Komiteti i Helsinkit n\u00eb raportin e tij t\u00eb muajit n\u00ebntor jep nj\u00eb p\u00ebrmbledhje t\u00eb k\u00ebtyre fushave: t\u00eb drejtat e pun\u00ebtor\u00ebve, grat\u00eb pun\u00ebtore n\u00eb industrin\u00eb e tekstilit, diskriminimi, dhuna me baz\u00eb gjinore, torturat dhe trajtimi \u00e7njer\u00ebzor dhe gjuha e urrejtjes.<\/p>\n<p>Sipas raportit t\u00eb Komisionit Evropian, p\u00ebrparimi i vendit n\u00eb muajin n\u00ebntor u konfirmua edhe nga ana e Parlamentit Evropian. Vihet re se korniza ligjore p\u00ebr mbrojtjen e t\u00eb drejtave themelore \u00ebsht\u00eb kryesisht n\u00eb p\u00ebrputhje me standardet evropiane.<\/p>\n<p>Korniza e bisedimeve q\u00eb u prezantua nga presidenca gjermane p\u00ebr bisedimet midis Bashkimit dhe Maqedonis\u00eb s\u00eb Veriut konstatoi se parakusht kryesor i an\u00ebtar\u00ebsimit jan\u00eb \u201cinstitucionet e q\u00ebndrueshme q\u00eb garantojn\u00eb demokraci, sundimi i ligjit, t\u00eb drejtat e njeriut dhe respektimi dhe mbrojtja e t\u00eb drejtave t\u00eb bashk\u00ebsive jo shumic\u00eb.\u201d Duke marr\u00eb n\u00eb konsiderat\u00eb rishikimin e gjith\u00ebansh\u00ebm t\u00eb procesit t\u00eb p\u00ebrafrimit n\u00eb pjes\u00ebn e kapitujve politik\u00eb, procesi i bisedimeve do t\u00eb filloj\u00eb dhe do t\u00eb p\u00ebrfundoj\u00eb me grupin e par\u00eb themelor (pra edhe Kapitulli 23 &#8211; Gjyq\u00ebsori dhe t\u00eb Drejtat themelore). Komisioni gjithashtu thekson \u00a0se me r\u00ebnd\u00ebsi t\u00eb madhe p\u00ebr vendin \u00ebsht\u00eb avancimi i zbatimit t\u00eb legjislacionit kund\u00ebr gjuh\u00ebs s\u00eb urrejtjes dhe planit t\u00eb veprimit p\u00ebr zbatimin e Konvent\u00ebs s\u00eb Stambollit. Gjuha e urrejtjes \u00ebsht\u00eb ende nj\u00eb sfid\u00eb kryesore p\u00ebr vendin n\u00eb periudh\u00ebn e ardhshme, duke pasur parasysh trendin e mbi 100 denoncimeve n\u00eb muaj q\u00eb nga fillimi i epidemis\u00eb n\u00eb muajin mars t\u00eb vitit 2020.<\/p>\n<p>Propozimi i Korniz\u00ebs negociuese ka p\u00ebr q\u00ebllim t\u00eb mund\u00ebsoj\u00eb koh\u00eb dhe resurse t\u00eb mjaftueshme p\u00ebr krijimin e infrastruktur\u00ebs s\u00eb nevojshme juridike p\u00ebr zbatimin e legjislacionit t\u00eb BE-s\u00eb dhe t\u00eb nd\u00ebrtoj\u00eb nj\u00eb dosje suksesi n\u00eb zbatimin e reformave t\u00eb nd\u00ebrmarra para mbylljes s\u00eb bisedimeve dhe n\u00ebnshkrimit t\u00eb Marr\u00ebveshjes p\u00ebr Aderim n\u00eb Bashkim. Sidoqoft\u00eb, edhe p\u00ebrkund\u00ebr insistimit t\u00eb Presidenc\u00ebs gjermane dhe negociatave intensive nd\u00ebrmjet delegacioneve t\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut dhe Republik\u00ebs s\u00eb Bullgaris\u00eb, m\u00eb 16 n\u00ebntor K\u00ebshilli i Bashkimit Evropian nuk arriti unanimitet p\u00ebr fillimin e negociatave dhe mbajtjen e konferenc\u00ebs s\u00eb par\u00eb nd\u00ebrqeveritare n\u00eb muajin dhjetor. Pavar\u00ebsisht insistimit p\u00ebr t\u00eb p\u00ebrfshir\u00eb k\u00ebrkesat e Bullgaris\u00eb n\u00eb korniz\u00ebn e negociatave, megjithat\u00eb, vendet e tjera an\u00ebtare refuzuan unanimisht k\u00ebt\u00eb k\u00ebrkes\u00eb. Bashkimi Evropian, i p\u00ebrfaq\u00ebsuar nga presidenca gjermane, theksoi se \u00e7\u00ebshtjet bilaterale duhet t\u00eb mbahen jasht\u00eb korniz\u00ebs negociuese.<\/p>\n<p><strong>T\u00cb DREJTAT E PUN\u00cbTOR\u00cbVE<\/strong><\/p>\n<p><em>21 <\/em><em>denoncime, <\/em><em>70 pun\u00ebtor\u00eb t\u00eb p\u00ebrfshir\u00eb<\/em><\/p>\n<p><em>\u00a071% <\/em><em>gra<\/em><em> 29<\/em><em>% <\/em><em>burra<\/em><\/p>\n<p><strong>Zjarrfik\u00ebsit luftuan p\u00ebr t\u00eb drejtat e tyre t\u00eb pun\u00ebs<\/strong><u><\/u><\/p>\n<p>Pas protestave t\u00eb zjarrfik\u00ebsve q\u00eb u mbajt\u00ebn muajin e kaluar, duke k\u00ebrkuar q\u00eb pagat e tyre t\u00eb harmonizoheshin me nivelin e pagave t\u00eb p\u00ebrcaktuara me ligj, Qyteti i Shkupit informoi publikun se ishte arritur nj\u00eb zgjidhje e p\u00ebrkohshme sa i p\u00ebrket k\u00ebtij problemi. Gjegj\u00ebsisht, shtesa e pag\u00ebs prej 20 p\u00ebrqind p\u00ebr shkak t\u00eb llojit dhe natyr\u00ebs s\u00eb pun\u00ebs q\u00eb kryejn\u00eb zjarrfik\u00ebsit profesionist\u00eb, e parashikuar me Ligjin p\u00ebr zjarrfikjen dhe e konfirmuar me aktvendime t\u00eb gjykat\u00ebs, do t\u00eb paguhet n\u00eb baz\u00eb t\u00eb ndryshimeve n\u00eb rregulloren e pagave. Bazuar n\u00eb rregulloren e ndryshuar, paga baz\u00eb e zjarrfik\u00ebsve do t\u00eb harmonizohet q\u00eb nga muaji dhjetor dhe kjo zgjidhje e p\u00ebrkohshme do t\u00eb jet\u00eb e vlefshme derisa t\u00eb miratohet nj\u00eb zgjidhje ligjore afatgjat\u00eb n\u00eb Kuvend p\u00ebr t\u00eb rregulluar k\u00ebt\u00eb \u00e7\u00ebshtje.<\/p>\n<p>N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, procedurat gjyq\u00ebsore p\u00ebr shtesat e papaguara t\u00eb pagave do t\u00eb shmangen, dhe Qyteti i Shkupit nuk do t\u00eb r\u00ebndohet me pagimin e borxheve, interesave, shpenzimeve gjyq\u00ebsore, t\u00eb avokat\u00ebve dhe shpenzimeve t\u00eb p\u00ebrmbaruesve.<\/p>\n<p><strong>Pun\u00ebtor\u00ebt me s\u00ebmundje kronike kan\u00eb mbetur pa mbrojtje sistemike<\/strong><u><\/u><\/p>\n<p>Pun\u00ebtor\u00ebt me disa probleme t\u00eb caktuara sh\u00ebndet\u00ebsore dhe s\u00ebmundje kronike u kthyen n\u00eb vendet e tyre t\u00eb pun\u00ebs dhe n\u00eb kryerjen e rregullt t\u00eb detyrave t\u00eb tyre t\u00eb pun\u00ebs n\u00eb muajin shtator, kur Qeveria vendosi q\u00eb kjo mas\u00eb t\u00eb pushoj\u00eb s\u00eb zbatuari. Shkalla e personave t\u00eb sapo diagnostikuar arrin 364 n\u00eb 100.000 banor\u00eb p\u00ebr nj\u00eb periudh\u00eb prej nj\u00eb jave, dhe p\u00ebr t\u00eb nj\u00ebjt\u00ebn periudh\u00eb, n\u00eb 27.8% t\u00eb rasteve t\u00eb ekzaminuara epidemiologjikisht \u00ebsht\u00eb konstatuar prania e kushteve kronike sh\u00ebndet\u00ebsore. Kjo do t\u00eb thot\u00eb q\u00eb nd\u00ebrprerja e vlefshm\u00ebris\u00eb s\u00eb k\u00ebsaj mase ka l\u00ebn\u00eb pun\u00ebtor\u00ebt me s\u00ebmundje kronike pa mbrojtje sistemike n\u00eb nj\u00eb nga momentet m\u00eb kritike t\u00eb pandemis\u00eb.<\/p>\n<p>N\u00eb k\u00ebt\u00eb drejtim edhe Shoqata e specialist\u00ebve dhe mjek\u00ebve t\u00eb rinj parashtroi propozime konkrete p\u00ebr trajtimin e kriz\u00ebs dhe dhan\u00eb kontributin e tyre n\u00eb leht\u00ebsimin e procesit t\u00eb miratimit t\u00eb masave dhe rekomandimeve t\u00eb reja p\u00ebr parandalimin e virusit korona. Midis k\u00ebtyre, u b\u00eb nj\u00eb propozim p\u00ebr t\u2019i liruar pun\u00ebtor\u00ebt me s\u00ebmundje kronike nga puna dhe obligimet e tyre n\u00eb vendin e pun\u00ebs. P\u00ebrkund\u00ebr premtimeve t\u00eb Qeveris\u00eb se do t\u00eb vazhdoj\u00eb t\u00eb marr\u00eb t\u00eb gjitha masat e nevojshme p\u00ebr t\u00eb mbrojtur t\u00eb gjith\u00eb pun\u00ebtor\u00ebt dhe vendet e tyre t\u00eb pun\u00ebs, publiku nuk \u00ebsht\u00eb informuar n\u00ebse kjo \u00e7\u00ebshtje konkrete \u00ebsht\u00eb duke u shqyrtuar.<\/p>\n<p><strong>Pasiguri n\u00eb vendin e pun\u00ebs gjat\u00eb kriz\u00ebs m\u00eb t\u00eb r\u00ebnd\u00eb sh\u00ebndet\u00ebsore dhe t\u00eb pun\u00ebs <\/strong><u><\/u><\/p>\n<p>M\u00eb 31 tetor, rreth dyzet motrave medicinale, t\u00eb cilat kan\u00eb punuar p\u00ebr m\u00eb shum\u00eb se dy vjet n\u00eb ISHP Qendra Sh\u00ebndet\u00ebsore Shkup, u \u00ebsht\u00eb nd\u00ebrpre marr\u00ebdh\u00ebnia e pun\u00ebs, p\u00ebr shkak t\u00eb skadimit t\u00eb afatit t\u00eb kontratatave t\u00eb pun\u00ebs q\u00eb i kan\u00eb lidhur p\u00ebr koh\u00eb t\u00eb caktuar. Zgjatja e kontratave t\u00eb tyre t\u00eb pun\u00ebs k\u00ebrkonte p\u00eblqimin e Fondit t\u00eb Sigurimeve Sh\u00ebndet\u00ebsore si institucioni kompetent p\u00ebr miratimin dhe aprovimin e buxhetit p\u00ebr angazhimin e stafit mjek\u00ebsor. Vet\u00ebm nj\u00eb dit\u00eb pasi historia e motrave medicinale t\u00eb cilave u kishin skaduar kontratat e pun\u00ebsimit p\u00ebr koh\u00eb t\u00eb caktuar dhe si rezultat nuk shkonin n\u00eb pun\u00eb u shp\u00ebrnda n\u00eb rrjetet sociale m\u00eb 23 n\u00ebntor, Fondi dha p\u00eblqimin p\u00ebr vazhdimin e kontratave t\u00eb tyre.<\/p>\n<p>Autore: Arbnora Memeti<\/p>\n<p>N\u00eb vitin 2018, madje 25,8 p\u00ebrqind e numrit t\u00eb p\u00ebrgjithsh\u00ebm t\u00eb t\u00eb pun\u00ebsuarve kishin lidhur kontrata me afat t\u00eb caktuar, q\u00eb do t\u00eb thot\u00eb se sot m\u00eb shum\u00eb se \u00e7do i kat\u00ebrti punonj\u00ebs n\u00eb Maqedoni \u00ebsht\u00eb i angazhuar p\u00ebrmes k\u00ebtij lloji t\u00eb kontrat\u00ebs. P\u00ebr punonj\u00ebsit sh\u00ebndet\u00ebsor\u00eb t\u00eb cil\u00ebve kontratat me afat t\u00eb caktuar u skadojn\u00eb gjat\u00eb nj\u00eb krize ekonomike t\u00eb k\u00ebtyre p\u00ebrmasave, kjo \u00ebsht\u00eb nj\u00eb goditje e konsiderueshme p\u00ebr ta, si nj\u00eb nga kategorit\u00eb m\u00eb t\u00eb prekura t\u00eb pun\u00ebtor\u00ebve. Ata po luftojn\u00eb n\u00eb vij\u00ebn e par\u00eb t\u00eb frontit kund\u00ebr virusit korona, t\u00eb privuar nga nj\u00ebra nga shtyllat e t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve &#8211; siguria n\u00eb vendin e pun\u00ebs.<\/p>\n<p>Ligji i ri p\u00ebr marr\u00ebdh\u00ebniet e pun\u00ebs, i cili duhet t\u00eb jet\u00eb n\u00eb procedur\u00eb parlamentare n\u00eb fillim t\u00eb vitit 2021, parashikon q\u00eb nj\u00eb kontrat\u00eb pune me koh\u00eb t\u00eb caktuar mund t\u00eb lidhet, me ose pa nd\u00ebrprerje, p\u00ebr nj\u00eb afat maksimal prej tre vjet\u00ebsh. Kjo n\u00ebnkupton nj\u00eb ulje t\u00eb kufirit aktual ku kufiri i sip\u00ebrm \u00ebsht\u00eb vendosur n\u00eb pes\u00eb vjet. P\u00ebr m\u00eb tep\u00ebr, Ligji i ri parashikon se nj\u00eb kontrat\u00eb pun\u00ebsimi me koh\u00eb t\u00eb caktuar \u00ebsht\u00eb nj\u00eb p\u00ebrjashtim dhe se me nj\u00eb kontrat\u00eb t\u00eb till\u00eb nuk mund t\u00eb pun\u00ebsohen m\u00eb shum\u00eb se 20 p\u00ebrqind t\u00eb numrit t\u00eb p\u00ebrgjithsh\u00ebm t\u00eb t\u00eb pun\u00ebsuarve te pun\u00ebdh\u00ebn\u00ebsi. P\u00ebrkund\u00ebr faktit q\u00eb edhe afati tre-vje\u00e7ar \u00ebsht\u00eb shum\u00eb i gjat\u00eb dhe i mban pun\u00ebtor\u00ebt n\u00eb nj\u00eb pozit\u00eb t\u00eb palakmueshme, ulja pothuajse e dyfisht\u00eb \u00ebsht\u00eb nj\u00eb ndryshim pozitiv sa i p\u00ebrket mbrojtjes t\u00eb t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve.<\/p>\n<p><strong>GRAT\u00cb PUN\u00cbTORE N\u00cb INDUSTRIN\u00cb E TEKSTILIT<\/strong><\/p>\n<p><strong>Po vazhdojn\u00eb shkeljet e t\u00eb drejtave t\u00eb pun\u00ebs t\u00eb grave pun\u00ebtore n\u00eb industrin\u00eb e tekstilit <\/strong><\/p>\n<p>N\u00eb muajin n\u00ebntor, Komiteti i Helsinkit regjistroi 88 raste t\u00eb shkeljes s\u00eb t\u00eb drejtave t\u00eb pun\u00ebs t\u00eb grave pun\u00ebtore n\u00eb industrin\u00eb e tekstilit dhe parashtroi kat\u00ebr k\u00ebrkesa p\u00ebr mbik\u00ebqyrje t\u00eb jasht\u00ebzakonshme inspektuese n\u00eb fabrikat e tekstilit p\u00ebr shkelje t\u00eb t\u00eb drejtave t\u00eb pun\u00ebs t\u00eb grave pun\u00ebtore n\u00eb industrin\u00eb e tekstilit. N\u00eb nj\u00eb prej rasteve b\u00ebhet fjal\u00eb p\u00ebr paga t\u00eb papaguara. Gjegj\u00ebsisht, pun\u00ebdh\u00ebn\u00ebsi nuk uw ka paguar pun\u00ebtor\u00ebve pagat p\u00ebr muajt korrik, gusht, shtator dhe n\u00ebntor. N\u00eb dy prej rasteve b\u00ebhet fjal\u00eb p\u00ebr mospagim t\u00eb pag\u00ebs minimale n\u00eb p\u00ebrputhje me ligjin. N\u00eb k\u00ebt\u00eb rast, pun\u00ebdh\u00ebn\u00ebsit u kishin paguar punonj\u00ebsve paga m\u00eb t\u00eb ul\u00ebta se paga minimale e p\u00ebrcaktuar ligj\u00ebrisht p\u00ebr muajin shtator dhe tetor. N\u00eb rastin e fundit, pun\u00ebdh\u00ebn\u00ebsi kishte themeluar kontrata pun\u00ebsimi me punonj\u00ebsit e tij me koh\u00eb t\u00eb pjesshme prej 4-or\u00ebsh, kurse punonj\u00ebsit kishin punuar me orar t\u00eb plot\u00eb pune prej 8-or\u00ebsh. K\u00ebrkesa drejtuar Kuvendit thekson nevoj\u00ebn p\u00ebr t\u00eb zgjedhur kandidat\u00eb profesionist\u00eb dhe t\u00eb pavarur t\u00eb cil\u00ebt n\u00eb asnj\u00eb m\u00ebnyr\u00eb nuk jan\u00eb t\u00eb lidhur me partit\u00eb politike. Prandaj, p\u00ebrkat\u00ebsia etnike nuk duhet t\u00eb jet\u00eb kriteri i vet\u00ebm, ve\u00e7an\u00ebrisht kuptimi i tij i ngusht\u00eb si nj\u00eb ndarje e pozitave midis maqedonasve dhe shqiptar\u00ebve. \u00cbsht\u00eb e nevojshme t\u00eb merret parasysh barazia gjinore dhe t\u00eb p\u00ebrfshihen p\u00ebrfaq\u00ebsues t\u00eb komuniteteve t\u00eb margjinalizuara (rom\u00eb, persona me aft\u00ebsi t\u00eb kufizuara, LGBTI dhe t\u00eb tjer\u00eb).<\/p>\n<p>Lidhur me zgjedhjen e Avokatit t\u00eb ri t\u00eb Popullit, Rrjeti p\u00ebr mbrojtje nga diskriminimi theksoi q\u00eb Kuvendi gjat\u00eb zgjedhjes duhet t\u00eb marr\u00eb parasysh q\u00eb Avokati i Popullit n\u00eb t\u00eb ardhmen t\u00eb jet\u00eb nj\u00eb person i cili do t\u00eb kap\u00ebrcej\u00eb problemet e identifikuara p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb t\u00eb institucionit, t\u00eb cilat i referohen munges\u00ebs s\u00eb shp\u00ebrndarjes s\u00eb drejt\u00eb t\u00eb financave dhe burimeve njer\u00ebzore, shkall\u00ebs s\u00eb ekspertiz\u00ebs dhe kompetenc\u00ebs s\u00eb nj\u00eb pjese t\u00eb r\u00ebnd\u00ebsishme t\u00eb stafit t\u00eb institucionit, shpalljes publike t\u00eb konflikteve nd\u00ebrpersonale dhe mobingut n\u00eb institucion dhe plot\u00ebsimin e vendeve t\u00eb lira n\u00eb p\u00ebrputhje me Rregulloren p\u00ebr sistemimin n\u00eb sh\u00ebrbimin profesional, n\u00eb ekipin e Mekanizmit komb\u00ebtar t\u00eb parandalimit, n\u00eb departamentet e ve\u00e7anta dhe n\u00eb zyrat e Avokatit t\u00eb Popullit.<strong>\u00a0<\/strong><\/p>\n<p><strong>DHUNA ME BAZ\u00cb GJINORE<\/strong><\/p>\n<p><strong>Mosveprimi (d\u00ebshtimi) i institucioneve n\u00eb rastet e dhun\u00ebs n\u00eb familje <\/strong><\/p>\n<p><strong>Rasti n\u00eb Tetov\u00eb<\/strong><\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut, p\u00ebrmes nj\u00eb teksti t\u00eb botuar n\u00eb median SDK.mk m\u00eb 19 n\u00ebntor, mori informacion n\u00eb lidhje me mosveprimin e n\u00ebpun\u00ebsve policor\u00eb pas denoncimit t\u00eb dhun\u00ebs n\u00eb familje. Sipas informacioneve fillestare, b\u00ebhet fjal\u00eb p\u00ebr nj\u00eb rast dhune n\u00eb familje n\u00eb Tetov\u00eb, i cili ishte denoncuar n\u00eb polici p\u00ebr disa her\u00eb. Viktima ishte e ekspozuar dhun\u00ebs nga ana e bashk\u00ebshortit t\u00eb saj, n\u00eb form\u00ebn e frik\u00ebsimit verbal dhe joverbal, p\u00ebrdhunimit, detyrimit, ndjekjes, sulmit fizik, privimit t\u00eb t\u00eb ardhurave mujore, etj, nd\u00ebrsa si viktima indirekte paraqiten edhe f\u00ebmij\u00ebt e tyre t\u00eb mitur q\u00eb shpesh ishin d\u00ebshmitar\u00eb t\u00eb p\u00ebrdhunimit dhe dhun\u00ebs fizike n\u00eb p\u00ebrgjith\u00ebsi. N\u00eb jav\u00ebn para k\u00ebtij incidenti t\u00eb fundit, ishte konstatuar se dhunuesi ishte pozitiv me virusin Kovid-19. M\u00eb 17 n\u00ebntor, rreth or\u00ebs 22, kur viktima ishte sulmuar fizikisht nga bashk\u00ebshorti i saj, ajo menj\u00ebher\u00eb rastin e kishte denoncuar n\u00eb polici. P\u00ebrgjigja nga stacioni kompetent policor n\u00eb Tetov\u00eb ishte: &#8220;Ne nuk mund t\u00eb kryejm\u00eb nd\u00ebrhyrje n\u00eb k\u00ebt\u00eb rast konkret, sepse autori i vepr\u00ebs \u00ebsht\u00eb pozitiv me virusin Kovid-19&#8221;. Nd\u00ebrsa dhunuesi po e maltretonte at\u00eb para f\u00ebmij\u00ebve t\u00eb tyre, n\u00ebpun\u00ebsit policor\u00eb e thirr\u00ebn me telefon viktim\u00ebn q\u00eb ishte n\u00eb rrezik, n\u00eb m\u00ebnyr\u00eb q\u00eb oficer\u00ebt e sh\u00ebrbimit t\u00eb d\u00ebgjonin se \u00e7far\u00eb po ndodhte &#8220;drejtp\u00ebrdrejt&#8221; n\u00eb sht\u00ebpi. Megjith\u00ebse n\u00ebpun\u00ebsit e policis\u00eb e dinin dhe ishin t\u00eb vet\u00ebdijsh\u00ebm se jeta dhe sh\u00ebndeti i viktim\u00ebs ishin n\u00eb rrezik serioz, ata me vet\u00ebdije kishin vendosur t\u00eb mos nd\u00ebrhyjn\u00eb n\u00eb sht\u00ebpi sepse autori kishte qen\u00eb pozitiv me virusin Kovid &#8211; 19. P\u00ebr m\u00eb tep\u00ebr, p\u00ebrgjigja nga Ministria e Pun\u00ebve t\u00eb Brendshme thot\u00eb se Sektori p\u00ebr Pun\u00eb t\u00eb Brendshme &#8211; Tetov\u00eb ka pajisje mbrojt\u00ebse ndaj virusit Kovid &#8211; 19 dhe se ato p\u00ebrdoren nga n\u00ebpun\u00ebsit policor\u00eb n\u00eb baz\u00eb t\u00eb nj\u00eb vler\u00ebsimi paraprak.<\/p>\n<p>N\u00eb rastet kur dhuna n\u00eb familje mbetet e pa denoncuar ose institucionet p\u00ebrkat\u00ebse, si\u00e7 \u00ebsht\u00eb Ministria e Pun\u00ebve t\u00eb Brendshme, nuk i sigurojn\u00eb mbrojtje adekuate viktim\u00ebs, rriten gjasat q\u00eb dhuna t\u00eb rezultoj\u00eb n\u00eb nj\u00eb femicidit. Prandaj, \u00ebsht\u00eb e papranueshme q\u00eb n\u00ebpun\u00ebsit e policis\u00eb t\u00eb cil\u00ebt duhet t\u00eb jen\u00eb n\u00eb vijat e para p\u00ebr t\u00eb mbrojtur viktimat e dhun\u00ebs n\u00eb familje, t\u00eb mos mbajn\u00eb pajisjet e nevojshme mbrojt\u00ebse ndaj virusit Kovid-19 dhe k\u00ebshtu t\u00eb veprojn\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb pamatur i shkelin t\u00eb drejtat e njeriut t\u00eb viktimave duke i v\u00ebn\u00eb jet\u00ebt e tyre n\u00eb rrezik.<\/p>\n<p>N\u00eb rastin n\u00eb fjal\u00eb, n\u00ebpun\u00ebsit e policis\u00eb shkel\u00ebn r\u00ebnd\u00eb dispozitat e Ligjit p\u00ebr parandalim dhe mbrojtje nga dhuna n\u00eb familje, ku Neni 29 parashikon q\u00eb: \u201cKurdoher\u00eb q\u00eb ka nj\u00eb raport t\u00eb dhun\u00ebs n\u00eb familje, dhe p\u00ebr t\u00eb eleminuar rrezikun e menj\u00ebhersh\u00ebm dhe serioz p\u00ebr jet\u00ebn dhe integritetin fizik t\u00eb viktim\u00ebs dhe an\u00ebtar\u00ebve t\u00eb familjes s\u00eb saj, oficeri i policis\u00eb \u00ebsht\u00eb i detyruar t\u00eb shkoj\u00eb n\u00eb vendin e ngjarjes dhe t\u00eb p\u00ebrgatis\u00eb nj\u00eb raport policor menj\u00ebher\u00eb, jo m\u00eb von\u00eb se 12 or\u00eb pas nd\u00ebrhyrjes n\u00eb ngjarje. I nj\u00ebjti nen n\u00eb paragrafin 2 parasheh se &#8220;N\u00ebpun\u00ebsi i policis\u00eb n\u00eb rastet e dhun\u00ebs n\u00eb familje, kur nd\u00ebrmerr pun\u00eb policore dhe zbaton kompetenca policore, masa operative-teknike dhe parandaluese t\u00eb p\u00ebrcaktuara me Ligjin p\u00ebr Policin\u00eb, gjithmon\u00eb b\u00ebn nj\u00eb vler\u00ebsim t\u00eb rrezikut t\u00eb jet\u00ebs dhe integritetit fizik t\u00eb viktim\u00ebs dhe rrezikut t\u00eb p\u00ebrs\u00ebritjes s\u00eb dhun\u00ebs, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb mbrohet viktima, p\u00ebrmes menaxhimit t\u00eb duhur t\u00eb rrezikut.\u201d<\/p>\n<p>M\u00eb 20 n\u00ebntor, Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut ngriti padi penale pran\u00eb Nj\u00ebsis\u00eb s\u00eb specializuar p\u00ebr ndjekjen e veprave penale t\u00eb kryera nga persona me kompetenca policore dhe an\u00ebtar\u00eb t\u00eb policis\u00eb s\u00eb burgjeve n\u00eb Prokurorin\u00eb Themelore Publike p\u00ebr ndjekjen e krimit t\u00eb organizuar dhe korrupsionit kund\u00ebr n\u00ebpun\u00ebsve t\u00eb policis\u00eb nga Stacioni policor n\u00eb Tetov\u00eb p\u00ebr kryerjen e vepr\u00ebs penale &#8220;Neglizhenc\u00eb gjat\u00eb pun\u00ebs n\u00eb sh\u00ebrbim&#8221; nga neni 353-c paragrafi 2 i Kodit Penal. Komiteti i Helsinkit propozoi, pas nj\u00eb hetimi t\u00eb holl\u00ebsish\u00ebm, marrjen e provave t\u00eb nevojshme materiale dhe verbale dhe konstatimin e gjendjes s\u00eb p\u00ebrgjithshme faktike, q\u00eb Prokuroria Themelore Publike t\u00eb parashtroj\u00eb nj\u00eb aktakuz\u00eb n\u00eb gjykat\u00ebn kompetente kund\u00ebr n\u00ebpun\u00ebsve t\u00eb raportuar t\u00eb policis\u00eb nga Stacioni policor i Tetov\u00ebs p\u00ebr nj\u00eb vep\u00ebr penale, me nj\u00eb rekomandim q\u00eb t\u00eb shpallen fajtor\u00eb dhe t\u00eb nd\u00ebshkohen me nj\u00eb d\u00ebnim par\u00ebsor q\u00eb do t\u00eb ket\u00eb nj\u00eb parandalim t\u00eb ve\u00e7ant\u00eb, por edhe nj\u00eb parandalim t\u00eb p\u00ebrgjithsh\u00ebm q\u00eb n\u00ebpun\u00ebsit policor\u00eb n\u00eb t\u00eb ardhmen t\u00eb mos kryejn\u00eb vepra t\u00eb tilla dhe t\u00eb ngjashme penale.<\/p>\n<p><strong>Rasti n\u00eb K\u00ebr\u00e7ov\u00eb<\/strong><\/p>\n<p>M\u00eb 10 n\u00ebntor, Komiteti i Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut, p\u00ebrmes medias TV 21, mori informacion n\u00eb lidhje me dhun\u00ebn n\u00eb familje t\u00eb kryer ndaj nj\u00eb gruaje nga K\u00ebr\u00e7ova nga ana e bashk\u00ebshortit t\u00eb saj nga fshati Luboten i Shkupit. Komisioni kontaktoi avokatin e viktim\u00ebs nga i cili mor\u00ebm informacion n\u00eb lidhje me rastin dhe na informoi se Ministria e Pun\u00ebve t\u00eb Brendshme kishte filluar dy procedura penale para Prokuroris\u00eb Themelore Publike &#8211; K\u00ebr\u00e7ov\u00eb kund\u00ebr autorit t\u00eb vepr\u00ebs. Procedurat penale u referohen veprave penale nga neni 130 paragrafi 2 dhe neni 149 i Kodit Penal. P\u00ebr m\u00eb tep\u00ebr, ne mor\u00ebm informacion se Ministria e Pun\u00ebve t\u00eb Brendshme po heton edhe p\u00ebr tri vepra t\u00eb tjera t\u00eb dhun\u00ebs n\u00eb familje t\u00eb kryera nga dhunuesi ndaj viktim\u00ebs dhe familjes s\u00eb saj. Sidoqoft\u00eb, edhe pse dy procedime penale p\u00ebr dhun\u00eb n\u00eb familje ishin filluar n\u00eb zyr\u00ebn e prokurorit kompetent kund\u00ebr kryesit t\u00eb vepr\u00ebs penale, hetimet po zhvillohen brenda Ministris\u00eb s\u00eb Pun\u00ebve t\u00eb Brendshme edhe p\u00ebr tri vepra t\u00eb tjera n\u00eb lidhje me dhun\u00ebn n\u00eb familje, dhe m\u00eb 16 n\u00ebntor, Gjykata Themelore n\u00eb K\u00ebr\u00e7ov\u00eb vendosi masa t\u00eb p\u00ebrkohshme kund\u00ebr kryesit t\u00eb vepr\u00ebs p\u00ebr parandalimin dhe mbrojtjen nga dhuna n\u00eb familje, i dyshuari ende po l\u00ebvizte lirsh\u00ebm, po vinte akoma para banes\u00ebs s\u00eb viktim\u00ebs, duke k\u00ebrc\u00ebnuar dhe duke vazhduar t\u00eb sillet dhunsh\u00ebm. Jeta e viktim\u00ebs, f\u00ebmij\u00ebs s\u00eb saj t\u00eb mitur dhe jeta e an\u00ebtar\u00ebve t\u00eb familjes s\u00eb saj jan\u00eb n\u00eb rrezik t\u00eb vazhduesh\u00ebm p\u00ebr \u00e7do dit\u00eb.<\/p>\n<p>Duke marr\u00eb parasysh se reagimi me vones\u00eb i institucioneve mund t\u00eb sjell\u00eb pasoja fatale p\u00ebr viktim\u00ebn, Komiteti i Helsinkit m\u00eb 17 n\u00ebntor n\u00eb Prokurorin\u00eb Themelore Publike &#8211; K\u00ebr\u00e7ov\u00eb ka parashtruar k\u00ebrkes\u00eb p\u00ebr veprim, me q\u00ebllim q\u00eb t\u00eb parandalohet dhuna e m\u00ebtejshme dhe t\u00eb mund\u00ebsohet mbrojtje e viktim\u00ebs dhe familjes s\u00eb saj. Duke pasur parasysh se Prokuroria Themelore Publike ka nj\u00eb nd\u00ebr rolet kryesore n\u00eb k\u00ebt\u00eb procedur\u00eb p\u00ebr mbrojtjen e viktim\u00ebs dhe familjes s\u00eb saj, duhet t\u00eb veproj\u00eb n\u00eb koh\u00eb, shpejt dhe n\u00eb m\u00ebnyr\u00eb efikase p\u00ebr t\u00eb zbatuar procedurat p\u00ebr ngritjen e aktakuzave para gjykatave kompetente, n\u00eb m\u00ebnyr\u00eb q\u00eb autori i dhun\u00ebs t\u00eb shpallej fajtor dhe t\u00eb nd\u00ebshkohej nga ana e gjykat\u00ebs p\u00ebr veprat e kryera. Ajo q\u00eb \u00ebsht\u00eb e nevojshme, deri n\u00eb p\u00ebrfundimin e plot\u00ebfuqish\u00ebm t\u00eb k\u00ebtyre procedurave, dhe p\u00ebr t\u00eb mbrojtur sigurin\u00eb dhe sh\u00ebndetin e viktim\u00ebs dhe familjes s\u00eb saj, si dhe zhvillimin e qet\u00eb t\u00eb procedimeve penale, \u00ebsht\u00eb sigurimi i pranis\u00eb s\u00eb tij ose paraqitja e nj\u00eb propozimi n\u00eb gjykat\u00eb p\u00ebr vendosjen e mas\u00ebs s\u00eb paraburgimit kund\u00ebr autorit t\u00eb vepr\u00ebs.<\/p>\n<p>M\u00eb 16 n\u00ebntor, Komiteti i Helsinkit ka angazhuar edhe nj\u00eb monitorues gjykate p\u00ebr gjykimin n\u00eb K\u00ebr\u00e7ov\u00eb, n\u00eb t\u00eb cilin u vendos\u00ebn masa t\u00eb p\u00ebrkohshme p\u00ebr parandalimin dhe mbrojtjen nga dhuna n\u00eb familje p\u00ebr viktim\u00ebn. Komiteti do t\u00eb vazhdoj\u00eb t\u00eb monitoroj\u00eb zbatimin e m\u00ebtejsh\u00ebm t\u00eb masave t\u00eb vendimit dhe procedurave penale.<strong>\u00a0<\/strong><\/p>\n<p><strong>TORTURA DHE TRAJTIMI \u00c7NJER\u00cbZOR<\/strong><strong>\u00a0<\/strong><\/p>\n<p><strong>P\u00ebrdorim force ndaj nj\u00eb personi t\u00eb burgosur<\/strong><\/p>\n<p>Nj\u00eb person i burgosur q\u00eb vuante nj\u00eb d\u00ebnim me burg n\u00eb INK Burgu Prilep iu drejtua Komitetit t\u00eb Helsinkit p\u00ebr t\u00eb Drejtat e Njeriut sepse, si\u00e7 pohon ai, ai kishte p\u00ebsuar tortur\u00eb dhe trajtim \u00e7njer\u00ebzor nga ana e nj\u00eb komandanti i pun\u00ebsuar n\u00eb k\u00ebt\u00eb institucion.<\/p>\n<p>Gjegj\u00ebsisht, m\u00eb 13 n\u00ebntor, personi i d\u00ebnuar kishte marr\u00eb pjes\u00eb n\u00eb seanc\u00ebn gjyq\u00ebsore n\u00eb cil\u00ebsin\u00eb e t\u00eb pandehurit. Pas p\u00ebrfundimit t\u00eb seanc\u00ebs gjyq\u00ebsore, rrug\u00ebs p\u00ebr ekzekutimin e tij n\u00eb INK Burgu Prilep, ai ishte sulmuar fizikisht nga ana e komandantit q\u00eb po e shoq\u00ebronte. Komiteti i Helsinkit, me rastin e Dit\u00ebs Nd\u00ebrkomb\u00ebtare t\u00eb Toleranc\u00ebs m\u00eb 16 n\u00ebntor 2020, publikoi nj\u00eb seri thirrjesh publike p\u00ebr institucionet kompetente p\u00ebr veprim aktiv n\u00eb terren dhe n\u00eb mediat sociale.<\/p>\n<p>Mesazhi i Komitetit t\u00eb Helsinkit \u00ebsht\u00eb se ne jetojm\u00eb n\u00eb nj\u00eb pjes\u00eb t\u00eb bot\u00ebs q\u00eb \u00ebsht\u00eb p\u00ebrballur me pasojat shkat\u00ebrruese t\u00eb intoleranc\u00ebs dhe produkteve t\u00eb tij shum\u00eb her\u00eb n\u00eb t\u00eb kaluar\u00ebn: urrejtjen dhe dhun\u00ebn. Gjithashtu, bazuar n\u00eb analiz\u00ebn ton\u00eb, ne ritheksojm\u00eb se popullata m\u00eb e re (18-26 vje\u00e7) \u00ebsht\u00eb m\u00eb e ekspozuar ndaj manipulimit dhe keqinformimit dhe shpesh
