gjith\u00eb k\u00ebsaj, pun\u00ebtorja e kishte ushtruar t\u00eb drejt\u00ebn e saj dhe kishte ngritur iniciativ\u00eb n\u00eb Inspektoratin Shtet\u00ebror t\u00eb Pun\u00ebs p\u00ebr nj\u00eb vendim q\u00eb do t\u00eb shtynte ekzekutimin e vendimit p\u00ebr pushim nga puna. Pun\u00ebtorja kishte k\u00ebrkuar q\u00eb t\u00eb shqiptohet nj\u00eb mas\u00eb e p\u00ebrkohshme p\u00ebr kthimin e saj n\u00eb pun\u00eb deri n\u00eb zgjidhjen p\u00ebrfundimtare t\u00eb kontestit nga marr\u00ebdh\u00ebnia e pun\u00ebs, i v\u00ebrtetuar pran\u00eb Gjykat\u00ebs Themelore Civile Shkup.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>Inspektori i cili ka vepruar mbi k\u00ebrkes\u00ebn e saj, nuk gjeti ndonj\u00eb parregullsi n\u00eb procedur\u00ebn e anulimit t\u00eb kontrat\u00ebs s\u00eb pun\u00ebs dhe kishte nd\u00ebrprer\u00eb procedur\u00ebn p\u00ebr mbik\u00ebqyrje t\u00eb jasht\u00ebzakonshme inspektuese. Jo vet\u00ebm q\u00eb inspektori nuk kishte miratuar nj\u00eb vendim n\u00eb p\u00ebrputhje me Ligjin p\u00ebr marr\u00ebdh\u00ebniet e pun\u00ebs, madje edhe m\u00eb shum\u00eb n\u00eb p\u00ebrgjigjen me shkrim p\u00ebr pun\u00ebtoren ai nuk kishte arsyetuar p\u00ebrse po e nd\u00ebrpren procedur\u00ebn, respektivisht pse ka konsideruar se n\u00eb k\u00ebt\u00eb rast nuk kishte shkelje t\u00eb drejt\u00ebs nga marr\u00ebdh\u00ebnia e pun\u00ebs. M\u00eb n\u00eb fund, inspektori e kishte udh\u00ebzuar pun\u00ebtoren t\u00eb k\u00ebrkonte t\u00eb drejt\u00ebn nga marr\u00ebdh\u00ebnia e pun\u00ebs para nj\u00eb gjykate kompetente, n\u00ebse ajo nuk \u00ebsht\u00eb e k\u00ebnaqur me verdiktin e procedur\u00ebs para Inspektoratit, pavar\u00ebsisht nga fakti se p\u00ebrve\u00e7 k\u00ebrkes\u00ebs, ajo kishte parashtruar edhe padin\u00eb.<\/p>\n<p>Kur pun\u00ebtor\u00ebt i drejtohen Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs si nj\u00eb mekaniz\u00ebm par\u00ebsor i mbrojtjes, \u00ebsht\u00eb e papranueshme q\u00eb inspektor\u00ebt t\u00eb p\u00ebrgatisin p\u00ebrgjigje t\u00eb pajustifikueshme p\u00ebr k\u00ebrkesat, n\u00eb t\u00eb cilat thuhet vet\u00ebm nj\u00eb fjali, dhe nuk arsyetohet, pse nuk ka pasur shkelje t\u00eb t\u00eb drejtave t\u00eb pun\u00ebs. Duke kontaktuar Inspektoratin, pun\u00ebtor\u00ebt presin q\u00eb nga mbik\u00ebqyrja inspektuese t\u00eb marrin informacion t\u00eb dobish\u00ebm n\u00eb lidhje me kontestin e pun\u00ebs q\u00eb ata kan\u00eb ngritur para nj\u00eb gjykate kompetente, shkeljet e t\u00eb drejtave t\u00eb tyre t\u00eb pun\u00ebs dhe mbrojtjen ligjore q\u00eb kan\u00eb n\u00eb dispozicion.<\/p>\n<p><em>Rasti i <\/em><em>2<\/em><em>-t\u00eb<\/em><em>:<\/em><\/p>\n<p>Gjat\u00eb muajit dhjetor, disa pun\u00ebtor\u00eb n\u00eb m\u00ebnyr\u00eb anonime raportuan se pun\u00ebdh\u00ebn\u00ebsi ku ata punojn\u00eb nuk mban sh\u00ebnime t\u00eb ndara p\u00ebr pun\u00ebn jasht\u00eb orarit, nuk regjistron ve\u00e7mas or\u00ebt e pun\u00ebs jasht\u00eb orarit n\u00eb llogaritjen e pag\u00ebs mujore dhe nuk u paguan atyre pun\u00ebn jasht\u00eb orarit. Pun\u00ebtor\u00ebve nuk u ishte paguar asnj\u00eb shtes\u00eb page, t\u00eb tilla si shtesa p\u00ebr pun\u00eb gjat\u00eb festave dhe shtesa p\u00ebr pun\u00eb gjat\u00eb dit\u00ebs s\u00eb pushimit javor. P\u00ebr shkak t\u00eb k\u00ebtyre shkeljeve, n\u00eb Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs kemi parashtruar k\u00ebrkes\u00eb p\u00ebr zbatimin e nj\u00eb mbik\u00ebqyrje t\u00eb jasht\u00ebzakonshme inspektuese, n\u00eb m\u00ebnyr\u00eb q\u00eb Inspektorati t\u00eb hetoj\u00eb n\u00ebse ka pasur shkelje t\u00eb rregullave t\u00eb pun\u00ebs nga pun\u00ebdh\u00ebn\u00ebsi, p\u00ebr k\u00ebto \u00e7\u00ebshtje specifike.<\/p>\n<p>&nbsp;<\/p>\n<p>Me k\u00ebrkes\u00ebn ton\u00eb, Inspektorati Shtet\u00ebror i Pun\u00ebs na dor\u00ebzoi vet\u00ebm nj\u00eb Njoftim (i cili nuk \u00ebsht\u00eb nj\u00eb akt administrativ dhe nuk mund t\u00eb apelohet), dhe aq m\u00eb tep\u00ebr p\u00ebrgjigja me shkrim p\u00ebrmbante konkluzione kontradiktore, p\u00ebr shkak t\u00eb gjendjes faktike t\u00eb konstatuar gabimisht. Gjegj\u00ebsisht, nj\u00eb nga shkeljet q\u00eb ne k\u00ebrkuam t\u00eb hetohet \u00ebsht\u00eb se pun\u00ebdh\u00ebn\u00ebsi nuk ka sh\u00ebnuar n\u00eb m\u00ebnyr\u00eb t\u00eb ve\u00e7ant\u00eb or\u00ebt shtes\u00eb t\u00eb pun\u00ebs jasht\u00eb orarit n\u00eb llogaritjen mujore t\u00eb pag\u00ebs s\u00eb pun\u00ebtor\u00ebve. P\u00ebr m\u00eb tep\u00ebr, ne k\u00ebrkuam t\u00eb hetohet n\u00ebse pun\u00ebdh\u00ebn\u00ebsi l\u00ebshon llogaritjet e pagave mujore p\u00ebr pun\u00ebtor\u00ebt. N\u00eb Njoftimin e Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs thuhej:<\/p>\n<p>\u201e<em>Nga inspektimi i llogaritjeve me shkrim t\u00eb pagave t\u00eb pun\u00ebtor\u00ebve nuk \u00ebsht\u00eb e mundur t\u00eb p\u00ebrcaktohet sakt\u00ebsisht llogaritja e shtes\u00ebs dhe pag\u00ebs p\u00ebr pun\u00ebn gjat\u00eb festave dhe pun\u00ebn jasht\u00eb orarit, p\u00ebr k\u00ebt\u00eb shkak \u00ebsht\u00eb k\u00ebrkuar nga punonj\u00ebsja n\u00eb kontabilitet q\u00eb t\u00eb deklarohet me shkrim n\u00eb lidhje me m\u00ebnyr\u00ebn e llogaritjes s\u00eb shtesave dhe kompensimeve t\u00eb pag\u00ebs.<\/em><\/p>\n<p><em>N\u00eb deklarat\u00ebn me shkrim thuhet se sistemi i llogaritjes s\u00eb pagave \u00ebsht\u00eb nj\u00eb sistem i vjet\u00ebr dhe nuk ka mund\u00ebsi p\u00ebr mb\u00ebshtetje softuerike p\u00ebr ndryshim, por q\u00eb nd\u00ebrkoh\u00eb \u00ebsht\u00eb bler\u00eb nj\u00eb softver i ri p\u00ebr llogaritjen e pagave (&#8230;) i nj\u00ebjti \u00ebsht\u00eb n\u00eb faz\u00ebn e implementimit dhe do t\u00eb jet\u00eb aktiv n\u00eb fillim t\u00eb vitit 2021. Deklarata me shkrim konfirmon se llogaritja dhe pagesa e t\u00eb gjitha shtesave p\u00ebr punonj\u00ebsit kryhet n\u00eb p\u00ebrputhje me Ligjin p\u00ebr marr\u00ebdh\u00ebniet e pun\u00ebs dhe Marr\u00ebveshjen kolektive <\/em>\u201c.<\/p>\n<p>P\u00ebr inspektorin e pun\u00ebs q\u00eb ka kryer mbik\u00ebqyrjen inspektuese, ky ishte nj\u00eb konfirmim i mjaftuesh\u00ebm se ishin paguar t\u00eb gjitha shtesat e punonj\u00ebsve dhe or\u00ebt e pun\u00ebs jasht\u00eb orarit. P\u00ebrve\u00e7 faktit se vet\u00ebm n\u00eb fjalin\u00eb paraprake thuhet se nga inspektimi i llogaritjeve me shkrim p\u00ebr pag\u00ebn e pun\u00ebtor\u00ebve nuk \u00ebsht\u00eb e mundur t\u00eb p\u00ebrcaktohet sakt\u00ebsisht llogaritja e shtes\u00ebs dhe kompensimit t\u00eb pag\u00ebs p\u00ebr pun\u00ebn gjat\u00eb festave dhe pun\u00ebn jasht\u00eb orarit.<\/p>\n<p>K\u00ebto dy konstatime jan\u00eb plot\u00ebsisht kontradiktore me nj\u00ebra-tjetr\u00ebn. Inspektori i cili ka vepruar n\u00eb k\u00ebt\u00eb rast nuk ka guxuar t\u00eb mb\u00ebshtetet vet\u00ebm n\u00eb konfirmimin me shkrim nga pun\u00ebdh\u00ebn\u00ebsi se jan\u00eb paguar t\u00eb gjitha shtesat e pagave, kur n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb ka denoncime me shkrim nga pun\u00ebtor\u00ebt (t\u00eb cil\u00ebt p\u00ebr shkak t\u00eb rasteve t\u00eb tilla dhe t\u00eb ngjashme t\u00eb mosnd\u00ebshkimit t\u00eb pun\u00ebdh\u00ebn\u00ebsve d\u00ebshirojn\u00eb t\u00eb mbeten anonim). Pse k\u00ebto denoncime p\u00ebr shklje t\u00eb t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve nuk vler\u00ebsohen nj\u00ebsoj sikur \u00ebsht\u00eb vler\u00ebsuar v\u00ebrtetimi me shkrim nga ana e pun\u00ebdh\u00ebn\u00ebsit? Kjo vet\u00ebm forcon edhe m\u00eb shum\u00eb mosbesimin e pun\u00ebtor\u00ebve ndaj masave mbrojt\u00ebse n\u00eb dispozicion t\u00eb tyre, si\u00e7 \u00ebsht\u00eb Inspektorati Shtet\u00ebror i Pun\u00ebs, dhe p\u00ebr m\u00eb tep\u00ebr thellohen edhe m\u00eb shum\u00eb marr\u00ebdh\u00ebniet e pabarabarta t\u00eb pushtetit midis pun\u00ebdh\u00ebn\u00ebsve dhe pun\u00ebtor\u00ebve.<\/p>\n<p><em>P\u00ebrfundim nga t\u00eb dy rastet<\/em><em>:<\/em><\/p>\n<p>Inspektor\u00ebt jan\u00eb p\u00ebrgjegj\u00ebs n\u00ebse nuk kryejn\u00eb detyrat ose nuk marrin masa, t\u00eb cilat me ligj jan\u00eb t\u00eb detyrueshme p\u00ebr t\u2019i kryer, respektivisht t\u00eb nd\u00ebrmarrin n\u00eb procedur\u00ebn e mbik\u00ebqyrjespra t&#8217;i marr\u00eb, n\u00eb procedur\u00ebn e mbik\u00ebqyrjes.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> P\u00ebr m\u00eb tep\u00ebr, p\u00ebr shkak t\u00eb shkeljes s\u00eb parimeve t\u00eb veprimit t\u00eb inspektor\u00ebve gjat\u00eb zbatimit t\u00eb mbik\u00ebqyrjeve inspektuese, ne i k\u00ebrkuam drejtorit t\u00eb Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs q\u00eb t\u00eb filloj\u00eb procedura disiplinore kund\u00ebr inspektor\u00ebve q\u00eb kan\u00eb vepruar n\u00eb k\u00ebto dy raste, n\u00ebse nuk i eliminojn\u00eb parregullsit\u00eb e kryera. N\u00eb rastin e pushimit nga puna t\u00eb punonj\u00ebses, ne u informuam se kan\u00eb filluar procedurat disiplinore kund\u00ebr inspektorit, nd\u00ebrsa p\u00ebr rastin tjet\u00ebr p\u00ebrgjigja \u00ebsht\u00eb n\u00eb pritje e sip\u00ebr.<\/p>\n<ul>\n<li><strong><em>Parimi i barazis\u00eb, paan\u00ebsis\u00eb dhe objektivitetit<\/em><\/strong>:: Inspektori gjat\u00eb kryerjes s\u00eb mbik\u00ebqyrjes inspektuese siguron barazi, paanshm\u00ebri dhe objektivitet ndaj subjekteve t\u00eb mbik\u00ebqyrjes inspektuese\u00a0<a href=\"#_ftn5\" name=\"_ftnref5\"><\/a><a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/li>\n<\/ul>\n<p><strong>GRAT\u00cb PUN\u00cbTORE N\u00cb INDUSTRIN\u00cb E TEKSTILIT<\/strong><\/p>\n<p><strong>53 raste t\u00eb shkeljeve t\u00eb t\u00eb drejtave t\u00eb pun\u00ebs t\u00eb grave pun\u00ebtore n\u00eb industrin\u00eb e tekstilit<\/strong><\/p>\n<p>N\u00eb muajin dhjetor, Komiteti i Helsinkit regjistroi 53 raste t\u00eb shkeljes s\u00eb t\u00eb drejtave t\u00eb pun\u00ebs t\u00eb grave pun\u00ebtore n\u00eb industrin\u00eb e tekstilit dhe parashtroi tri k\u00ebrkesa p\u00ebr mbik\u00ebqyrje t\u00eb jasht\u00ebzakonshme inspektuese n\u00eb fabrikat e tekstilit p\u00ebr shkelje t\u00eb t\u00eb drejtave t\u00eb pun\u00ebs t\u00eb grave pun\u00ebtore t\u00eb tekstilit. N\u00eb nj\u00eb prej rasteve b\u00ebhet fjal\u00eb p\u00ebr paga t\u00eb papaguara, kurse n\u00eb dy prej rasteve b\u00ebhet fjal\u00eb p\u00ebr mosnd\u00ebrmarrjen e masave parandaluese p\u00ebr mbrojtje nga KOVID-19 n\u00eb vendet e pun\u00ebs.<\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb gjitha rastet e p\u00ebrmendura filloi procedurat p\u00ebr mbik\u00ebqyrje t\u00eb jasht\u00ebzakonshme inspektuese para Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs.<\/p>\n<p>N\u00eb m\u00ebnyr\u00eb shtes\u00eb, Komiteti i Helsinkit n\u00eb k\u00ebt\u00eb periudh\u00eb ofroi 27 k\u00ebshilla juridike p\u00ebr grat\u00eb pun\u00ebtore t\u00eb tekstilit p\u00ebr t\u00eb ushtruar t\u00eb drejt\u00ebn e regresit p\u00ebr pushim vjetor (k15).<\/p>\n<p>P\u00cbRFUNDIM: Grat\u00eb pun\u00ebtore n\u00eb industrin\u00eb e tekstilit mbeten nj\u00eb nga kategorit\u00eb m\u00eb t\u00eb prekura t\u00eb qytetar\u00ebve, ku t\u00eb drejtat e tyre t\u00eb pun\u00ebs jan\u00eb m\u00eb t\u00eb ekspozuara ndaj shkeljeve gjat\u00eb koh\u00ebs s\u00eb pandemis\u00eb me KOVID-19. Dhjetori \u00ebsht\u00eb nj\u00eb muaj n\u00eb t\u00eb cilin po rriten rastet e dokumentuara t\u00eb shkeljeve t\u00eb t\u00eb drejtave t\u00eb regresit p\u00ebr pushim vjetor.<\/p>\n<p>REKOMANDIM: Ne i b\u00ebjm\u00eb thirrje Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs q\u00eb t\u00eb veproj\u00eb n\u00eb koh\u00eb dhe n\u00eb m\u00ebnyr\u00eb efikase n\u00eb lidhje me k\u00ebrkesat e parashtruara p\u00ebr mbik\u00ebqyrje inspektuese, duke respektuar afatet ligjore p\u00ebr veprimin dhe duke njoftuar parashtruesin e k\u00ebrkes\u00ebs n\u00eb p\u00ebrputhje me Ligjin p\u00ebr mbik\u00ebqyrje inspektuese. P\u00ebr m\u00eb tep\u00ebr, i b\u00ebjm\u00eb thirrje Inspektoratit q\u00eb t\u00eb intensifikoj\u00eb mbik\u00ebqyrjen sipas detyr\u00ebs zyrtare p\u00ebr pagimin e regresit p\u00ebr pushim vjetor (k15) nga ana e pun\u00ebdh\u00ebn\u00ebsve.<strong>\u00a0<\/strong><\/p>\n<p><strong>DISKRIMINIMI<\/strong><\/p>\n<p><strong>N\u00ebnat e f\u00ebmij\u00ebve deri n\u00eb mosh\u00ebn tre vje\u00e7 punojn\u00eb nat\u00ebn dhe jasht\u00eb orarit pa p\u00eblqimin e tyre<\/strong><\/p>\n<p>Disa gra pun\u00ebtore nga Velesi, t\u00eb cilat kan\u00eb f\u00ebmij\u00eb deri n\u00eb nj\u00eb vje\u00e7, iu drejtuan Komitetit t\u00eb Helsinkit sepse ata punojn\u00eb jasht\u00eb orarit t\u00eb pun\u00ebs nat\u00ebn, kurse disa prej tyre, t\u00eb cil\u00ebt kan\u00eb f\u00ebmij\u00eb deri n\u00eb tre vje\u00e7, punojn\u00eb nat\u00ebn duke dh\u00ebn\u00eb p\u00eblqim t\u00eb imponuar me shkrim.<\/p>\n<p>Grat\u00eb pun\u00ebtore, t\u00eb cilat jan\u00eb n\u00ebna t\u00eb f\u00ebmij\u00ebve deri n\u00eb tre vje\u00e7, jan\u00eb n\u00eb marr\u00ebdh\u00ebnie pune te nj\u00eb pun\u00ebdh\u00ebn\u00ebs, me kontrata t\u00eb lidhura pun\u00ebsimi p\u00ebr koh\u00eb t\u00eb caktuar. Ata, nga pun\u00ebdh\u00ebn\u00ebsi i tyre ishin k\u00ebrc\u00ebnuar se n\u00ebse nuk n\u00ebnshkruajn\u00eb nj\u00eb p\u00eblqim me shkrim me t\u00eb cilin bien dakord p\u00ebr t\u00eb punuar jasht\u00eb orarit nat\u00ebn, kontratat e tyre nuk do t\u00eb vazhdohen. Nga frika se mos mbeteshin pa fonde p\u00ebr jetes\u00eb gjat\u00eb nj\u00eb periudhe pandemie, grat\u00eb pun\u00ebtore i kishin n\u00ebnshkruar p\u00eblqimet. Pun\u00ebdh\u00ebn\u00ebsi e dinte q\u00eb ata kishin frik\u00eb t\u00eb humbnin vendet e tyre t\u00eb pun\u00ebs dhe e dinte se n\u00ebnshkrimet e tyre do ta b\u00ebnin t\u00eb v\u00ebshtir\u00eb d\u00ebshmin\u00eb para inspektoratit t\u00eb pun\u00ebs dhe prokuroris\u00eb se ata nuk ishin dakord t\u00eb punonin nat\u00ebn dhe jasht\u00eb orarit p\u00ebr shkak t\u00eb t\u00eb cilave ai abuzoi me pozicionin e tyre n\u00eb favor t\u00eb tij, dhe m\u00eb tej n\u00eb kurriz t\u00eb tyre. Ai, jo vet\u00ebm q\u00eb i ka detyruar ato t\u00eb punojn\u00eb n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, ai nuk ua kishte paguar atyre as pun\u00ebn shtes\u00eb jasht\u00eb orarit p\u00ebr t\u00eb cil\u00ebn jan\u00eb konstatuar parregullsi nga ana e Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs, pas denoncimit nga Komiteti i Helsinkit.<\/p>\n<p>Ligji p\u00ebr marr\u00ebdh\u00ebniet e pun\u00ebs parashikon mbrojtje t\u00eb ve\u00e7ant\u00eb gjat\u00eb shtatz\u00ebnis\u00eb dhe prind\u00ebrimit n\u00eb lidhje me pun\u00ebn gjat\u00eb nat\u00ebs dhe pun\u00ebn jasht\u00eb orarit. N\u00eb fakt, gjat\u00eb shtatz\u00ebnis\u00eb ose me nj\u00eb f\u00ebmij\u00eb deri n\u00eb nj\u00eb vje\u00e7, pun\u00ebtorja nuk duhet t\u00eb punoj\u00eb jasht\u00eb orarit ose t\u00eb punoj\u00eb gjat\u00eb nat\u00ebs (neni 164, paragrafi 1). Nj\u00eb pun\u00ebtore q\u00eb ka nj\u00eb f\u00ebmij\u00eb nga nj\u00eb deri n\u00eb tre vje\u00e7 mund t&#8217;i k\u00ebrkohet t\u00eb punoj\u00eb jasht\u00eb orarit ose t\u00eb punoj\u00eb gjat\u00eb nat\u00ebs, vet\u00ebm me p\u00eblqimin e saj paraprak me shkrim (164, paragrafi 2). P\u00eblqimi me shkrim nga ana e pun\u00ebtores duhet t\u00eb jepet lirisht dhe vullnetarisht pa imponim ose k\u00ebrc\u00ebnim.<\/p>\n<p>Kjo m\u00ebnyr\u00eb e t\u00eb vepruarit t\u00eb pun\u00ebdh\u00ebn\u00ebsit, i cili fjal\u00eb p\u00ebr fjal\u00eb i ka detyruar grat\u00eb pun\u00ebtore t\u00eb punojn\u00eb gjat\u00eb nat\u00ebs dhe jasht\u00eb orarit, paraqet nj\u00eb vep\u00ebr penale kund\u00ebr marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs dhe shkelen dispozitat p\u00ebr pun\u00ebn gjat\u00eb nat\u00ebs dhe jasht\u00eb orarit, p\u00ebr t\u00eb cilat \u00ebsht\u00eb parashikuar nj\u00eb gjob\u00eb n\u00eb para ose burgim deri n\u00eb nj\u00eb vit.<strong>\u00a0<\/strong><\/p>\n<p><strong>DHUNA ME BAZ\u00cb GJINORE<\/strong><\/p>\n<p><strong>K\u00ebrkes\u00eb p\u00ebr mbik\u00ebqyrje t\u00eb jasht\u00ebzakonshme inspektuese n\u00eb qendrat p\u00ebr pun\u00eb sociale n\u00eb Strug\u00eb dhe Resnj\u00eb<\/strong><\/p>\n<p>Nj\u00eb k\u00ebrkes\u00eb p\u00ebr ndihm\u00eb juridike falas iu drejtua Komitetit t\u00eb Helsinkit nga nj\u00eb n\u00ebn\u00eb 25-vje\u00e7are nga Resnja, f\u00ebmija 15-muajsh i s\u00eb cil\u00ebs, frut i nj\u00eb bashk\u00ebsi jasht\u00ebmartesore, kishte q\u00ebndruar t\u00eb jetonte me baban\u00eb e saj n\u00eb Strug\u00eb. Nga dokumentet e paraqitura v\u00ebrehen veprime joprofesionale dhe t\u00eb paligjshme t\u00eb Qendr\u00ebs p\u00ebr pun\u00eb sociale Strug\u00eb, e cila padyshim e favorizonte baban\u00eb. N\u00eb fakt, Qendra p\u00ebr pun\u00eb sociale n\u00eb Strug\u00eb e kishte miratuar k\u00ebrkes\u00ebn p\u00ebr dh\u00ebnien e kujdestaris\u00eb babait, kurse p\u00ebr t\u00eb nj\u00ebjt\u00ebn k\u00ebrkes\u00eb t\u00eb n\u00ebn\u00ebs nuk kishte vepruar fare, megjith\u00ebse ishte dor\u00ebzuar paraprakisht. K\u00ebshtu, n\u00eb Vendimin p\u00ebr besimin e f\u00ebmij\u00ebs s\u00eb mitur babait, Qendra p\u00ebr pun\u00eb sociale Strug\u00eb kishte p\u00ebrcaktuar nj\u00eb arsyetim t\u00eb pabaz\u00eb p\u00ebr veprimin e saj: \u201e<em>&#8230; duke marr\u00eb parasysh mosh\u00ebn e f\u00ebmij\u00ebs, nevojat e zhvillimit n\u00eb k\u00ebt\u00eb faz\u00eb t\u00eb zhvillimit personal dhe faktin q\u00eb n\u00ebna ka l\u00ebn\u00eb bashk\u00ebshortin dhe f\u00ebmij\u00ebn e mitur, ekipi i ekspert\u00ebve n\u00eb k\u00ebt\u00eb organ vendosi t&#8217;ia caktoj\u00eb f\u00ebmij\u00ebn babait p\u00ebr kujdes dhe edukim\u201c.\u00a0<\/em><\/p>\n<p>Nj\u00eb arsyetim i till\u00eb skandaloz nuk ka asnj\u00eb baz\u00eb n\u00eb Ligjin p\u00ebr familje, i cili nuk p\u00ebrcakton nj\u00eb baz\u00eb p\u00ebr besimin e f\u00ebmij\u00ebs s\u00eb mitur babait, sepse n\u00ebna ka l\u00ebn\u00eb bashk\u00ebsin\u00eb jasht\u00ebmartesore. Sistemi penitenciar ende p\u00ebrballet me v\u00ebshtir\u00ebsi dhe sfida t\u00eb m\u00ebdha, ve\u00e7an\u00ebrisht p\u00ebr sa i p\u00ebrket kushteve materiale, sh\u00ebndetit, arsimit dhe risocializimit t\u00eb personave t\u00eb d\u00ebnuar.<\/p>\n<p>Vite m\u00eb par\u00eb, kemi b\u00ebr\u00eb thirrje p\u00ebr nevoj\u00ebn e em\u00ebrimit t\u00eb njer\u00ebzve n\u00eb postet drejtuese t\u00eb institucioneve t\u00eb vuajtjes s\u00eb d\u00ebnimit, t\u00eb cil\u00ebt jo vet\u00ebm q\u00eb kan\u00eb ekspertiz\u00eb dhe p\u00ebrvoj\u00eb n\u00eb sistemin e burgjeve, por gjithashtu jan\u00eb sensibilizuar p\u00ebr nevoj\u00ebn e promovimit dhe mbrojtjes s\u00eb t\u00eb drejtave themelore t\u00eb njeriut t\u00eb personave t\u00eb d\u00ebnuar dhe t\u00eb paraburgosurve. Em\u00ebrimi i kuadrove joadekuat\u00eb \u00ebsht\u00eb krejt\u00ebsisht n\u00eb kund\u00ebrshtim me p\u00ebrpjekjet e k\u00ebtilla dhe mund t\u00eb \u00e7oj\u00eb n\u00eb regres, n\u00eb vend t\u00eb avancimit t\u00eb sistemit penitenciar n\u00eb vend.<\/p>\n<p><a name=\"_ftn1\"><\/a><a href=\"https:\/\/mhc.org.mk\/news\/naznachuvanjeto-na-nesoodvetni-rakovodni-kadri-e-sprotivno-na-zalozhbite-za-podobar-kazneno-popraven-sistem\/#_ftnref1\">[1]<\/a> Ligji p\u00ebr ekzekutimin e sanksioneve (\u201eGazeta Zyrtare e Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut\u201c nr. 99\/19 dhe 220\/19).<strong>\u00a0<\/strong><\/p>\n<p><strong>Pengesat p\u00ebr akses n\u00eb mbrojtje sh\u00ebndet\u00ebsore n\u00eb institucionet nd\u00ebshkimore-korrektuese<\/strong><\/p>\n<p>Kujdesi sh\u00ebndet\u00ebsor n\u00eb Republik\u00ebn e Maqedonis\u00eb s\u00eb Veriut \u00ebsht\u00eb nj\u00eb e drejt\u00eb e garantuar e parapar\u00eb me dispozit\u00ebn e nenit 39 paragrafi 1 t\u00eb Kushtetut\u00ebs, sipas s\u00eb cil\u00ebs \u00e7do qytetari i garantohet e drejta e kujdesit sh\u00ebndet\u00ebsor.<\/p>\n<p>Ligji p\u00ebr mbrojtje sh\u00ebndet\u00ebsore p\u00ebrcakton, nd\u00ebr t\u00eb tjera, q\u00eb sigurimi i detyruesh\u00ebm sh\u00ebndet\u00ebsor dhe kujdesi themelor sh\u00ebndet\u00ebsor u ofrohen edhe personave q\u00eb vuajn\u00eb d\u00ebnimin me burg, personave q\u00eb jan\u00eb n\u00eb paraburgim, n\u00ebse nuk jan\u00eb t\u00eb siguruar p\u00ebr arsye t\u00eb tjera dhe personave t\u00eb mitur q\u00eb jan\u00eb duke kryer nj\u00eb mas\u00eb edukative, referim n\u00eb nj\u00eb sht\u00ebpi edukativo-korrektuese.<\/p>\n<p>P\u00ebrkund\u00ebr faktit q\u00eb n\u00eb vitin 2019 Drejtoria p\u00ebr Ekzekutimin e Sanksioneve filloi t\u00eb paguante sigurimin sh\u00ebndet\u00ebsor p\u00ebr t\u00eb gjith\u00eb personat e d\u00ebnuar, qasja n\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb themelore t\u00eb t\u00eb d\u00ebnuarve ende nuk ushtrohet normalisht dhe \u00ebsht\u00eb nj\u00eb nga problemet m\u00eb t\u00eb v\u00ebshtira n\u00eb sistemin e institucioneve nd\u00ebshkimore-korrektuese, p\u00ebr t\u00eb cilin ka nevoj\u00eb p\u00ebr nj\u00eb qasje sistemore.<\/p>\n<p>Vet\u00ebm n\u00eb muajin dhjetor n\u00eb Komitetin e Helsinkit u drejtuan kat\u00ebr persona t\u00eb d\u00ebnuar nga INK Manastir dhe ShNK Idrizov\u00eb duke u ankuar se terapia e tyre mjek\u00ebsore u \u00ebsht\u00eb zvog\u00ebluar pa nj\u00eb rekomandim nga nj\u00eb mjek specialist, u jepet n\u00eb sasi m\u00eb t\u00eb vogla, nuk u shp\u00ebrndahet n\u00eb fundjav\u00eb ose t\u00eb d\u00ebnuarit detyrohen t\u00eb paguajn\u00eb gjysm\u00ebn e shum\u00ebs s\u00eb terapis\u00eb nga mjetet vetanake.<\/p>\n<p>Ligji p\u00ebr ekzekutimin e sanksioneve n\u00eb nenin 182 p\u00ebrcakton q\u00eb personave t\u00eb d\u00ebnuar u garantohet e drejta e mbrojtjes sh\u00ebndet\u00ebsore, dhe shpenzimet p\u00ebr kujdesin sh\u00ebndet\u00ebsor bien n\u00eb kurriz t\u00eb Buxhetit t\u00eb RMV-s\u00eb. Prandaj, \u00ebsht\u00eb e papranueshme q\u00eb personat e d\u00ebnuar, t\u00eb cil\u00ebt zakonisht jan\u00eb t\u00eb papun\u00eb, t\u00eb paguajn\u00eb vet\u00eb p\u00ebr terapin\u00eb e tyre mjek\u00ebsore, ta marrin at\u00eb n\u00eb nj\u00eb sasi m\u00eb t\u00eb vog\u00ebl se ajo e p\u00ebrcaktuar nga nj\u00eb mjek specialist ose t\u00eb mos e marrin at\u00eb vazhdimisht gjat\u00eb fundjavave p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb nj\u00eb personi mjek\u00ebsor n\u00eb institucion.<\/p>\n<p>Ju kujtojm\u00eb se aksesi joadekuat n\u00eb mbrojtjen sh\u00ebndet\u00ebsore mund t\u00eb \u00e7oj\u00eb n\u00eb trajtim \u00e7njer\u00ebzor dhe johuman t\u00eb personave t\u00eb d\u00ebnuar, p\u00ebr shkak t\u00eb s\u00eb cil\u00ebs n\u00eb t\u00eb gjitha k\u00ebto raste do t\u00eb k\u00ebrkojm\u00eb t\u00eb zbatohet mbik\u00ebqyrje nga ana e Drejtoris\u00eb p\u00ebr Ekzekutimin e Sanksioneve.<strong>\u00a0<\/strong><\/p>\n<p><strong>GJUHA E URREJTJES<\/strong><strong>\u00a0<\/strong><\/p>\n<p><strong>Gjuha e urrejtjes n\u00eb baz\u00eb etnike m\u00eb e p\u00ebrhapur edhe n\u00eb muajin dhjetor<\/strong><\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut n\u00eb muajin dhjetor 2020, ngjash\u00ebm si n\u00eb vitin 2020, vuri n\u00eb dukje nj\u00eb num\u00ebr t\u00eb lart\u00eb t\u00eb rasteve t\u00eb gjuh\u00ebs s\u00eb urrejtjes n\u00eb mediat sociale. Gjuha e urrejtjes n\u00eb baz\u00eb t\u00eb p\u00ebrkat\u00ebsis\u00eb etnike ishte p\u00ebrs\u00ebri n\u00eb krye t\u00eb list\u00ebs, duke p\u00ebrb\u00ebr\u00eb 48% t\u00eb t\u00eb gjitha rasteve t\u00eb regjistruara p\u00ebr muajin aktual. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, denoncimet e bazuara n\u00eb orientimin politik, orientimin seksual dhe identitetin gjinor u rrit\u00ebn p\u00ebrs\u00ebri n\u00eb dhjetor, me 30% t\u00eb numrit t\u00eb p\u00ebrgjithsh\u00ebm t\u00eb denoncimeve.<\/p>\n<p>Komiteti verifikoi nj\u00eb total prej <em>110 denoncimesh p\u00ebr muajin dhjetor 2020, q\u00eb paraqet nj\u00eb rritje prej 130% krahasuar me t\u00eb nj\u00ebjtin muaj n\u00eb vitin 2019<\/em>.
