Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut n\u00eb raportin e tij p\u00ebr muajin gusht jep nj\u00eb p\u00ebrmbledhje t\u00eb situat\u00ebs me t\u00eb drejtat e pun\u00ebtor\u00ebve, diskriminimin, punonj\u00ebset n\u00eb industrin\u00eb e tekstilit, f\u00ebmij\u00ebt me aft\u00ebsi t\u00eb kufizuara dhe gjuh\u00ebn e urrejtjes.<\/p>\n<p>Korniza e bisedimeve q\u00eb u prezantua nga presidenca gjermane p\u00ebr bisedimet midis Bashkimit dhe Maqedonis\u00eb s\u00eb Veriut konstatoi se parakusht kryesor i an\u00ebtar\u00ebsimit jan\u00eb \u201cinstitucionet e q\u00ebndrueshme q\u00eb garantojn\u00eb demokraci, sundimi i ligjit, t\u00eb drejtat e njeriut dhe respektimi dhe mbrojtja e t\u00eb drejtave t\u00eb bashk\u00ebsive jo shumic\u00eb.<\/p>\n<p>Duke marr\u00eb n\u00eb konsiderat\u00eb rishikimin e gjith\u00ebansh\u00ebm t\u00eb procesit t\u00eb p\u00ebrafrimit n\u00eb pjes\u00ebn e kapitujve politik\u00eb, procesi i bisedimeve do t\u00eb filloj\u00eb dhe do t\u00eb p\u00ebrfundoj\u00eb me grupin e par\u00eb themelor (pra edhe Kapitulli 23 &#8211; Gjyq\u00ebsori dhe t\u00eb Drejtat fundamentale). Metodologjia e re dhe propozimi i Korniz\u00ebs s\u00eb bisedimeve ka p\u00ebr q\u00ebllim:<\/p>\n<p>&#8211; t\u00eb mund\u00ebsoj\u00eb koh\u00eb dhe resurse t\u00eb mjaftueshme p\u00ebr krijimin e infrastruktur\u00ebs s\u00eb nevojshme ligjore p\u00ebr zbatimin e t\u00eb drejt\u00ebs s\u00eb BE-s\u00eb,<\/p>\n<p>&#8211; krijimin e strukturave t\u00eb domosdoshme n\u00eb p\u00ebrputhje me struktur\u00ebn administrative t\u00eb BE-s\u00eb dhe p\u00ebrshtatjen graduale t\u00eb tyre n\u00eb p\u00ebrmbushjen e detyrimeve p\u00ebr an\u00ebtar\u00ebsimin e Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut n\u00eb Bashkimin Evropian dhe<\/p>\n<p>&#8211; nd\u00ebrtimin e nj\u00eb dosje suksesi n\u00eb zbatimin e reformave t\u00eb nd\u00ebrmarra para p\u00ebrmbylljes s\u00eb bisedimeve dhe n\u00ebnshkrimit t\u00eb Marr\u00ebveshjes p\u00ebr aderim n\u00eb Bashkimin Evropian.<\/p>\n<p>Ngjash\u00ebm si muajt e kaluar dhe n\u00eb vij\u00eb t\u00eb drejt\u00eb me prirjen e konstatuar, kujdesi duhet t\u00eb drejtohet kah p\u00ebrballja e kriz\u00ebs socio-ekonomike si rezultat i pandemis\u00eb \u2013 mbrojtjen e bashk\u00ebsive t\u00eb margjinalizuara, zbatimin p\u00ebrkat\u00ebs t\u00eb masave, mbik\u00ebqyrjen dhe zbatimin e duhur. Ajo q\u00eb e sh\u00ebnoi k\u00ebt\u00eb muaj \u00ebsht\u00eb s\u00ebrish rritja e gjuh\u00ebs s\u00eb urrejtjes n\u00eb mediat sociale n\u00eb kontekst t\u00eb mbajtjes s\u00eb zgjedhjeve t\u00eb parakohshme parlamentare dhe formimit t\u00eb qeveris\u00eb s\u00eb re t\u00eb koalicionit midis Lidhjes socialdemokrate t\u00eb Maqedonis\u00eb (LSDM) dhe Bashkimit demokratik p\u00ebr integrim (BDI).<strong>\u00a0<\/strong><\/p>\n<p><strong>T\u00cb DREJTAT E PUN\u00cbTOR\u00cbVE<\/strong><strong>\u00a0<\/strong><\/p>\n<p><strong>Xehetaria paraqet baz\u00ebn e zhvillimit t\u00eb industris\u00eb s\u00eb nj\u00eb vendi<\/strong><strong>,<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> <\/strong><strong>por sa vlen jeta e nj\u00eb minatori n\u00eb Maqedoni<\/strong><strong>?<\/strong><strong><em>\u00a0<\/em><\/strong><\/p>\n<p>\u201eMe rastin e nj\u00eb aksidenti n\u00eb minier\u00ebn \u201eSuvodoll\u201c n\u00eb KXE Manastir, nd\u00ebrsa punonte me makin\u00eb nd\u00ebrtimi, jet\u00ebn e humbi nj\u00eb pun\u00ebtor 60 vje\u00e7.\u201c \u2013 p\u00ebr fat t\u00eb keq, lajmet e tilla u b\u00ebn\u00eb gjithnj\u00eb e m\u00eb t\u00eb shpeshta n\u00eb vendin ton\u00eb. I nj\u00ebjti rast ishte edhe me minatorin q\u00eb humbi jet\u00ebn vet\u00ebm tet\u00eb dit\u00eb para sh\u00ebnimit t\u00eb 28 gushtit \u2013 Dit\u00ebs s\u00eb minator\u00ebve.<\/p>\n<p>Xehetaria edhe m\u00eb tej paraqet nj\u00eb nga industrit\u00eb m\u00eb t\u00eb rrezikshme n\u00eb vendin ton\u00eb, me p\u00ebrqindjen m\u00eb t\u00eb lart\u00eb t\u00eb d\u00ebmtimeve t\u00eb regjistruara n\u00eb vendin e pun\u00ebs. Instituti i sh\u00ebndetit publik, n\u00eb raportin e tij p\u00ebr vitin 2019 v\u00eb n\u00eb dukje se jan\u00eb v\u00ebrejtur gjithsej 1.121 d\u00ebmtime n\u00eb vendin e pun\u00ebs gjat\u00eb vitit t\u00eb kaluar, q\u00eb paraqet nj\u00eb rritje n\u00eb raport me vitin paraprak, madje p\u00ebr 25 p\u00ebrqind. N\u00eb struktur\u00ebn e d\u00ebmtimeve t\u00eb regjistruara p\u00ebr vitin 2019, numri m\u00eb i madh \u00ebsht\u00eb regjistruar n\u00eb industri dhe xehetari, edhe at\u00eb gjithsej 309 d\u00ebmtime ose 27.6 p\u00ebrqind nga numri i p\u00ebrgjithsh\u00ebm i d\u00ebmtimeve t\u00eb regjistruara. N\u00eb raport me vitin 2018, numri i tyre \u00ebsht\u00eb rritur p\u00ebr 3 p\u00ebrqind.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p>Rastet fatale n\u00ebp\u00ebr miniera shpesh jan\u00eb si rezultat i munges\u00ebs s\u00eb masave p\u00ebr mbrojtjen e siguris\u00eb dhe sh\u00ebndetit t\u00eb pun\u00ebtor\u00ebve, munges\u00ebn e pajisjeve personale p\u00ebr mbrojtje, problemeve teknologjike n\u00eb lidhje me sistemin e ajrosjes dhe t\u00eb ngjashme. Kjo do t\u00eb thot\u00eb q\u00eb shumica e d\u00ebmtimeve fatale mund t\u00eb shmangen n\u00ebse respektohen dispozitat e p\u00ebrshkruara p\u00ebr mbrojtjen e minator\u00ebve. P\u00ebr k\u00ebt\u00eb arsye rikujtojm\u00eb se Qeveria dhe pun\u00ebdh\u00ebn\u00ebsit kan\u00eb obligim q\u00eb ta mbrojn\u00eb t\u00eb drejt\u00ebn e jet\u00ebs s\u00eb pun\u00ebtor\u00ebve q\u00eb punojn\u00eb n\u00ebp\u00ebr miniera dhe theksojm\u00eb se edukimi i duhur i pun\u00ebtor\u00ebve dhe zbatimi i teknologjis\u00eb s\u00eb re n\u00eb miniera jan\u00eb nj\u00eb nd\u00ebr masat kryesore q\u00eb duhet t\u00eb zbatohen p\u00ebr parandalimin e aksidenteve t\u00eb tilla n\u00eb miniera. Minator\u00ebt nuk jan\u00eb inpute n\u00eb prodhimtari, nuk jan\u00eb vegla p\u00ebr gjenerimin e fitimeve, nuk jan\u00eb vegla q\u00eb duhet t\u00eb sigurojn\u00eb produktivitetin e nd\u00ebrmarrjeve. Ata jan\u00eb pun\u00ebtor\u00eb, njer\u00ebz t\u00eb mishit dhe gjakut, me ndjenja, me historit\u00eb e tyre t\u00eb jet\u00ebs, me dinjitetin e tyre dhe jemi t\u00eb detyruar q\u00eb t\u2019ju ofrojm\u00eb kushte sa m\u00eb t\u00eb mira n\u00eb pun\u00eb.<\/p>\n<p><strong>(<\/strong><strong>Mos<\/strong><strong>) <\/strong><strong>vazhdimi i pushimit mjek\u00ebsor t\u00eb punonj\u00ebseve p\u00ebr shkak t\u00eb lehonis\u00eb<\/strong><\/p>\n<p>P\u00ebr shkak t\u00eb pandemis\u00eb s\u00eb shkaktuar nga virusi korona, n\u00eb dat\u00eb 02.04.2020, Qeveria miratoi Dekret me t\u00eb cilin pushimi mjek\u00ebsor p\u00ebr shkak t\u00eb shtatz\u00ebnis\u00eb vazhdohet deri n\u00eb skadimin e masave t\u00eb p\u00ebrkohshme p\u00ebr mbrojtje nga p\u00ebrhapja dhe parandalimi i virusit KOVID \u2013 19, kurse kompensimi p\u00ebr pushimin mjek\u00ebsor do t\u00eb vazhdoj\u00eb t\u00eb paguhet.<\/p>\n<p>Nj\u00eb punonj\u00ebse, t\u00eb cil\u00ebs kontrata e pun\u00ebs e themeluar p\u00ebr koh\u00eb t\u00eb caktuar ka skaduar n\u00eb dhjetor 2019, e kishte ushtruar t\u00eb drejt\u00ebn e saj t\u00eb pushimit mjek\u00ebsor p\u00ebr shkak t\u00eb lehonis\u00eb, deri n\u00eb muajin prill t\u00eb k\u00ebtij viti. Pasi q\u00eb Qeveria e miratoi dekretin me fuqi ligjore, me k\u00ebrkes\u00eb t\u00eb punonj\u00ebses, Fondi p\u00ebr sigurim sh\u00ebndet\u00ebsor e kishte njoftuar gojarisht se ajo ishte e p\u00ebrfshir\u00eb me masat qeveritare dhe se pushimi i saj mjek\u00ebsor p\u00ebr shkak t\u00eb shtatz\u00ebnis\u00eb \u00ebsht\u00eb vazhduar. Mir\u00ebpo, p\u00ebr shkak faktit se punonj\u00ebsja nuk e ka marr\u00eb kompensimin e pag\u00ebs p\u00ebr muajt prill dhe maj, ajo s\u00ebrish i \u00ebsht\u00eb drejtuar Fondit p\u00ebr sigurim sh\u00ebndet\u00ebsor, ku k\u00ebsaj here e kan\u00eb njoftuar se pushimi i saj mjek\u00ebsor i shtatz\u00ebnis\u00eb nuk \u00ebsht\u00eb vazhduar sepse kontrata e saj e pun\u00ebsimit kishte skaduar n\u00eb muajin dhjetor t\u00eb vitit 2019.<\/p>\n<p>Ligji p\u00ebr marr\u00ebdh\u00ebniet e pun\u00ebs, n\u00eb nenin 170, paragrafi 2 parashikon se punonj\u00ebses t\u00eb cil\u00ebs i \u00ebsht\u00eb nd\u00ebrprer\u00eb kontrata e pun\u00ebsimit p\u00ebr koh\u00eb t\u00eb caktuar p\u00ebr shkak t\u00eb skadimit t\u00eb kontrat\u00ebs dhe g\u00ebzon kompensimin e pag\u00ebs gjat\u00eb koh\u00ebs s\u00eb pushimit mjek\u00ebsor p\u00ebr shkak t\u00eb shtatz\u00ebnis\u00eb, lehonis\u00eb dhe at\u00ebsis\u00eb, vazhdon t\u00eb ushtroj\u00eb t\u00eb drejt\u00ebn deri n\u00eb skadimin e pushimit mjek\u00ebsor me shpenzimin e institucionit p\u00ebrgjegj\u00ebs p\u00ebr zbatimin e sigurimit t\u00eb detyruesh\u00ebm sh\u00ebndet\u00ebsor. Kjo n\u00ebnkupton se t\u00eb gjitha punonj\u00ebset, t\u00eb cilave u jan\u00eb nd\u00ebrprer\u00eb kontratat e pun\u00ebsimit p\u00ebr koh\u00eb t\u00eb caktuar nd\u00ebrsa kan\u00eb ushtruar t\u00eb drejt\u00ebn e pushimit mjek\u00ebsor p\u00ebr shkak t\u00eb shtatz\u00ebnis\u00eb, pa p\u00ebrjashtim, kan\u00eb t\u00eb drejt\u00eb vazhdimin e pushimit mjek\u00ebsor p\u00ebr shkak t\u00eb shtatz\u00ebnis\u00eb dhe t\u00eb g\u00ebzojn\u00eb kompensim deri n\u00eb skadimin e masave t\u00eb p\u00ebrkohshme.<\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut \u00ebsht\u00eb n\u00eb pritje t\u00eb p\u00ebrgjigjes zyrtare nga ana e Fondit p\u00ebr sigurim sh\u00ebndet\u00ebsor dhe korrigjim t\u00eb m\u00ebnyr\u00ebs s\u00eb till\u00eb t\u00eb interpretimit t\u00eb Dekretit, gj\u00eb q\u00eb e v\u00eb k\u00ebt\u00eb grup punonj\u00ebsesh n\u00eb nj\u00eb pozit\u00eb t\u00eb pabarabart\u00eb, duke i pamund\u00ebsuar ato n\u00eb ushtrimin e t\u00eb drejt\u00ebs s\u00eb tyre p\u00ebr pushim mjek\u00ebsor p\u00ebr shkak t\u00eb shtatz\u00ebnis\u00eb.<strong>\u00a0<\/strong><\/p>\n<p><strong>DISKRIMINIMI<\/strong><strong>\u00a0<\/strong><\/p>\n<p><strong>Rrjeti p\u00ebr mbrojtje nga diskriminimi k\u00ebrkon zgjedhjen e profesionist\u00ebve dhe personave kompetent\u00eb n\u00eb institucionin Avokati i Popullit<\/strong><\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut si pjes\u00eb e Rrjetit p\u00ebr mbrojtje nga diskriminimi, n\u00eb m\u00ebnyr\u00eb t\u00eb vazhdueshme e monitoron pun\u00ebn e Avokatit t\u00eb Popullit si nj\u00eb institucion komb\u00ebtar p\u00ebr t\u00eb drejtat e njeriut dhe p\u00ebrgjat\u00eb viteve t\u00eb fundit ka identifikuar shum\u00eb pengesa n\u00eb funksionimin e t\u00ebr\u00ebsish\u00ebm t\u00eb tij, q\u00eb e dob\u00ebsojn\u00eb efikasitetin dhe efektivitetin e tij si institucion dhe e ndalojn\u00eb at\u00eb n\u00eb p\u00ebrmbushjen e plot\u00eb t\u00eb kompetencave t\u00eb tij. Nd\u00ebr problemet urgjente jan\u00eb mungesa e shp\u00ebrndarjes s\u00eb barabart\u00eb t\u00eb burimeve financiare, njer\u00ebzore dhe teknike, si dhe shkalla e profesionalizmit dhe p\u00ebrgatitjes s\u00eb nj\u00eb pjese t\u00eb konsiderueshme t\u00eb stafit. Lajmet e fundit q\u00eb i raportuan mediat n\u00eb lidhje me pun\u00ebn e Avokatit t\u00eb Popullit, respektivisht mosmarr\u00ebveshjet midis Avokatit t\u00eb Popullit Ixhet Memeti dhe z\u00ebvend\u00ebsve t\u00eb tij, si dhe akuzat p\u00ebr n\u00ebn\u00e7mim, shkurtim t\u00eb pushimit vjetor dhe privim t\u00eb t\u00eb drejtave t\u00eb tjera, madje edhe t\u00eb mobingu nga ana e Avokatit t\u00eb Popullit jan\u00eb skandaloze dhe shqet\u00ebsuese. Nj\u00eb situat\u00eb e till\u00eb e shkund seriozisht besimin e qytetar\u00ebve ndaj institucionit dhe r\u00ebnd\u00ebsin\u00eb e rolit t\u00eb tij. Me k\u00ebt\u00eb rast, d\u00ebshirojm\u00eb t\u00eb kujtojm\u00eb se mandati i dyt\u00eb i Avokatit t\u00eb Popullit Ixhet Memeti skadon n\u00eb fund t\u00eb vitit 2020, dhe sipas Ligjit p\u00ebr Avokatin e Popullit, Kuvendi \u00ebsht\u00eb ligj\u00ebrisht p\u00ebrgjegj\u00ebs p\u00ebr t\u00eb filluar procedur\u00ebn p\u00ebr zgjedhjen e Avokatit t\u00eb ri t\u00eb Popullit me an\u00eb t\u00eb shpalljes s\u00eb konkursit jo m\u00eb von\u00eb se tre muaj para skadimit t\u00eb mandatit t\u00eb Avokatit aktual t\u00eb Popullit. Rrjeti p\u00ebr mbrojtje nga diskriminimi k\u00ebrkon nga Kuvendi q\u00eb zgjedhja e Avokatit t\u00eb Popullit t\u00eb jet\u00eb nj\u00eb nd\u00ebr prioritetet e p\u00ebrb\u00ebrjes s\u00eb re parlamentare, t\u00eb zbatohet proces transparent dhe i drejt\u00eb i p\u00ebrzgjedhjes s\u00eb kandidat\u00ebve i \u00e7liruar nga ndikimi i partive politike dhe t\u00eb b\u00ebhet zgjedhja e kandidatit kompetent dhe t\u00eb duhur. Vet\u00ebm n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb do t\u00eb sigurohet nj\u00eb institucion i pavaruar dhe profesional i cili n\u00eb p\u00ebrpikm\u00ebri dhe t\u00ebr\u00ebsi do t\u2019i ushtroj\u00eb t\u00eb gjitha kompetencat e tij ligjor\u00eb p\u00ebr promocion, avancim dhe mbrojtje t\u00eb t\u00eb drejtave dhe lirive t\u00eb njeriut. Nj\u00ebherit, funksionimi i institucionit varet edhe nga k\u00ebshilltar\u00ebt shtet\u00ebror\u00eb, nga bashk\u00ebpun\u00ebtor\u00ebt dhe nga n\u00ebpun\u00ebsit e tjer\u00eb q\u00eb jan\u00eb t\u00eb pun\u00ebsuar n\u00eb t\u00eb. Sipas raportit t\u00eb fundit t\u00eb Avokatit t\u00eb Popullit p\u00ebr vitin 2019, nga 155 vende pune t\u00eb parashikuara me Rregulloren p\u00ebr sistematizimin e vendeve t\u00eb pun\u00ebs n\u00eb sh\u00ebrbimin profesional, n\u00eb ekipin e Mekanizmit komb\u00ebtar p\u00ebr parandalim, n\u00eb departamentet e ve\u00e7anta dhe zyrat e Avokatit t\u00eb Popullit jan\u00eb plot\u00ebsuar vet\u00ebm 90 vende, q\u00eb do t\u00eb thot\u00eb se, madje 65 vende pune jan\u00eb t\u00eb paplot\u00ebsuara. N\u00eb rastin e dyt\u00eb b\u00ebhet fjal\u00eb p\u00ebr nj\u00eb fabrik\u00eb tekstili nga Negotina, e cila nuk e paguan shtes\u00ebn p\u00ebr pun\u00eb jasht\u00eb orarit dhe shtes\u00ebn e pag\u00ebs p\u00ebr stazh pune. Presim q\u00eb Inspektorati Shtet\u00ebror i Pun\u00ebs t\u00eb kryej\u00eb mbik\u00ebqyrje inspektuese p\u00ebr rastet e p\u00ebrmendura, t\u00eb konstatoj\u00eb parregullsit\u00eb dhe t\u00eb urdh\u00ebroj\u00eb m\u00ebnjanimin e shkeljeve t\u00eb t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve nga ana e \u00a0pun\u00ebdh\u00ebn\u00ebsve.<\/p>\n<p><strong>PERSONAT ME AFT\u00cbSI T\u00cb KUFIZUARA<\/strong><strong>\u00a0<\/strong><\/p>\n<p><strong>Arsim p\u00ebr f\u00ebmij\u00ebt me aft\u00ebsi t\u00eb kufizuara<\/strong><\/p>\n<p>Q\u00eb nga fillimi i pandemis\u00eb KOVID-19, f\u00ebmij\u00ebt me nevoja t\u00eb ve\u00e7anta arsimore, sidomos f\u00ebmij\u00ebt me aft\u00ebsi t\u00eb kufizuara, jan\u00eb p\u00ebrballur me sfida t\u00eb shumta n\u00eb procesin arsimor.<\/p>\n<p>Platformat online p\u00ebr m\u00ebsim nga larg\u00ebsia n\u00eb vendin ton\u00eb, t\u00eb cilat e z\u00ebvend\u00ebsuan arsimin e rregullt, me fillimin e izolimit i p\u00ebrjashtuan numrin m\u00eb t\u00eb madh t\u00eb f\u00ebmij\u00ebve me aft\u00ebsi t\u00eb kufizuara. Organizata e Kombeve t\u00eb Bashkuara e ka theksuar rrezikun e rritjes s\u00eb p\u00ebrjashtimit t\u00eb f\u00ebmij\u00ebve me aft\u00ebsi t\u00eb kufizuara nga procesi arsimor si rezultat i kriz\u00ebs aktuale. Vler\u00ebsohet se f\u00ebmij\u00ebt me aft\u00ebsi t\u00eb kufizuara do t\u00eb p\u00ebrfitojn\u00eb m\u00eb s\u00eb paku nga zbatimi i zgjedhjeve alternative p\u00ebr m\u00ebsim nga larg\u00ebsia, e q\u00eb pasohet nga mungesa e mb\u00ebshtetjes n\u00eb sht\u00ebpi, mungesa e qasjes n\u00eb internet, mosekzistimi i softverit t\u00eb aksesuesh\u00ebm dhe materialeve arsimore.<a href=\"#_ftn3\" name=\"_ftnref3\"><sup>[3]<\/sup><\/a><\/p>\n<p>Situata me pandemin\u00eb vet\u00ebm i theksoi mang\u00ebsit\u00eb e shumta n\u00eb zbatimin e Ligjit p\u00ebr arsimin fillor, i cili u miratua para fillimit t\u00eb vitit t\u00eb kaluar shkollor, p\u00ebr t\u00eb cilin Komiteti i Helsinkit ka paralajm\u00ebruar n\u00eb disa raste. Duke marr\u00eb parasysh q\u00eb akoma nuk \u00ebsht\u00eb shpallur konkurs p\u00ebr zgjedhjen e asistent\u00ebve arsimor\u00eb, e drejt\u00eb q\u00eb gjat\u00eb vitit paraprak shkollor mund ta g\u00ebzonin vet\u00ebm nj\u00eb num\u00ebr i vog\u00ebl f\u00ebmj\u00ebsh nga ata q\u00eb kishin nevoj\u00eb, ekzistojn\u00eb indikacione q\u00eb edhe me fillimin e vitit t\u00eb ri shkollor, f\u00ebmij\u00ebt me aft\u00ebsi t\u00eb kufizuara nuk do t\u00eb jen\u00eb n\u00eb gjendje t\u00eb ushtrojn\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb.<\/p>\n<p>Gjat\u00eb muajit gusht, n\u00eb Komitetin e Helsinkit p\u00ebr t\u00eb drejtat e njeriut u denoncua nj\u00eb rast n\u00eb t\u00eb cilin nj\u00eb f\u00ebmije me aft\u00ebsi t\u00eb kufizuara, sipas vler\u00ebsimit funksional t\u00eb b\u00ebr\u00eb gjat\u00eb muajit t\u00eb fundit, \u00ebsht\u00eb konstatuar nevoja p\u00ebr nj\u00eb asistent arsimor, por pas parashtrimit t\u00eb k\u00ebrkes\u00ebs p\u00ebr shfryt\u00ebzimin e k\u00ebsaj mase n\u00eb Komun\u00eb, familja edhe m\u00eb tej nuk ka marr\u00eb asnj\u00eb p\u00ebrgjigje. Pas nj\u00eb komunikimi me Zyr\u00ebn e UNDP-s\u00eb, e cila si nj\u00eb organizat\u00eb bashk\u00ebpunon me komunat p\u00ebr ofrimin e asistenc\u00ebs arsimore, familja mori informacion se UNDP-ja do t\u00eb mbuloj\u00eb 80% t\u00eb shpenzimeve t\u00eb p\u00ebrgjithshme p\u00ebr sigurimin e asistenit arsimor. Nga ky fakt, familja e ka kontaktuar Komun\u00ebn prej ku i kan\u00eb dh\u00ebn\u00eb shpjegime rreth procedur\u00ebs administrative p\u00ebr plot\u00ebsimin e aplikacionit p\u00ebr t\u00eb siguruar asistenc\u00ebn e nevojshme. Megjithat\u00eb, Komuna edhe m\u00eb tej nuk i ka dor\u00ebzuar p\u00ebrgjigje shkoll\u00ebs, as edhe familjes n\u00ebse \u00ebsht\u00eb marr\u00eb nj\u00eb vendim p\u00ebr t\u00eb aprovuar asistenc\u00ebn arsimore dhe p\u00ebr t\u00eb mbuluar shpenzimet e mbetura.<\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut parashtroi k\u00ebrkes\u00eb p\u00ebr dor\u00ebzimin e informacionit n\u00eb Komun\u00eb, por edhe n\u00eb Ministrin\u00eb e Arsimit dhe Shkenc\u00ebs n\u00ebse \u00ebsht\u00eb marr\u00eb ndonj\u00eb vendim me t\u00eb cilin aprovohet asistenca arsimore dhe mbulimi i shpenzimeve t\u00eb mbetura nga ana e Komun\u00ebs, dhe n\u00ebse nuk \u00ebsht\u00eb marr\u00eb vendim, arsyetim se p\u00ebr \u00e7far\u00eb shkaqesh nuk \u00ebsht\u00eb vepruar.<\/p>\n<p>N\u00eb prag t\u00eb vitit t\u00eb ri shkollor, nj\u00eb num\u00ebr i madh nx\u00ebn\u00ebsish vazhdojn\u00eb t\u00eb mos ken\u00eb qasje n\u00eb internet dhe n\u00eb pajisje kompjuterike, madje nuk kan\u00eb qasje as n\u00eb materialet p\u00ebrkat\u00ebse arsimore p\u00ebr realizimin e m\u00ebsimit online, q\u00eb jan\u00eb t\u00eb nj\u00eb r\u00ebnd\u00ebsie t\u00eb ve\u00e7ant\u00eb p\u00ebr f\u00ebmij\u00ebt me aft\u00ebsi t\u00eb kufizuara. P\u00ebr k\u00ebt\u00eb arsye, Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut u ka b\u00ebr\u00eb thirrje t\u00eb gjitha institucioneve t\u00eb r\u00ebnd\u00ebsishme q\u00eb gjat\u00eb miratimit t\u00eb vendimit p\u00ebr zgjedhjen e m\u00ebnyr\u00ebs s\u00eb pun\u00ebs n\u00ebp\u00ebr shkolla n\u00eb vitin e ri shkollor, t\u2019i marrin parasysh edhe nevojat e f\u00ebmij\u00ebve me aft\u00ebsi t\u00eb kufizuara, respektivisht t\u2019ju ofrojn\u00eb kushtet e nevojshme dhe zbatimin e dispozitave ligjore n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb p\u00ebrfshihen pa u penguar n\u00eb procesin arsimor.<strong>\u00a0<\/strong><\/p>\n<p><strong>GJUHA E URREJTJES<\/strong><strong>\u00a0<\/strong><\/p>\n<p><strong>Rritje e gjuh\u00ebs s\u00eb urrejtjes mbi baz\u00ebn e p\u00ebrkat\u00ebsis\u00eb etnike<\/strong><\/p>\n<p>Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut edhe gjat\u00eb muajit gusht ka v\u00ebrejtur num\u00ebr t\u00eb madh denoncimesh n\u00eb lidhje me gjuh\u00ebn e urrejtjes. Komiteti i Helsinkit ka verifikuar gjithsej <strong><em>97 <\/em><\/strong><strong><em>denoncime p\u00ebr muajin gusht<\/em><\/strong><strong><em> 2020<\/em><\/strong>. Shumica e rasteve t\u00eb denoncuara n\u00eb muajin gusht u referohen biseimeve p\u00ebr formimin e Qeveris\u00eb s\u00eb re t\u00eb Republik\u00ebs s\u00eb Maqedonis\u00eb s\u00eb Veriut. N\u00eb ve\u00e7anti ishte regjistruar retorika negative q\u00eb rezultoi n\u00eb rritjen e numrit t\u00eb denoncimeve p\u00ebr gjuh\u00eb t\u00eb urrejtjes n\u00eb mediat sociale mbi baz\u00ebn e p\u00ebrkat\u00ebsis\u00eb etnike dhe politike, madje 45% nga numri i p\u00ebrgjithsh\u00ebm i t\u00eb gjitha denoncimeve p\u00ebr muajin gusht.<\/p>\n<p>Komiteti ka paralajm\u00ebruar vazhdimisht p\u00ebr numrin e lart\u00eb t\u00eb denoncimeve p\u00ebr gjuh\u00eb t\u00eb urrejtjes dhe mund t\u00eb konstatohet se reagimi nga ana e institucioneve kompetente \u00ebsht\u00eb akoma n\u00eb nivel t\u00eb pak\u00ebnaqsh\u00ebm. Sa p\u00ebr ilustrim, p\u00ebr muajin e nj\u00ebjt\u00eb n\u00eb vitin 2019 kur u p\u00ebrshkall\u00ebzua rasti \u2018Zhvatja\u2019 ishin regjistruar 46 denoncime, q\u00eb n\u00eb thelb paraqet rritje p\u00ebr rreth 90 p\u00ebrqind p\u00ebr k\u00ebt\u00eb vit. P\u00ebrmes monitorimit t\u00eb vendosur nga ana e Komitetit, mund t\u00eb v\u00ebrehet se gjuha e urrejtjes p\u00ebrve\u00e7 n\u00eb Facebook u p\u00ebrhap edhe n\u00eb mediat e tjera sociale, sidomos n\u00eb Twitter, Instagram dhe TikTok.<\/p>\n<p>Diskursi negativ nga periudha paszgjedhore n\u00eb muajin korrik vazhdoi edhe n muajin gusht me nj\u00eb retorik\u00eb jasht\u00ebzakonisht t\u00eb intensifikuar dhe ofenduese. Bisedimet rreth formimit t\u00eb Qeveris\u00eb s\u00eb re prodhuan gjuh\u00eb plot urrejtje, e cila kryesisht ishte me karakter etnik n\u00eb kontekst t\u00eb bisedimeve nd\u00ebrmjet Lidhjes socialdemokrate t\u00eb Maqedonis\u00eb (LSDM) dhe Bashkimit demokratik p\u00ebr integrim (BDI). Ishte p\u00ebrdorur gjuh\u00eb ofenduese drejtp\u00ebrdrejt ndaj politikan\u00ebve t\u00eb caktuar, duke i quajtur \u2018t\u00eb shitur\u2019, \u2018tradhtar\u00eb\u2019, etj. Gjithashtu, q\u00eb nga muaji maj 2020, Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut ka v\u00ebrejtur jasht\u00ebzakonisht gjuh\u00eb nacionaliste plot me urrejtje. N\u00eb reagimin e par\u00eb me titull \u201cNuk ka vend p\u00ebr homofobi n\u00eb t\u00eb majt\u00ebn<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a>\u201d, Komiteti p\u00ebrmes Rrjetin komb\u00ebtar p\u00ebr luft\u00eb kund\u00ebr homofobis\u00eb dhe transfobis\u00eb shprhet se \u201cApasiev, si p\u00ebrfaq\u00ebsues i partis\u00eb me ideologji t\u00eb vet\u00ebshpallur majtiste duhet t\u00eb jet\u00eb n\u00eb dijeni se \u00e7do t\u00eb thot\u00eb t\u00eb jesh i shtypur, i p\u00ebrjashtuar, i margjinalizuar dhe i diskriminuar n\u00eb nj\u00eb shoq\u00ebri si e jona.
