{"id":2895,"date":"2019-06-30T10:57:51","date_gmt":"2019-06-30T10:57:51","guid":{"rendered":"https:\/\/new.mhc.org.mk\/?page_id=2895"},"modified":"2024-11-13T20:50:06","modified_gmt":"2024-11-13T20:50:06","slug":"gjednj","status":"publish","type":"page","link":"https:\/\/mhc.org.mk\/sq\/gjednj\/","title":{"rendered":"GJEDNJ"},"content":{"rendered":"<h2>L\u00cbND\u00cb PARA GJEDNJ<\/h2>\n<p><strong>Rasti<\/strong><strong> \u0415.\u0410 <\/strong><strong>kund\u00ebr Maqedonis\u00eb s\u00eb Veriut<\/strong><\/p>\n<p>N\u00eb vitin 2018, Komiteti i Helsinkit p\u00ebr t\u00eb drejtat e njeriut p\u00ebrgatiti dhe parashtroi k\u00ebrkes\u00eb para Gjykat\u00ebs Evropiane p\u00ebr t\u00eb drejtat e njeriut (GJEDNJ) n\u00eb Strazbur p\u00ebr shkeljen e t\u00eb drejtave t\u00eb garantuara me nenin 3 dhe nenin 14 n\u00eb lidhje me nenin 3 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb drejtat e njeriut.<\/p>\n<p>Konketisht, b\u00ebhet fjal\u00eb p\u00ebr rast n\u00eb t\u00eb cilin f\u00ebmij\u00eb i mosh\u00ebs 8 vje\u00e7are gjat\u00eb intervenimit mjek\u00ebsor ka qen\u00eb i maltretuar fizikisht dhe verbalisht nga ana e personelit mjek\u00ebsor n\u00eb nj\u00eb spital n\u00eb brend\u00ebsi t\u00eb Maqedonis\u00eb. Edhe pse rasti s\u00eb pari ishte denoncuar n\u00eb polici, kurse pastaj edhe n\u00eb prokurorin\u00eb kompetente, prokuroria e ka refuzuar k\u00ebt\u00eb denoncim penal. Pasi q\u00eb jan\u00eb shfryt\u00ebzuar t\u00eb gjitha mjetet ligjore t\u00eb vendit, aplikanti i mitur me ndihm\u00eb juridike nga Komiteti i Helsinkit dhe avokati ka parashtruar n\u00eb koh\u00eb k\u00ebrkes\u00ebn para GJEDNJ n\u00eb Strazbur.<\/p>\n<p>N\u00eb m\u00ebnyr\u00eb specifike, shkelja e nenit 3 t\u00eb GJEDNJ ka t\u00eb b\u00ebj\u00eb me faktin se i mituri kishte qen\u00eb i ekspozuar trajtimit jonjer\u00ebzor dhe degradues dhe i d\u00ebnuar duke e goditur n\u00ebp\u00ebr fytyr\u00eb dhe n\u00eb goj\u00eb dhe i fyer nga ana e personave zyrtar\u00eb mjek\u00ebsor\u00eb q\u00eb punojn\u00eb n\u00eb sh\u00ebndet\u00ebsin\u00eb publike, edhe pse kjo \u00ebsht\u00eb e ndaluar n\u00eb shtetin ton\u00eb. Gjykata n\u00eb praktik\u00ebn e saj ka specifikuar se q\u00eb t\u00eb ekzistoj\u00eb trajtim jonjer\u00ebzor, duhet t\u00eb ekzistoj\u00eb niveli minimal i vrazhd\u00ebsis\u00eb q\u00eb ti p\u00ebrfshij\u00eb dispozitat e nenit 3 t\u00eb Konvent\u00ebs. Vler\u00ebsimi p\u00ebr k\u00ebt\u00eb minimum, sipas natyr\u00ebs s\u00eb gj\u00ebrave \u00ebsht\u00eb relativ dhe varet nga rrethanat e rastit, si\u00e7 \u00ebsht\u00eb koh\u00ebzgjatja e trajtimit, efektet mbi sh\u00ebndetin fizik dhe mendor, kurse n\u00eb disa raste edhe gjinia, mosha, gjendja sh\u00ebndet\u00ebsore e viktim\u00ebs dhe t\u00eb ngjashme.<\/p>\n<p>Gjykyta k\u00ebto trajtime i konsideron si jonjer\u00ebzore, n\u00ebse ka qen\u00eb me paramendim ose paramendim t\u00eb mundsh\u00ebm dhe\/ose sa ka zgjatur trajtimi dhe a ka shkaktuar l\u00ebndime t\u00eb v\u00ebrteta trupore ose eventualisht vuajtje mendore. N\u00eb rastin konkret, ekzistojn\u00eb t\u00eb gjitha elementet e lartp\u00ebrmendura n\u00eb veprimet e personave zyrtar\u00eb mjek\u00ebsor\u00eb, respektivisht f\u00ebmija ishte goditur p\u00ebr ta \u201eedukuar\u201c dhe fyer p\u00ebr ta qet\u00ebsuar. Personeli ka vepruar n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb i nxitur nga paragjykimet e tyre p\u00ebr f\u00ebmij\u00ebt rom\u00eb si f\u00ebmij\u00eb t\u00eb \u201epaedukuar\u201c, duke shp\u00ebrfillur faktin se t\u00eb qajturit dhe rezistenca i f\u00ebmij\u00ebs ishte rezultat i dhimbjes s\u00eb p\u00ebsuar nga vet\u00eb thyerja\/fraktura. \u00a0Me k\u00ebt\u00eb rast, f\u00ebmija ka p\u00ebsuar l\u00ebndime trupore shtes\u00eb t\u00eb shprehura n\u00eb form\u00ebn e mavijosjeve\/hematomave n\u00eb pjes\u00ebn e fytyr\u00ebs dhe gjak n\u00eb goj\u00eb, t\u00eb cilat sipas ekspertit subspecialist t\u00eb traumatologjis\u00eb, mund t\u00eb ndodhin vet\u00ebm nga goditja me forc\u00eb, por jo nga intervenimi dhe vet\u00ebl\u00ebndimi nga dora e f\u00ebmij\u00ebs. P\u00ebrve\u00e7 l\u00ebndimeve t\u00eb v\u00ebrteta trupore, aplikanti ka qen\u00eb i ekspozuar edhe ndaj vuajtjeve intenzive mendore p\u00ebr shkak t\u00eb rrahjes dhe fyerjeve nga personat zyrtar\u00eb mjek\u00ebsor\u00eb. Trajtimi do t\u00eb konsiderohet si degradues, at\u00ebher\u00eb kur trajtimi te viktima do t\u00eb shkaktoj\u00eb frik\u00eb, dhimbje dhe inferioritet, duke e n\u00ebn\u00e7muar dhe demoralizuar dhe n\u00eb fund duke e thyer rezistenc\u00ebn fizike dhe morale (Labita v. Italy [GC], no. 26772\/95, \u00a7 120, ECHR 2000-IV). N\u00eb rastin konkret jan\u00eb kryer edhe elementet e trajtimit degradues t\u00eb cilat i ka vuajtur aplikanti nga ana e personave zyrtar\u00eb mjek\u00ebsor\u00eb, t\u00eb cil\u00ebt kan\u00eb deklaruar: \u201eAi f\u00ebmij\u00eb \u00ebsht\u00eb i paedukuar, duhet t\u00eb rrihet m\u00eb tep\u00ebr \u201c ose deklarata: \u201eDo t\u00eb kesh dhimbje, do t\u00eb kesh dhimbje, madje do t\u00eb pyes\u00ebsh n\u00ebse ka akoma \u201c q\u00eb te f\u00ebmija kan\u00eb shkaktuar ndjenj\u00ebn e frik\u00ebs, dhimbjes dhe inferioritetit.<\/p>\n<p>P\u00ebrve\u00e7 k\u00ebsaj, n\u00eb p\u00ebrgjith\u00ebsi duhet t\u00eb merret parasysh edhe mosha e aplikantit i cili n\u00eb koh\u00ebn e ngjarjes ka pasur 8 (tet\u00eb) vjet\u00eb dhe faktin se f\u00ebmija p\u00ebr disa or\u00eb ka vuajtur dhimbje t\u00eb fort\u00eb fizike p\u00ebr shkak t\u00eb fraktur\u00ebs s\u00eb dor\u00ebs. N\u00eb t\u00ebr\u00eb kontekstin, n\u00eb veprimet e personave zyrtar\u00eb mjek\u00ebsor\u00eb ekziston niveli minimal i vrazhd\u00ebsis\u00eb dhe p\u00ebr shkak t\u00eb k\u00ebtij trajtimi t\u00eb personave zyrtar\u00eb mjek\u00ebsor\u00eb p\u00ebrfshihen dispozitat e nenit 3 t\u00eb Konvent\u00ebs (Hurtado v. Switzerland, 28 January 1994, opinionoftheCommission, \u00a7 67, Series A no. 280-A, andWieser v. Austria, no. 2293\/03, \u00a7 36, 22 February 2007).<\/p>\n<p>Shkelje t\u00eb nenit 3 ka edhe nga aspekti i procedur\u00ebs. Konkretisht, shteti ka obligim pozitiv t\u00eb zbatoj\u00eb hetim t\u00eb thell\u00eb dhe efikas. Kjo n\u00ebnkupton marrjen e t\u00eb gjitha hapave t\u00eb arsyesh\u00ebm q\u00eb i ka n\u00eb dispozicion shteti p\u00ebr t\u00eb mbledhur d\u00ebshmi, p\u00ebrfshir\u00eb edhe deklaratat dhe d\u00ebshmit\u00eb forenzike dhe duhet t\u00eb ket\u00eb p\u00ebrpjekje serioze q\u00eb t\u00eb zbulohet se \u00e7ka ka ndodhur dhe sakt\u00eb t\u00eb identifikohen kryer\u00ebsit dhe n\u00eb p\u00ebrputhje me ligjin t\u00eb d\u00ebnohen kurse viktim\u00ebs ti jepet kompenzim i drejt\u00eb (Jashar kund\u00ebr Maqedonis\u00eb; Xheladinov kund\u00ebr Maqedonis\u00eb). Organet e ndjekjes (prokuroria) u ka besuar vet\u00ebm deklaratave t\u00eb dyshuarve, personave t\u00eb tjer\u00eb mjek\u00ebsor\u00eb-d\u00ebshmitar\u00eb q\u00eb kan\u00eb marr\u00eb pjes\u00eb n\u00eb ngjarje dhe ekspertiz\u00ebs, edhe pse k\u00ebto d\u00ebshmi jan\u00eb kund\u00ebrth\u00ebn\u00ebse nj\u00ebra me tjetr\u00ebn dhe nuk p\u00ebrputhen mes vete. Nga ana tjet\u00ebr, prokuroria gjat\u00eb marrjes s\u00eb vendimit aspak nuk i ka marr\u00eb parasysh deklaratat e n\u00ebn\u00ebs, aplikantit, d\u00ebshmitar\u00ebt e aplikantit dhe n\u00eb ve\u00e7anti ishte injoruar ekspertiza e subspecialistit e cila n\u00eb t\u00ebr\u00ebsi i ka rr\u00ebzuar ekspertizat dhe d\u00ebshmit\u00eb paraprake mbi t\u00eb cilat prokuroria e ka bazuar vendimin e saj.<\/p>\n<p>Konventa ndalon \u00e7do lloj t\u00eb diskriminimit n\u00eb baz\u00eb t\u00eb p\u00ebrkat\u00ebsis\u00eb etnike. Nga aspekti material, maltretimi i aplikantit nga ana e personave zyrtar\u00eb mjek\u00ebsor\u00eb, rezulton nga paragjykimet dhe stereotipet ndaj Rom\u00ebve dhe f\u00ebmij\u00ebve rom\u00eb, respektivisht se ata jan\u00eb t\u00eb paedukuar ose keq t\u00eb edukuar, se nuk dijn\u00eb t\u00eb sillen n\u00eb situata t\u00eb caktuara dhe se nuk kan\u00eb respekt ndaj autoriteteve. Kjo konstatohet nga deklarata \u201eSi e ke eduakuar aq keq k\u00ebt\u00eb f\u00ebmij\u00eb, q\u00eb t\u00eb m\u00eb shqelmoj\u00eb k\u00ebshtu, m\u00eb shqelmoi n\u00eb stomak, nuk dua t\u00eb mjekoj k\u00ebsisoj pacienti \u201c q\u00eb ka deklaruar i dyshuari i par\u00eb i cili e ka goditur aplikantin n\u00eb m\u00ebnyr\u00eb d\u00ebnuese p\u00ebr shkak se f\u00ebmija e ka goditur me k\u00ebmb\u00eb n\u00eb stomak, duke konkluduar se kjo ishte rezultat i edukumit t\u00eb keq e jo si reaksion refleksiv nga dhimbja q\u00eb ka pasur aplikanti. Paragjykimet dhe stereotipet konfirmohen edhe nga deklarata e motr\u00ebs medicinale e cila ka th\u00ebn\u00eb: \u201eKy f\u00ebmij\u00eb me t\u00eb v\u00ebrtet\u00eb \u00ebsht\u00eb i paedukuar dhe duhet t\u00eb rrihet m\u00eb tep\u00ebr q\u00eb ti vij\u00eb mendja \u201c, si dhe nga deklarata e t\u00eb dyshuarit t\u00eb dyt\u00eb i cili pasi f\u00ebmija p\u00ebr her\u00eb t\u00eb dyt\u00eb ka k\u00ebrkuar ndihm\u00eb nga e \u00ebma se po e rrahin, ka deklaruar: \u201eE kryem pun\u00ebn ton\u00eb dhe nuk kemi pse t\u00eb angazhohemi m\u00eb tej me ju \u201c.<\/p>\n<p>Kjo k\u00ebrkes\u00eb \u00ebsht\u00eb pranuar si e lejuar dhe gjendet n\u00eb faz\u00ebn e vendimit para Gjykat\u00ebs evropiane.<\/p>\n<p><strong>Rasti KOO<\/strong><strong> ( <\/strong><strong>Kryepeshkopata ortodokse e Ohrit<\/strong><strong> (<\/strong><strong>KOO<\/strong><strong>) <\/strong><strong>respektivisht Kryepeshkopata greko-ortodokse e Ohrit pran\u00eb Patriarkan\u00ebs s\u00eb Pej\u00ebs<\/strong><strong>) <\/strong><strong>kund\u00ebr Maqedonis\u00eb s\u00eb Veriut<\/strong><\/p>\n<p><strong>K\u00ebrkesa<\/strong><strong>\/<\/strong><strong>aktgjykimi<\/strong> <strong>nr<\/strong><strong>. 3532\/07<\/strong><\/p>\n<p>Aplikant\u00ebt n\u00eb vitin 2004 jan\u00eb p\u00ebrpjekur ta regjistrojn\u00eb komunitetin e tyre fetar n\u00eb p\u00ebrputhje me aktet e vlefshme pozitive. P\u00ebr shkak se nuk kan\u00eb pasur sukses para Komisionit (sipas ligjit nga viti 1997) duke i shfryt\u00ebzuar t\u00eb gjitha mekanizmat vendor\u00eb p\u00ebr mbrojtje, kan\u00eb parashtruar ankes\u00eb n\u00eb Gjykat\u00ebn evropiane p\u00ebr t\u00eb drejtat e njeriut p\u00ebr shkelje t\u00eb nenit 11 v.v. nenit 9 t\u00eb Konvent\u00ebs, k\u00ebrkes\u00eb e regjistruar n\u00ebn numrin 3532\/07. N\u00eb nd\u00ebrkoh\u00eb, n\u00eb vitin 2009 \u00ebsht\u00eb miratuar Ligj i ri p\u00ebr gjendjen juridike t\u00eb kishave, komuniteteve fetare dhe grupeve religjioze (Gazeta zyrtare nr. 113\/07), n\u00eb p\u00ebrputhje me t\u00eb cilin ankimuesit kan\u00eb parashtruar k\u00ebrkes\u00eb t\u00eb re p\u00ebr regjistrimin e kish\u00ebs s\u00eb tyre n\u00eb regjistrin p\u00ebrkat\u00ebs.<\/p>\n<p>Por, edhe kjo k\u00ebrkes\u00eb e tyre nuk ishte aprovuar nga ana e gjykat\u00ebs regjistruese n\u00eb Maqedonin\u00eb e Veriut as edhe n\u00eb instancat m\u00eb t\u00eb larta t\u00eb shtetit, me \u00e7rast jan\u00eb p\u00ebrmbushur kushtet p\u00ebr inicimin e procedur\u00ebs s\u00eb re para Gjykat\u00ebs evropiane p\u00ebr t\u00eb drejtat e njeriut (GJEDNJ), pastaj themeluesit kan\u00eb parashtruar ankes\u00eb n\u00eb Gjykat\u00ebn e Strazburit p\u00ebr shkeljen e neneve t\u00eb lartp\u00ebrmendura t\u00eb konvent\u00ebs, k\u00ebrkes\u00eb e cila ishte bashkangjitur l\u00ebnd\u00ebs paraprake t\u00eb regjistruar n\u00ebn ankes\u00ebn nr. 3532\/07.<\/p>\n<p>GJEDNJ duke i vler\u00ebsuar pretendimet e ankes\u00ebs, t\u00eb gjitha d\u00ebshmit\u00eb e mbledhura, p\u00ebrgjigjen e shtetit si dhe standardet nd\u00ebrkomb\u00ebtare q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me respektimin e t\u00eb drejt\u00ebs s\u00eb religjionit dhe besimit, duke u mb\u00ebshtetur n\u00eb praktik\u00ebn e tyre moti t\u00eb vendosur p\u00ebr mbrojtjen e k\u00ebsaj t\u00eb drejte, MIRATOI AKTGJYKIMIN ME T\u00cb CILIN KONSTATON (shiko arsyetimin e aktgjykimit) SE SHTETI (d.m.th Republika e Maqedonis\u00eb s\u00eb Veriut) KA SHKELUR NENIN 11 interpretuar n\u00eb kuptimin e nenit 9 t\u00eb Konvent\u00ebs. Arsyetimin e saj t\u00eb k\u00ebtij aktgjykimi GJEDNJ e jep n\u00eb pjes\u00ebn Vler\u00ebsimi i gjykat\u00ebs (paragrafi 93- 123) ku i vler\u00ebson t\u00eb gjitha aspektet e trajtimit joadekuat nga ana e shtetit n\u00eb k\u00ebt\u00eb rast, n\u00eb ve\u00e7anti duke i elaboruar parimet e p\u00ebrgjithshme t\u00eb gjykat\u00ebs t\u00eb shprehura n\u00eb praktik\u00ebn e deritanishme t\u00eb GJEDNJ, lidhur me rastin konkret i shqyrton edhe mang\u00ebsit\u00eb e supozuara t\u00eb k\u00ebrkes\u00ebs s\u00eb aplikantit para organeve dhe gjykatave nacionale dhe v\u00ebshtrimin m\u00eb t\u00eb detajuar dhe m\u00eb preciz gjykata jep p\u00ebr \u201eorigjin\u00ebn e huaj\u201d t\u00eb ankimuesit dhe em\u00ebrtimin e tij.<\/p>\n<p>N\u00eb muajin prill t\u00eb vitit 2019, Aktgjykimi 3532\/07 i GJEDNJ b\u00ebhet i plot\u00ebfuqish\u00ebm dhe i nj\u00ebjti duhet t\u00eb zbatohet para organeve nacionale n\u00eb m\u00ebnyr\u00ebn q\u00eb ka p\u00ebrcaktuar gjykata n\u00eb vet\u00eb aktgjykimin.<\/p>\n<p>Konkretisht, sipas nenit 46 t\u00eb Konvent\u00ebs evropiane p\u00ebr t\u00eb drejtat dhe lirit\u00eb e njeriut, shteti i cili e ka n\u00ebnshkruar dhe ratifikuar t\u00eb nj\u00ebjt\u00ebn, obligohet q\u00eb ti respektoj\u00eb dhe ti zbatoj\u00eb vendimet e GJEDNJ, kurse respektimin dhe implementimin e vendimeve t\u00eb GJEDNJ sipas t\u00eb nj\u00ebjtit nen e monitoron Komiteti i ministrave.<\/p>\n<p>Implementimi i aktgjykimeve realizohet duke marr\u00eb masa (individuale dhe\/ose t\u00eb p\u00ebrgjithshme) nga ana e shtetit t\u00eb paditur.<\/p>\n<p>Masat individuale n\u00ebnkuptojn\u00eb paras\u00ebgjithash heqjen e pasojave, q\u00eb n\u00eb rastin konkret do n\u00ebnkuptonin regjistrimin e subjektivitetit juridik t\u00eb Kryepeshkopat\u00ebs greko-ortodokse t\u00eb Ohrit pran\u00eb Patriarkan\u00ebs s\u00eb Pej\u00ebs si komunitet i posa\u00e7\u00ebm fetar.<\/p>\n<p>M\u00eb sakt\u00ebsisht kjo rregullohet me aktet pozitive nacionale, m\u00eb sakt\u00eb Ligjin p\u00ebr implementimin e vendimeve t\u00eb GJEDNJ n\u00eb nenin 5 fq. 1 p. 12 ku precizohet se \u00e7ka n\u00ebnkuptojn\u00eb masat individuale. Nga na tjet\u00ebr, me dispozitat nga neni 22 deri n\u00eb nenin 24 rregullohet procedura e implementimit t\u00eb aktgjykimit p\u00ebrfundimtar t\u00eb GJEDNJ. Me nenin 25 rregullohet se shteti (d.m.th Republika e Maqedonis\u00eb s\u00eb Veriut) do ti nd\u00ebrmerr t\u00eb gjitha masat individuale nga ana e subjekteve nga neni 24 (shiko nenin 24 t\u00eb Ligjit) <strong>p\u00ebr heqjen e shkeljes dhe pasojave t\u00eb ndodhura nga shkelja e q\u00eb p\u00ebrcaktohet nga shkelja e konstatuar dhe gjendja e ankimuesit<\/strong><strong>. <\/strong><strong>N\u00eb rastin konkret, kjo do t\u00eb n\u00ebnkuptonte anulimin e vendimit t\u00eb shkall\u00ebs s\u00eb par\u00eb dhe t\u00eb gjitha vendimeve t\u00eb tjera q\u00eb kan\u00eb konfirmuar t\u00eb nj\u00ebjt\u00ebn dhe pranimin e k\u00ebrkes\u00ebs s\u00eb themeluesve t\u00eb Kryepeshkopat\u00ebs greko-ortodokse t\u00eb Ohrit pran\u00eb Patriarkan\u00ebs s\u00eb Pej\u00ebs<\/strong> p\u00ebr regjistrim n\u00eb Regjistrin e Gjykat\u00ebs themelore Shkup 2 dhe <strong>REGJISTRIMIN e Kryepeshkopat\u00ebs greko-ortodokse t\u00eb Ohrit pran\u00eb Patriarkan\u00ebs s\u00eb Pej\u00ebs n\u00eb t\u00eb nj\u00ebjtin regjist\u00ebr<\/strong><strong>.<\/strong><\/p>\n<p>Por, edhe pse me iniciativ\u00eb t\u00eb aplikant\u00ebve para organeve dhe gjykatave nacionale kishte filluar procedura e implementimit t\u00eb k\u00ebtij aktgjykimi, i nj\u00ebjti edhe m\u00eb tej nuk \u00ebsht\u00eb implementuar n\u00eb t\u00ebr\u00ebsi.
